Two weeks ago, when the Huffington Post reported that the "infanticide" charge against Barack Obama was gaining traction in right-wing circles, the Illinois Democrat's campaign had not placed the issue on its "Fight the Smears" website. According to an Obama aide who spoke on background, the campaign did not see a compelling reason for lending greater profile to the attacks with a full-blown response.

On Wednesday, however, the campaign posted an exhaustive rebuttal to the "infanticide" charge -- a tacit admission that the controversy over a spate of anti-abortion bills that Obama opposed as an Illinois State Senator is not going away.

The event that forced the Obama camp's hand was a new push by the National Right to Life Committee. Late last week, the group announced that it had obtained details of a 2003 committee vote that contradicted Obama's past explanation for his opposition to the Born Alive Infant Protection Act while serving in the State Senate.

In past statements, Obama had described his opposition to multiple versions of the bill as stemming from concerns that the bill could endanger Roe vs. Wade. The first two iterations of the Illinois bill did not contain language that explicitly re-affirmed abortion rights granted under Roe. The NRLC now points out that the 2003 version contained a "neutrality" clause similar to that of the federal version -- for which Obama says he would have voted.

Thus, the NRLC announced that it had discovered the mendacity and manipulation at the heart of Barack Obama's pro-choice position: support for the grave charge of "infanticide."

Since Obama initially carved out his response to the controversy on Roe-centric grounds, any maneuvering he performs now might seem like a slimy cover-up to low-information voters. But as the campaign's fact sheet reveals today, there were numerous other reasons for a pro-choice politician to stand against the Illinois legislation at the time, outside of a furtive desire to kill children.

Those reasons included the fact that the Illinois legislation was bundled together with a measure that threatened doctors with criminal prosecution if they incorrectly applied the Born Alive bill. When NRLC legislative director Douglas Johnson claims that Illinois Senate bills 1082 and 1083 had no relationship outside of being sequentially numbered, and that they "were not in any way linked," he is either under-informed or willfully bending the record. Both bills were introduced by the same senator, and the Born Alive act only passed when the doctor-intimidation measure was dropped in 2005 (after Obama had moved to the U.S. Senate).

A local AP wire story (not available online) from March 9, 2005 reflects the reality that the two bills were always considered connected. Reporting on the passed version of the Born Alive measure, the agency wrote: "Unlike earlier versions that failed, this bill does not spell out what medical care doctors must provide when an abortion procedure ends in a live birth. The legislation also specifically says it has no impact on Illinois abortion laws."

In addition, Obama's Wednesday fact sheet appropriately makes the distinction between federal and state roles in regulating abortion. Put simply, the U.S. Senate was at greater liberty to expound on the definition of "born alive" infants, since it plays a rather small role in regulating abortion practice. States, on the other hand, must make sure that any new definition of "born alive" can comport with other existing statutes. As Planned Parenthood's Illinois chapter wrote in its own policy memo: "Federal law does not regulate abortion practice. That is left to the states. Therefore, it is state legislation that would affect abortion practice in Illinois."

Given the headache-inducing wonkery at work, it's not hard to understand why the Obama campaign didn't immediately dive into the Senator's past policy to rebut a charge that fared so poorly for Alan Keyes in his 2004 Senate campaign.

But with the resurgent Born Alive debate rating coverage on the Christian Broadcast Network as well as The Washington Post and The New York Times, the Obama campaign now apparently feels that traveling into the weeds of the issue is less damaging than allowing the NRLC's charges to go unchallenged.

Really? I just don't believe that a father of two young girls who has no problem displaying his love for them on national tv would support that babies born alive - under any circumstances - should be "left to die." He states the reason he voted against them is because they left a back door to destroy Roe v Wade. I believe him until I see absolute proof that he actually wants babies to be left to die!!!

It's just a smear campaign by the repugnantcans!

How is looking at Obama's past votes and comments a smear? He knows some of his past is shameful, especially these votes on protecting born alive infants, and he's been running from them since, except in front of NARAL audiences.

This will not go away. These votes are chilling and the Obama campaign is going ape over this. For these votes to come back to haunt him is good. His is an extreme position on abortion and the American people need to know just how extreme his position is. Pro-abortion folks have been losing ground since people started hearing about partial birth abortion and for good reason. It is infanticide.

For the poster who claims that killing a born alive child has been illegal since 1800 in IL he is wrong. The law at the time protected only babies who were intended to be born alive, not babies who were intended to be aborted but happened to be alive after a botched abortion.

Please visit www.jillstanek.com. She is the nurse who testified in front of Obama about comforting a Downs Syndrome baby for 45 minutes after he was left to die in a soiled utility closet. She's the one who blew the whistle on the hospital's practice of leaving born alive babies to die in cold metal tins, then lost her job before campaigning on this issue.

