Bush Administration Trying To Stop Fraud Reporting By War Contractors Abroad

WASHINGTON — House Democrats demanded documents Thursday about a multibillion-dollar overseas contracting loophole to track down how _ and why _ the Bush administration slipped it into plans to protect taxpayer money.

Leaders of the House Oversight and Government Reform Committee gave the administration until April 4 to turn over the documents or, aides have said, face a possible subpoena.

The controversial loophole has irked Democrats and Republicans alike. But it has the support of a trade association that lobbies on behalf of giant global government contractors, including Blackwater USA, KBR Inc., Boeing Co., CACI International Inc. and Lockheed Martin.

The United States has spent more than $102 billion over the last five years to help rebuild Iraq and Afghanistan. In that time, the Justice Department has uncovered at least $14 million in contract bribes in those two nations alone.

"Preventing fraud by contractors overseas should be a high priority," Democrats wrote in letters sent to the White House Office of Management and Budget and four other executive agencies. "Instead, the exemption for contracts to be performed overseas appears to have been inserted in the rule late in the process and against the wishes of the Department of Justice, which raises serious questions as to why and how such a policy was developed."

The letters were signed by House Oversight Chairman Henry Waxman of California and committee members Reps. Edolphus Towns of New York and Peter Welch of Vermont. Welch, who first called for the investigation, vowed "to get to the bottom of this."

"Who snuck this in at the eleventh hour and why?" Welch said in a statement. "No contractor should be given a free ride to defraud taxpayers, at home or abroad."

OMB spokeswoman Jane Lee said Waxman's request was being reviewed and that the rule in total would help curb fraud, but she declined to discuss the loophole.

Letters also were sent to the Justice and Defense departments, NASA and the General Services Administration.

Thursday's demand marked the first step in a congressional inquiry of the loophole that was quietly slipped into plans otherwise aiming to crack down on waste, fraud and abuse of taxpayer dollars spent on government contracts. The loophole was first reported last month by The Associated Press.

The government spends an estimated $350 billion a year on contracts.

Last May, facing growing cases of fraud and increasing spending overseas, the Justice Department introduced plans to force companies to notify the government about evidence of contract abuse worth $5 million or more. Currently, contractors report evidence of abuse on a voluntary basis, and the number of company-reported fraud cases has declined steadily over the past 15 years.

By November, after it left the Justice Department and was published in the Federal Register, the proposed rule specifically exempted "contracts to be performed outside the United States."

The Justice Department and the Office of the Special Inspector General for Iraq Reconstruction have asked the exemption be eliminated before the rule becomes law. Additionally, Sen. Charles Grassley, R-Iowa, has threatened to block the loophole in the federal budget if the administration does not do away with it.

OMB's Office of Federal Procurement Policy has repeatedly declined to comment on the loophole or how it was added to the overall fraud crackdown.

The House inquiry is looking at whether the exemption was added at the request of private firms, or their lobbyists, to escape having to report abuse in U.S. contracts performed abroad.

Alan Chvotkin, executive vice president of the Professional Services Council, says the loophole merely follows long-standing Defense Department policy that only covers domestic contracts. Without the exemption, Chvotkin said, U.S. firms that subcontract out work to foreign businesses could be unfairly held liable for abuse that they have little or no way of preventing.

The Arlington, Va.-based Professional Services Council represents more than 300 government contractors and other businesses. Chvotkin said the lobbying firm did not ask for the loophole but agrees with it. The Professional Services Council is among firms and other business groups, including the U.S. Chamber of Commerce, that oppose the overall rule.

"We're not trying to exempt companies or suggest that fraudulent behavior in overseas contracts should go unpunished," Chvotkin said in an interview this week. "If somebody's guilty, hold them accountable. We've just stopped short of mandatory disclosure as part of a government-wide rule that goes everywhere for everything."

The rule _ with or without the loophole _ could become law at any time.

"It's hard to imagine that the Justice Department won't fight to eliminate this exception before the rule becomes final," said former prosecutor David Laufman, now a defense attorney in Washington.

There is a law dating from the Civil War, that allows any citizen to bring a suit against a company
that defrauds the government and get a percentage of the recovery and penalties imposed on the
company (I think it's 10%, and is known as the Lincoln Law). It helps to be a lawyer and have the
means to work on spec. Incidentally, the NRA has been abusing its' tax exempt status for years by
sending out blatantly political material, and claiming that it's educational. Knock down a few million
and leave them without a pot to piss in. I wait for the day.

