OCALA, Fla. — Action star Wesley Snipes was found not guilty of federal tax-fraud and conspiracy charges Friday, but was convicted on three misdemeanor counts of failing to file a tax return.

Snipes had faced up to 16 years in prison if convicted on all charges, but can now only get up to three years. The "Blade" star and two co-defendants had been indicted in 2006 after Snipes stopped paying, using tax protest arguments long rejected by the courts.

Snipes sat emotionless as his verdict was read, then nodded in relief. He refused to talk with reporters after the verdict, and is still liable for millions in taxes likely to be pursued in civil court.

"Mr. Snipes has always been committed to doing the right thing, and after this trial is over he'll make whatever amends are required," defense attorney Robert Bernhoft said. "But this is a man of integrity."

Snipes' lawyers argued that he was a victim of crooked advisers, and the jury seemed to believe it. Co-defendants Eddie Ray Kahn, the founder of a tax protest group, and Douglas P. Rosile, an accountant who lost his licenses, were convicted Friday by the same panel of tax fraud and conspiracy. Both face up to 10 years in prison.

The government said Snipes failed to file tax returns from 1999 to 2004, a period in which he signed two contracts for more than $10 million on sequels in the "Blade" trilogy.

The actor, who also appeared in "White Men Can't Jump," is among the most famous targets of an IRS criminal investigation, and his prosecution was key for the government.

"We thought there was sufficient evidence for a conviction on all counts, but obviously the jury disagreed," U.S. Attorney Robert O'Neill said.

Snipes used bizarre arguments to justify his position, saying the IRS' own code meant income earned in this country wasn't taxable, and the agency had no legal authority because it's not a proper government entity.

Later, the actor threatened the government and individual agents in his pursuit, declaring himself a "nonresident alien" not subject to tax laws.

Prosecutors say Snipes paid taxes in the 1990s, but changed his mind after meeting Kahn in 2000. He allegedly stopped filing returns, illegally sought $11 million in 1996 and 1997 taxes paid and drew fake checks to pay the U.S. Treasury.

Kahn founded the central Florida tax protest group American Rights Litigators and its successor, Guiding Light of God Ministries. He has been using tax scams since at least the early 1980s, according to government documents, and refused to defend himself in court against these charges.

Rosile, a CPA who lost his licenses in Florida and Ohio, allegedly prepared the fraudulent documents for Snipes, along with numerous other Kahn clients.

Judge and jury have long rejected their ideas, but there were exceptions.

The IRS bears a unique burden of proof in criminal tax cases. It must show not only that someone broke the law, but he or she did so with willful, bad purpose to defraud the government.

A few defendants have won acquittal because the jury thought they sincerely believed they did not have to pay.

Just one more thing Cowtippin. Greed is color-blind. These so-called 'Cards' (Race, Gender, Sex preference etc.) piss you and others off so much, look beyond the labels and see the facts. When is the last time you seen a Black farmer? If he talks about unequal availability of loans from the FHA, is that the race card? Wesley Snipes money is a drop in the ocean. But it is enough to get you pissed off. Before there was the 'Race Card' there was the 'Race Question'. Our DNA is 99.9999 similar, yet according to our Constitution I am 3/5 a man.
U.S.A. was founded by Merchants & Lawyers, and at the end of the day they are the only folks who succeed in pimpin' the system.

I bet you if I didn't pay my taxes, I would go to jail. Society is so screwed up. First OJ and Robert Blake get to kill their wives and don't go to jail, Lindsay Lohan and Britney Spears are caught driving under the influence or getting into hit and run accidents, and now Wesley Snipes gets off even though he didn't pay his taxes. This society is so screwed up.

God bless Mr. Snipes. We had a country without an income tax for over 100 years, perhaps it's time to reconsider its usefulness.

When an income tax is used to make the rich richer and poor poorer, it's time to abolish it or fix it. It is a vastly powerful tool of either justice or cruelty.

In America it is being used for evil and Mr. Snipes is a hero for exploiting all the illegalities and injustices of the current income tax.

Always question authority.

This is not difficult. The man made millions, he had a societal obligation, all this bs re: no defintion of income, taxes are unconstitutional is just that, bs. Yes a lot of the performers are unsophisticated in fin'l matters, some with the comprehension of street actors with money. But I have a hard time believing someone of Mr. Snipes' stature is that nieve. Perhaps he got lucky and the jury was more nieve. And the comment on the studios not paying his taxes, come again? In most cases the studios profit particpation statements will reflect "expenses" that have as much reality as Bush's intelligence.

I don't like what the gov't does with the money, but it is against the law not to file and pay. The gov't needs to go to a postcard system for the vast majority of working class and beef up enforcement against the affluent.

Powerful individuals and organizations that do not pay their legally required and fair share, with impunity send a distinct signal to all taxpayers that cheating on their taxes is an acceptable practice of citizenship.
Gradually, the entire tax collection system is corrupted which accelerates the decline of the organization, in this instance, our American Republic. When selfishness, self-centeredness and speculation submerge selflessness, public interest and earned income both the guilty and innocent are equally corrupted. The society loses its will and energy to grow and develop.

What alot of people don't realize is that this is the studio's fault... Snipes name was on all the movies he did and the studios decided not to pay the taxes on it and didn't tell him this... So Snipes was left with the taxes to pay on the amount of money his movies made, thats why he was acquitted. That is also why no one in Hollywood has emerged as a solo action hero. Noticed how alot the action movies with one star(non-comic book) are going straight to DVD... Snipes didn't know they were leaving him with the taxes to pay, where a Matt Damon has the studios to pay the taxes on franchise movies such as the "Bourne" movies or Spiderman. It also depends on the studio your dealing with. If it is NOT a blockbuster film and the solo actor doesn't know better, the studio will opt not to pay the taxes due to low profits; leaving it to the actor. But Snipes was guilty for not filing taxes for some years.

Next up, how many Americans will actually refuse to pay their taxes to support the illegal wars in Iraq and Afghanistan? If he refused to pay to protest those, then I'd be impressed. But not today.

I think that his defense seemed pretty shitty. A 'non-resident alien' how exactly does that work? The real fact remains that there is no identifiable law on the books that says that you must file an income tax. In the tax code it also says that it's a system of 'voluntary compliance', not sure how that works when you end up in 'tax court' for not voluntarily shipping your money to them. But there are documented cases of defendants being let off because there is simply no law to have been broken. That's probably the only legit defense. Also somehow the IRS has conveniently not defined what 'income' means in all there thousands of pages, sounds shady to me. .
But if you are uneducated about the 'income tax' and the IRS you should give America: Freedom to Fascism a look. I mean hell they interview the guy that wrote the tax code and he still can't cite the law..

I'm just confused by all of this. Why do show business millionaires often end up making such terrible financial decisions? I make less than $100,000 a year and my accountant is quite competant.

Its just weird. If you make millions and get famous are you suddenly obligated to hire insane people to manage your finances?

What is that about?
