JUNEAU, Alaska — Alaska's investigation into whether Gov. Sarah Palin abused her power, a potentially damaging distraction for John McCain's presidential campaign, ran into intensified resistance Tuesday when the attorney general said state employees would refuse to honor subpoenas in the case.

In a letter to state Sen. Hollis French, the Democrat overseeing the investigation, Republican Attorney General Talis Colberg asked that the subpoenas be withdrawn. He also said the employees would refuse to appear unless either the full state Senate or the entire Legislature votes to compel their testimony.

Colberg, who was appointed by Palin, said the employees are caught between their respect for the Legislature and their loyalty to the governor, who initially agreed to cooperate with the inquiry but has increasingly opposed it since McCain chose her as his running mate.

"This is an untenable position for our clients because the governor has so strongly stated that the subpoenas issued by your committee are of questionable validity," Colberg wrote.

Last week, French's Senate Judiciary Committee subpoenaed 13 people. They include 10 employees of Palin's administration and three who are not: her husband, Todd Palin; John Bitney, Palin's former legislative liaison who now is chief of staff for Republican House Speaker John Harris; and Murlene Wilkes, a state contractor.

French did not immediately return a telephone call Tuesday for comment.

Earlier in the day, Harris, who two months ago supported the "Troopergate" investigation, openly questioned its impartiality and raised the possibility of delaying the findings.

Like Colberg's letter, the surprise maneuver by Harris reflected deepening resolve by Republicans to spare Palin embarrassment or worse in the final weeks of the presidential campaign.

And it marked a further fraying of a bipartisan consensus, formed by a unanimous panel before Palin became McCain's running mate, that her firing of the state's public safety commissioner justified the ethical investigation.

In a letter, Harris wrote that what "started as a bipartisan and impartial effort is becoming overshadowed by public comments from individuals at both ends of the political spectrum," and he urged lawmakers to meet quickly to decide on a course.

"What I may be in favor of is having the report delayed, but only if it becomes a blatant partisan issue," he told The Associated Press, while indicating he already believes it has become politically tainted.

Democratic state Sen. Kim Elton, chairman of the Legislative Council, the 14-member panel that authorized the probe, had no immediate comment on Harris' request. Under an unusual power-sharing agreement, the council is made up of 10 Republicans and 4 Democrats.

At issue is whether Palin abused her power by pressing the commissioner to remove her former brother-in-law as an Alaska state trooper, then firing the commissioner when he didn't.

The matter risks casting a shadow on Palin's reputation, central to her appeal in the campaign, that she is a clean-government advocate who takes on entrenched interests _ not a governor who tried to use her authority behind the scenes to settle a personal score.

Palin has defended her behavior and said she welcomed the investigation. "Hold me accountable," she said. But she and the McCain campaign have taken actions that could slow the probe, possibly past Election Day.

Also Tuesday, five Republican state lawmakers filed a lawsuit against an investigation they called "unlawful, biased, partial and partisan." None serves on the bipartisan Legislative Council that unanimously approved the inquiry. They want it pushed past the election or top Democrats removed from the probe.

Making clear the dispute has ramifications beyond Alaska, Liberty Legal Institute, a Texas-based legal advocacy group, was working on the lawsuit. The institute has taken on a variety of cases in defense of conservative Christian positions.

Elton called the lawsuit "a distraction."

"The silver lining in this action initiated by the five lawmakers is that some of that debate now has been kicked to the judicial branch which, unlike the Legislature and the governor's office, is more insulated from the red-hot passion of presidential politics," he said.

Palin fired public safety commissioner Walt Monegan in July.

Weeks later, it emerged that Palin, her husband, Todd, and several high-level staffers had contacted Monegan about state trooper Mike Wooten, who had gone through a nasty divorce from Palin's sister before Palin became governor. While Monegan says no one from the administration ever told him directly to fire Wooten, he says their repeated contacts made it clear they wanted Wooten gone.

