WASHINGTON — Just months before President Bush leaves office, his administration is antagonizing environmentalists by proposing changes that would allow federal agencies to decide for themselves whether subdivisions, dams, highways and other projects have the potential to harm endangered animals and plants.

The proposal, first reported by The Associated Press, would cut out the advice of government scientists who have been weighing in on such decisions for 35 years. Agencies also could not consider a project's contribution to global warming in their analysis.

Reaction was swift from Democrats and environmental groups.

The chairman of the House committee that oversees the Interior Department, Rep. Nick Rahall, D-W.Va., said he was "deeply troubled." Sen. Barbara Boxer, D-Calif., head of the Senate's environment committee, said Bush's plan was illegal. Environmentalists complained the proposals would gut protections for endangered animals and plants.

"This proposed rule ... gives federal agencies an unacceptable degree of discretion to decide whether or not to comply with the Endangered Species Act," Rahall said.

Interior Secretary Dirk Kempthorne defended the revisions, saying they were needed to ensure that the Endangered Species Act would not be used as a "back door" to regulate the gases blamed for global warming.

If approved, the changes would represent the biggest overhaul of endangered species regulations since 1986 and accomplish through rules what conservative Republicans have been unable to achieve in Congress: ending some environmental reviews that developers and other federal agencies blame for delays and cost increases on many projects.

In May, the polar bear became the first species declared as threatened because of climate change. Warming temperatures are expected to melt the sea ice the bear depends on for survival.

"We need to focus our efforts where they will do the most good," Kempthorne said in a news conference arranged hastily after the AP reported details of the proposal. "It is important to use our time and resources to protect the most vulnerable species. It is not possible to draw a link between greenhouse gas emissions and distant observations of impacts on species."

The rule changes unveiled Monday would apply to any project a federal agency would fund, build or authorize that the agency itself determines is unlikely to harm endangered wildlife and their habitat. Government wildlife experts currently participate in tens of thousands of such reviews each year.

The revisions also would limit which effects can be considered harmful and set a 60-day deadline for wildlife experts to evaluate a project when they are asked to become involved. If no decision is made within 60 days, the project can move ahead.

"If adopted, these changes would seriously weaken the safety net of habitat protections that we have relied upon to protect and recover endangered fish, wildlife and plants for the past 35 years," said John Kostyack, executive director of the National Wildlife Federation's Wildlife Conservation and Global Warming initiative.

Under current law, federal agencies must consult with experts at the Fish and Wildlife Service or the National Marine Fisheries Service to determine whether a project is likely to jeopardize any endangered species or to damage habitat, even if no harm seems likely. This initial review usually results in accommodations that better protect the 1,353 animals and plants in the U.S. listed as threatened or endangered and determines whether a more formal analysis is warranted.

The new rules were expected to be formally proposed in the next couple of days, officials said. They would be subject to a 30-day public comment period before being finalized by the Interior and Commerce departments. That would give the administration enough time to impose the rules before November's presidential election. A new administration could freeze any pending regulations or reverse them, a process that could take months. Congress could also overturn the rules through legislation, but that could take even longer.

Between 1998 and 2002, the Fish and Wildlife Service conducted 300,000 consultations. The National Marine Fisheries Service, which evaluates projects affecting marine species, conducts about 1,300 reviews each year.

Some federal agencies and private developers say that process has killed or delayed some worthwhile projects.

"Over the years, the Endangered Species Act has become a regulatory nightmare that kills or stalls even the most well-crafted land-use projects," said Rob Rivett, president of the Pacific Legal Foundation, a group that supports property rights and limited government. "The economy suffers, people suffer, rational environmental planning suffers. Some careful streamlining is long overdue."

Well, this will be the last valentine to his big backers. With the endangered species act neutered agency chiefs can summarily order the approval of just about anything. Get the bulldozers rolling and by the time the next president can restore order there won't be anything left to protect at the site.

Beyond the anti-envir­onmentalis­t aspect of this it also reflects Bush anti-science bias and anti-intellectual bias. Why let those brainy bioligist types get in the way of us building that new dam!

This will hurt the GOP down the line more than Bush. Is he honestly such a sociopath that destroying America to put some hurt on his enemies is the best use he can make of his last few months in office?