I was around when the government concentrated on stopping the fraud itself. Guess that speaks volumes to the current state of affairs in this country.

Funny I should use that word! It gave me a great idea!

A Democrat has an "affair", which we know is concentual, and the GOP are all over that "sinner" to step down. Yet the GOP are having their way with us, all the while claiming it's concentual. Couldn't we say, then, that the GOP are having an affair with almost everyone in this country, and impeach this administration under its own moral code?

If lying, murder, treason and torture don't seem to be valid reasons for the Democrats to impeach, perhaps global fornication would! We can just refer to it as "global affairs", and ask the government to do it's jobs based on moral misconduct!

CNN reported a story last night that Iraq’s oil production has been exceeding pre-war production for the last 2 years in a row, 48 billion in 2007 alone, which begs the question why can’t they start paying for their own reconstruction. When the journalist asks this question of a State Department official, the answer was, they do not a have government in place to distribute the money, and correcption was a problem. I thought 90,000 citizens of Iraq, (militias on both sides we are paying off), were rising up to expel the terrorist. I thought Iraq had an elected government. My question is where is all that money going, and why is oil $108 a barrow considering oil production is exceeding pre-war production.

Good Comment. Where exactly is this money going or for starts where is it, Swiss Banks? Add this to previous US money they haven't spent and you wonder why we are still including reconstruction costs in the never ending Bush war funding requests. When are the Dems in Congress going to wise up and at least cut this part of the funding, a cut that would not impact troop safety.

It is so obvious to the rest of the world that this is why we are there, but thanks to our controlled media America just cannot believe it, even though thousands of our soldiers have been dying, and our economy is reaching disaster conclusions. we are getting absolutely nothing for all this, but it is obvious someone is, or will be.
It is also obvious that if we made the choice to get these greedy bastards to loose their death grip on these reserves and let other countries help to manage a smooth transition to where Iraq could step up to take their place as a world supplier, then we could bring our forces home and go on with life here. Seeing things this way and how impossible it seems to be sheds light on those who are really in control of our nation.... The corporations. Thanks a lot, W.

This exactly I'm not wild about any of our candidates. Their job as senators is to provide some sort of oversight on this ... If one of them actually did their jobs, representing the people (instead of their own presidential bids based on nothing) I'd be thrilled. As is, it looks like the dems on both sides are destroying each other over whether to vote for coke or pepsi.

It has been long reported by many that oil production has never recovered. Maybe CNN is trying to out fox FOX. The following are an example of the many sources that dispute the claim:

Four years after the fall of Saddam Hussein, the story of Iraqi petroleum remains one of great promises unfulfilled. Iraqi oil did not pay for the first round of postwar national reconstruction, as Bush administration officials had predicted. Nor has the industry come close to matching its decades-old pumping record of 3.7 billion barrels a day – a level at which Iraq might become a vital source of oil for thirsty world markets.
That need can be seen in the nation's production levels. In the first quarter of 2007 Iraqi crude oil production averaged 1.95 million barrels per day, according to the US Special Inspector General. That's far short of the Iraqi goal of some 2.5 million BPD.

For one thing, the labor unions of Iraqi workers in the oil industry are striking to prevent the US from taking over particular production fields. (google that for interesting reading)

For another, the estimated oil profits from the fields designated for foreign (US) exploration is in the 21 trillions. (google Hydrocarbon Law)

Any oil profits garnered by US interests in Iraq will be kept by the oil companies and their parent corporations and stockholders. Except for taxes, none of the monies generated by oil profits will be returned to the US Treasury's General Fund, from which the war was funded, nor will these monies be used to pay off the massive US debt incurred by the war itself, for wounded veterans of the war, or for the families of dead soldiers. Those funds will continue to come from taxpayer dollars.

He threw everything into total "loser " mode with that statement, when he had the opportunity to actually say what needs so desperately to be said- that this is not a war at all!!!
It is an occupation!
Someone needs to tell him with the ferocity of a bitchslap- "Hey Reid- AMERICA DOES NOT LOSE WARS!!"
Dems should get smart once and for all and refuse to let the right stand on any moral high ground by arguing that this isn't a war at all; only Bush's idea of a war. Or Cheney's idea- 2 losers, one who hid behind his daddy;s trousers so he wouldn't have to face the Vietcong, another who "had more important things to do."
