Judge Rules Dan Rather's $70 Million CBS Lawsuit Can Proceed

NEW YORK — A New York City judge says news anchor Dan Rather can proceed with his $70 million lawsuit accusing CBS of violating its contract with him when the network fired him.

Judicial Hearing Officer Ira Gammerman dismissed a fraud complaint against CBS Corp. on Monday and a business interference complaint against CBS and former parent company Viacom Inc. No causes of action remain in the lawsuit against Viacom.

CBS lawyer James Quinn says Rather can't prove breach of contract because the network assigned him to "60 Minutes II" as required and paid him what it owed him.

Rather lawyer Martin Gold says proving breach of contract will be "a slam dunk."

The judge also let Rather's breach of fiduciary duty complaint against CBS continue.

At the risk of sounding like an echo chamber--keep going Dan, and pursue the truth as you always have. I hope that at some point during the suit, the truth about the story regarding GWB's alleged service in the National Guard will finally come out, and we will finally have proof positive about Shrub being AWOL from the Guard!

I think CBS better settle....

It's gonna cost 'em a lot more to go to court, lose, then be known as the loser company that schilled for the Chimp and lost big. Oooohhhh hoo hoo... Imagine what that's gonna cost 'em... It already sounds like a loser deal.

They oughtta settle. They will, if they're smart.

If this litigation goes to court, CBS will lose more in image and prestige than in attorney's fees. One way or another, CBS lost when they fired Dan Rather. They lost viewers thanks to the perky infotainment girl on Evening News and they are losing money on lawyers.

But Dan Rather said from the beginning that he won't settle. He said he is suing for a judgment and the principle. Let's hope he sticks to that.

Get 'em good, Dan? I can't believe that the other parts of the case were thrown out. If Dan were allowed to do his job, would we really have this president? Bush avoided Vietnam and did not show up to the National Guard. Nobody can remember him.

Old Dan stayed after the Silverado Savings and Loan Scandel and showed how corrupt Daddy Bush was in removing the Investigastors so the EVIDENCE AGAIST NEIL AND G.W. could disappear.

Bush set him up but now Old Dan is going to have the last word !

I hope Dan uses that money and gets some Investors for a leveraged buy out of CBS.
Then the USA would have at least one compentent media source for news and information.

Who knows... maybe CBS will show up with five or six of Junior's Air Guard contemporaries, all chafing at the bit to attest to his presence during that 'missing year' and his textbook fulfillment of his service obligations -- angrily refuting the essence of Rather's reporting.