I wouldn't be one bit surprised to see Bush become a serial kiler (or FOX commentator) after he's out of office, he's just that psychotic.

I love your response. It is what I think of this president. He's supposed to go on vacation maybe he will stay. He can stay in Crawford and kill animals & birds on his ranch. Or maybe we can go and dig it up for Oil exploration or maybe build a dam on one of his cricks, or have a volcano erupt or have a hurricane blow over it or tornado, severe thunderstorm, flooding, land slids, fires or anything else Mother Nature can think up and see how he appreciates it.

This is breathtaking in scope in terms of what it will mean for the loss of wildlands and open space in this country. The ESA is one of the main weapons that can be used to slow rampant development. I'm not surprised Bush is doing this as he's heading out the door. I just pray that Obama is elected so that he can reverse it (although many development projects will be rammed through in the interim)

I doubt California will, either. I live in Washington State now and I'd say it's probably 50-50 here. This is a terrible, monstrous thing for Bush to do, and therefore not unexpected.

November-January cannot come soon enough.

Here's a thought: did Bush and his "administration" (thugs) make it possible - or likely - for Obama not only to get the nomiation this year but also to win by a landslide? If so, it will be about the only good thing they've done.

Here's an idea: Instead of re-making and revising (read: GUTTING) the ESA, perhaps Republicans would make better use of their energies by overhauling THEIR OWN PARTY.

One of W and the Republican America-Wreckers' big tricks is clouding complex issues by making important "mistakes" in discussing the basic facts. Earlier an obviously "conservative" poster talked about the ESA being used in a Georgia water shortage situation to protect "zebra mussels" over the water interests of humans. Of course, the correct NATIVE mussel species weren't even mentioned in the post. Zebra mussels are a destructive invasive exotic, a real scourge; native mussels are essential cornerstones of native ecosystems. Minor detail.

We must pull the curtain back on each of these sleights-of-hand, because they are how BushCo is pulling off nothing less than a non-military American coup. It's as anti-American as any real or imagined Communist traitor or double-agent spy of the 50's and 60's.

And those of you who help spread these "mistakes", half-truths, smears, and outright lies about the facts of important issues are complicit in what amounts to treason. I suggest you get busy remaking your own party, lest "Republicans" become the new "Communists". Or, worse.

You might even want to think about a name change.

I'd suggest a few, but it would cause the HuffPo censures to dump my entire post.

You asked what anti-environmental acts the Bush Adminstration has committed.

How about....a­ll of them?

No, in all seriousness, Bush's environmental sins are simply too numerous to list, although I imagine someone has done it. (Hmm....no­w that I think about it, I bet science writer and HuffPo blogger Chris Mooney has..)

But, anyway, AZ, If you're truly interested , a quick google of any of the top environmental watchdog groups will provide you with way more information on that topic than is digestible in a reasonable amount of time.

To summarize, this administration has displayed nothing short of malice aforethought regarding the environment and the incredibly bountiful, diverse, and essential living natural resource wealth that our Constitution says we Americans own in common.

BushCo has conducted a Nazi-style blitzkrieg out to scrap, weaken, or nullify every previously existing environmental policy and law. It's as if someone meticulously sat and studied it, possibly for years, with a carefully prioritized hit list.

But, if someone did off the tops of their heads list ten or fifteen of BushCo's worst environmental transgressions over the last 8 yrs, given the current Conservative regard for the factual world, what would that accomplish?

Bush's god approves of and encourages the unfettered exploitation and wanton destruction of Earth's natural systems. If any part of Earth breaks, and it's important, He'll fix it without our help, Bush and his ilk like to say.

Bush's god isn't interested in stewardship of "the commons", and supports His followers' theft of the assets and wealth that we all own together in undivided public partnership.

Bush's god isn't democratic. He isn't nonpartisan. He isn't interested one iota in the American Way, in true patriotism, or even whether our country and her people survive or thrive.

And neither is Bush.

Unless you have your own well, you're probably already paying for the water. Charging for air is a bit more problematic, but there'll be big profits in the essential filter masks when pollution finally makes the entire atmosphere fatally toxic to all life.

Bush looks outside his door in Crawford Texas, and uses that as a reference for what he thinks "wilderness" should be. Anything more then some sagebrush and the odd Jack Rabbit is just waste. So why not make some money out of it?
