Sex Assault Suit Against Halliburton Killed

A mother of five who says she was sexually harassed and assaulted while working for Halliburton/KBR in Iraq is headed for a secretive arbitration process rather than being able to present her case in open court.

A judge in Texas has ruled that Tracy Barker's case will be heard in arbitration, according to the terms of her initial employment contract. Barker says that while in Iraq she was constantly propositioned by her superior, threatened and isolated after she reported an incident of sexual assault.

KBR had moved for Tracy's claim to be heard in private arbitration, instead of a public courtroom, as provided under the terms of her original employment contract.

In arbitration, there is no public record or transcript of the proceedings, meaning that Tracy's claims will not be heard before a judge and jury.

I am sure corporations are creating their own "Halliburton model" to do away with such legal annoyances as sexual harrassment. If it can work in this area why not other areas like racial discrimination as well. It looks like giving up your Constitutional rights will become a standard condition of employment. All issues will go to secret binding arbitration. It is a good business plan. Kind of makes you proud to be an American.

The point here is that sexual harrassment and assault are ILLEGAL. These charges are not an ordinary complaint. Agreeing to arbitration when signing a contract may be useful for disagreements, or "civil" misunderstandings.
Sexual harrassment, discrimination and assault are both illegal under federal (and all state) laws. These charges are the basis of criminal activity, and should be dealt with as such. If Halliburton/KBG employees engaged in such conduct, they should be tried in court on criminal charges, and not allowed to slip away with a small financial settlement.

most people dont understand the bigger point here. virtually every contract you sign now a days, from buying a car to a cell phone contains this binding arbitration clause. hardly anyone is aware of it,but if you are aware and refuse to agree to it, you will be told to walk.
once you lose the right to sue, the results from arbitration are always the same.

As far as this women signing an agreement to prevent her suit in open court in my opinion was her mistake for agreeing to it. I understand it was a condition of emplyment still though it seems unfair but she signed it. What I want to knoo though regardless of her civil action, where the hell is the criminal aspects of this case? I guess Haliburton can have their employees rape others without being criminally prosecuted. Soldiers cannot get away with that, how can US contractors get away with it?