I hope this issue is in the news every day until Election Day because Obama needs to answer for these votes. His lack of a moral compass on this issue is astounding, and shows just how easy it is to be blinded by ideology.

Oh and as I've learned from my far-right family members(30%ers), they still are not on board with McCain, I doubt they will come around to Obama, but they are now open to third parties, such as Barr and the Libertarians.

Democrats need to step up and do what the Rethugs did in 2000 and '04- help the third party be spoiler. Fact of the matter is not every Rep will swing Dem, they just won't, but they can be swayed away from McCain.
Support for Barr will not only help Obama and hurt WcCain, but it will also help to bring about a faster end to the NeoCon hijacked republican party.

The Obama camp needs to reframe the issue...

Barack Obama cares about ALL life.

He cares about improving our sex education so that our children can make better decisions so that teenage pregnancies and abortions are not as frequent of problem.

He cares not just about life in the womb while it is convienant, but after the baby is born when it will need healthcare, and an education.

He cares about the life of the mother who will need help and resources she deserves so that she can keep the baby.

He cares about the life of all the children in foster homes and orphanages who need a family.
He cares about the life of the familys that want a child in their home but can not do it on their own.

He cares about the life of our brothers, sisters, sons and daughters when they are old enough to serve. He will not allow them to die for the profit of another.

He cares about the life of the familys of America. Giving them the tools and rights they need to live a healthy and prosperous life.

He cares about the life of the elderly. Allowing them to retire in health, comfort, peace and security.


McCain only cares about the life of a political pander and the life of his investors stock accounts.

The strategy of the anti-choice forces has always been to limit and obstruct women's access to abortion by any means necessary. The kind of legislation that Obama opposed fits precisely into that catagory. It is nuisance legislation tailored to intimidate doctors and women out of performing and seeking abortions with the threat that they may be dragged into court to defend themselves if even a non-viable fetus dies outside the womb. Even if such legislation contains Roe-neutral verbage it does not prevent a anti-choice prosecutor from bringing charges. The harrassment value of such legislation for the anti-choice movement is all that really matters to them in such a case. Further even if it contains Roe-neutral verbage it does not keep this legislation from actually violating Roe vs. Wade because it does allow the state to interfere by establishing enough of a cause to bring charges even if the charges are not ultimately upheld, therefore the idea that Obama's concern was Roe-centric is quite correct.

It's all beginning to make sense now. The reason he parsed and quibbled at Saddleback over the simple "when does a baby gain rights" was because he knew in the back of his mind that he was vulnerable over THIS issue of his "infanticide" votes.

He must have thought that if he gave the simple, straightforward answer that a baby gains legal rights at birth, that Warren would throw these votes in his face and bring this issue to the forefront on a nationally televised forum.

It seems that the BHO campaign thinks this issue is his Achilles heel, and perhaps they're right.

Oh please, what tiresome pseudo-intellectual twaddle. The reason he answered the way he did is because people believe whatever they want to believe about when "life" begins and when that life has legal rights. Nothing he could have said is going to change that in anyone's mind. What's the use of even parsing it? He didn't. He just simply restated his allegiance and commitment to Roe v. Wade giving women who so choose, within certain limits, the legal permission to end a pregnancy. Right to lifers, many of whom support the death penalty, and oppose aid to women with dependent children, will not be satisfied until all abortion is again illegal and women and young girls will have to resort to dangerous and unhealthy measures to gain control over their lives. Thankfully, although this insane and useless argument has gone on about twenty years too long in this crazy country, we've managed, somehow, not to throw women under the bus over it.

The facts seem to support his opponents on this and his campaign has now completely back pedaled on their repeated incorrect claims the Illinois bill didn't match the US Senate bill since it does. His official claim in now that he was working against some now identified package of bills of which this bill was a part. He is a Harvard educated law professor, he should be able to fully explain exactly what he believes, why he voted the way he did and make his case to all of us. Why doesn't he?

"....all he does is vouch for his own interpretation and demand that we accept it. This is like the way he insists that we not "question his patriotism" when what we're doing — some of us — is trying to learn about and process some things we have questions about. It's delusional to think that millions of people will obey a command to put this behind us. We want to know the details of his relationship with former terrorist Bill Ayers. We want to know the details of the text of the Born Alive Infant Protection Act and the politics that surrounded it. The campaign season, for many Americans, is just getting started. It won't do to get pissed off and say that you've already explained this and we need to move on. Move on to what? These are the questions that concern us! And you won't deign to answer.

Obama supporters like to label John McCain McSame, but right now, it's Obama who is reminding me of George Bush. George Bush's greatest failing was his refusal or inability to explain why his judgment was sound and to continually persuade us that the course he had chosen was best.