Palin maintains she fired Monegan over budget disagreements, not because he wouldn't dismiss her ex-brother-in-law. She has sought through her lawyer to have the matter investigated in a more favorable forum, the state personnel board.

why has all this disappeared from the news? Staff refusing to comply with subpoenas is newsworthy. Is there some kind of legal issues that were imposed or discovered after this AP article came out yesterday?

With everything going on this week. People are fed up. Enough is enough! These people need to get out of our lives and go back under the rock they came from. It is completely obvious that they are covering up wrong doing, again. We need to be yelling alot louder that america has had enough.

This strategy may backfire for them. They are working overtime to discredit pretty much everyone, it is just making them look more and more guilty. Shame on her for even getting in a situation where an ethics probe is even needed. It just doesn't look good at all.

Doesn't god or the bible say something somewhere about lies and deceit and not having grudges...

It's always been my philosophy that if you have nothing to hide then you have no reason not to tell your side of the story. Contrary to that point of view Sarah Palin is now trying to get the investigation into the ethics violations turned over to a panel she appointed. Even the RNC and the McCain campaign have now entered the fray in Alaska backing her attempt to stall the investigation. For someone who hasn't done anything wrong she sure is trying hard to avoid the outcome. You have to ask yourself why. The fact is that if she has the investigation move to this more favorable panel all current deadlines become moot and they could continue this long past the November 4th election. What is she hiding and why is she working so hard to hide it? I thought Their campaign was all about reform and transparency. Looks more like hide and seek.

Too all Americans, what type of government do you want? We have a serious situation in Alaska with the probe into Gov. Palins motive for firing the Commission of Public Safety. Using your office to settle a personal vendetta is not only a violation of ethics, it’s a violation of the public trust.

This investigation was initiated by Republicans as well as Democrats. And now the McCain campaigns pushes to quiet the issue and stop the investigation. I cannot honestly say whether or not Gov. Palin did anything wrong. What I do want to know is what type of individual do I want to occupy the second highest job in American. The only way Americans can be absolutely sure their pick is the right one, is to know everything about the person their about hire.

I become very suspicious when someone says they will cooperate with an investigation and then when the stakes become higher they back away from their original position. Honesty is honesty and if you have nothing to hide then you must be willing to open your books and clear up all suspicion.

For the last eight years we have all seen what secrecy in government gets us. From Dick Cheney’s secret meeting with energy executives to refusals to testify before congress our trust in government has been eroded. In order to regain that trust we must demand full disclosure of those we choose to represent us. Stalling an investigation only causes us to become more cynical.

sarah is a crook, a liar, and want to be hillary, sarah is no hillary by a long shot, who can mccain and palin fool, sarah need's to go and take care of her kid's, who's taking care of her kid's now she has been away from them quite sometime while on the road with mccain and neglecting her young baby who she say's she love and have down syndrome problems, a child need's their mom and sarah and todd both is a way from their kid's this is not a good role model leaving your children's this length of time, mccain and sarah need's to be ashamed of their self all they want is desperate to win an election they do not care about non of us. so unfortune

i guess the world need's sarah palin and john mccain to save them, if anyone dosen't guess this trying to make a fool out of the american people's i do not know what will, it appears that john mccain chose that chick palin to grab hold of hillary voters, well the truth is that america is so weak for nonsense like being racist therfore they will not vote to help change america they will vote for mccain to try to hurt obama but the true fact is they are not hurting obama they are hurting they own future as well as their families, the one's vote for mccain and palin when your color go's from white to poor let's see is mccain going to give you one of them 11 homes he and his beauty queen whinning wife have, or will cindy let you shop with her on that $750,00 credit card she spend's every month, or that $350,00 she spent on that outfit she wore at their convention, you fool's know john mccain and palin do not give a damm about any of us come on america do not let us go through this mess all over again bush put us through aren't you tired? i am.

If there is nothing to hide and all the facts have come out then why delay the investigation? If there is nothing to hide why withdraw cooperation? How can this process be tainted if there were no issues before she hit national spotlight? How can the Repubs cry foul when they have the majority and wish to unbalance the investigation by pushes off the four (4) Dems taking part? What's factual and "fair" about that? HOW DO THEY KEEP GETTING AWAY WITH THIS?!
