Starbucks Sued In New York Over Baristas' Tips

A former barista sued Starbucks on Thursday, accusing the company of cheating thousands of baristas in New York State by giving a share of their tips to shift supervisors.

In papers filed in Federal District Court in Manhattan, lawyers for the barista, Jeana Barenboim, asserted that Starbucks had violated a state law that bars employers or agents of an employer from receiving part of workers' tips.

This was not the first time Starbucks has been sued by its baristas over a share of the tips. Starbucks was ordered by a judge in California last month to pay more than $100M in back tips, an order which CEO Howard Schultz has said the company would be appealing.

I think this case has a point. When you tip somebody at a counter you don't expect part to go to the manager.

i can understand that you want good service in order to tip, but do you know how many people DON'T tip when the service is good? they don't even think about these kids trying to make a living on minimum wage and how much throwing the coinage change in the tip box would help them pay their bills. please think about tipping these hard working employees, but not, of course, if you think your service was bad.

I think it comes down to the fact that even in retail, we like to divide those up into social classes. If you're working the counter at McDonald's, you're considered worthless to society. Therefore, no tip necessary. You work at Starbuck's, and it's like you're just a valuable member of society who is paying the bills to get through college. Therefore, you deserve to get more money because you're in "transition." In other words, white collar people doing blue collar jobs get "tipped." You're a waiter, you get tipped. I go to McDonald's for my $2 ice coffee that's as delicious as Starbuck's (actually, more delicious), and it's not acceptable to leave a tip. I feel obligated to leave a tip at Starbuck's even if the crew are looking at me like I'm a problem because they have to do their jobs and get me a drink.

We should all be gratefull for lawyers willing to take on such class action lawsuites for the little guy. And they'll do it for the virtually insignificant fee of 40% of the settlement (plus costs and expenses incured in reaching the settlement).

They have such big hearts.

no kidding! wow - a lot of Mr Pinks out there - tip your barista like you do your bartender - from someone who worked in the service industry for a long time and was paid a lot less than the minimum wage (in TX min wage for tipped employees is $2.13 - YIKES) I think it's great that they get paid $9-11 an hour AND pick up tips - good for them

Obviously there are some lawyers who don't think they're making nearly enough money yet, because that's who's going to benefit the most.

Also, as was explained by several people on the previous story about CA, shift supervisors actually do do the work behind the line. They're not the same as managers at all.

As a NY'er, I draw the line at tipping Baristas- yeah they have a tough job, but tips sho go to people who make less than minimum wage and survive on them, not cashiers. If you are making 9-11 bucks an hour slinging coffee, you shouldn't get tips, because you don't get taxed on them like waitstaff/bartenders/bussers do.

Dunkin Donuts...please I'm not tipping those people for walking to a tray and pressing a few buttons on a pos machine.

As much as I would hate to share my tips with someone that wasn't serving the customers as much as I was [if that is the case], I can't support anyone at Starbuck's that complains about MONEY!

With the prices they charge for the simplest thing- we should be getting REFUNDS, not GIVING tips! I worked as a barista at an independent coffee shop in a college town. We roasted our own coffee beans, had a WIDE selection of roasts and beans from around the world, did foam art, and actually tried to educate our customers on the different coffee and espresso drinks.

What does Startbuck's do that is SO WORTHY of tipping?

Why are we tipping these people? We don't tip the folks at McDonalds or Burger King? Are we that thankful for the little cardboard wrapper around the hot cup of $5.00 coffe that keeps us from burning our hands that we feel the need to give more of our money away? Maybe that's why were in a Recession. Were giving our mortgage money to the kid who so delicately pours a cup of coffee for us.
