Oscar-winning screenwriter Roger Avary has been arrested on suspicion of manslaughter and driving under the influence after a Ventura County car crash that killed a man and injured Avary's wife, authorities said.

Avary, 42, was the driver in the single-car collision shortly after midnight Sunday in Ojai, said Capt. Ross Bonfiglio of the Ventura County Sheriff's Department.

Killed in the accident was Andreas Zini, 34, a resident of Italy who was apparently visiting the couple. Firefighters cut Zini from the car with Jaws of Life, and he died several hours later at Ventura County Medical Center.

Avary's wife Gretchen, 40, was ejected from the car and found in the road by deputies, Bonfiglio said. She was hospitalized in stable condition.

Avary was booked but later released on $50,000 bail, Bonfiglio said. He did not know whether Avary has hired an attorney.

Avary won an Academy Award along with Quentin Tarantino for writing "Pulp Fiction," and was also a co-writer of the recent epic "Beowulf." He and his wife live in Ojai, a popular artists' colony and tourist destination 14 miles north of Ventura.

The wife/passenger: tossed from the car, in stable cond.

The drunk driver: OKAY!!!

i live in south korea,
and for a small fee,
you can call a service
and within minutes a driver
will show up at a bar or restaurant
or party, to drive you home
in YOUR vehicle. 10-15 bucks.

of course in america,
it would only take one
accident by one of these drivers
to shut the entire industry down in
a class-action suit (see: lawyer takes all the money).

america could spare hundreds if not thousands of lives a year with such a service.
not to mention, the ruin of thousands of lives
with dui's.

but america is all about setting a trap,
then crucifying. it's the way the man
keeps everybody down. soon, america will
be just a penal colony - australia in reverse.

america could use legal reform.
this is not to say that "trial lawyers"
are bad. the system is bad.

We have roadside bars or attend friends' houses, accessible only by car, where people drink all night. In most cases, though not this one, these are lonely people who arrive and leave alone, no designated driver to be found. Only in a few cities is there adequate public transportation or is the bar within walking distance. DUI is another casualty of a car dependent environment. Mass transit is the answer, but we're too busy bombing where we don't belong to solve our own problems. People are not going to stop drinking and driving no matter how stiff the penalty. They're drunk, but they rarely think they are, or they think, "I'm good enough to drive." When drunk, judgment is gone.

The majority of people whom I have known that were injured or killed on the road were either drinking themselves or in an accident caused by a drunk.

Often the drunk is a repeat offender. Often with a suspended or revoked license, no insurance, etc.

Medical alternatives to accountability by incarceration do not work nearly well enough to justify the expense.

Many drinkers do not care if they are caught, either because they are alcoholics or they just don't believe that they will be accountable.

After all these years of fiddling around with this I think the only solution zero tolerance and mandatory jail time, mandatory minimums... no plea outs, no treatment alternatives. One DUI and you go to jail for two years and lose your license for five years. Period. Get caught DUI after doing time for it and its five years in jail, and without the license... go back to jail for an additional two years....

Make it so that anybody who takes the risk once and gets caught not only won't do it again soon because they are in prison but will also serve as a warning to others.

Do this for a few years and the message will get across and the numbers will drop.

Take the money we waste every year funding treatment contractors and spend it on jail space. We have tried every other technique to no avail.

No matter if you are a moviestar, a mayor or a mom... no exceptions.

Driving drunk should be treated like attempted homicide, assault with a deadly weapon, assault with intent to do great bodily harm.

This is the only message strong enough to get it across that DUI can not be tolerated.
The costs to society are huge. Insurance, property damages, etc...

Driving is a privilege and it isn't regulated nearly well enough.

Alcohol consumption is glorified as much or more so than even handguns in this country. People think they're cool "mavericks" when they drink and do reckless, stupid things. Most US cities, you can't go a block without encountering another corner liquor store. This country needs to sober up and get off the booze. Alcohol is for pussies and the weak.

It's regrettable that someone is dead and someone seriously injured as a result of this person's drinking. But even more regrettable is that today, somewhere in this country, someone else is going to die because of booze. It'll happen in an auto accident or domestic argument or in a bar fight. Booze just makes people do stupid things that have a tendency to become ugly things.
I offer no solutions. The only thing that I put on the table is the fact that booze, used irresponsibly---as it often is---spells trouble.
So many of the bad decision we---all of us---have ever made have a single common denominator: booze.
What can you say?

Doesn't anyone wear seat belts in LA-LA Land?

BTW most drunk-driving fatalities involve drivers who are 2X-3X the legal limit. They don't care about the law. My cousin was killed (murdered?) by a driver drunk out of his mind who had his license suspended/revoked multiple times.

Lowering the current level of impairment will only make criminals out of otherwise innocent civilians. The cops will sit outside all the wedding halls and restaurants, making their quota of arrests, but not stopping the real criminals who are throwing them down at the local gin mills.

If you really want to stop repeat drunk-driving, take away the car and don't give it back! Sell it at auction to pay for the costs. If it's somebody else's car, fine the owner $1,000 to get the car back.

The efforts of government to legislatively curb DUI have been insincere. By enacting laws which permit the drinker to have one or two drinks and still fall below the legal blood alcohol limit, government has caved in to the alcohol seller's lobby, while creating the illusion of controlling drunk driving. Consider that after a drink or two, a drinker who planned to have only one or two drinks, is likely to have more, because of his lowered inhibitions. He then becomes a dangerous driver and a candidate for DUI.
Many fine people have had their reputations, careers, and lives ruined by a DUI conviction. Even more innocent people have lost their lives, on and off the highway, because of alcohol abuse.
There is an effective step we can take. We can reduce the legal limit to zero blood alcohol. People will know with certainty that they cannot drink and drive. Alcohol sellers will know it too.

A - B - OR - C

I have millions of dollars and not a long enough lifetime

to spend it all. I like to drink alcohol and plan on

going out for the evening. So I

A) Hire a driver for the night. The expense is not an issue.

B) Call a non-drinking friend to drive

or

C) Take a chance and drink and drive.

I would choose A or B. The truly weathy drinker always seems to choose C.
