WASHINGTON — The senator overseeing Barack Obama's swearing-in ceremony said Monday she's writing to Internet sites like eBay asking them not to sell scalped inauguration tickets. Sen. Dianne Feinstein, D-Calif., also said she's crafting a bill that would make a federal crime of selling tickets to the historic event Jan. 20.

Feinstein, who chairs the Joint Congressional Committee on Inaugural Ceremonies, said she foresees overwhelming demand for the 240,000 available tickets and has heard reports they may be sold for as much as $40,000 online.

The tickets are supposed to be free to the public and distributed through congressional offices.

Lawmakers' offices won't get the tickets until shortly before the inauguration, to try to prevent scalping. In-person pickup will be required.

"These tickets are given for free to people. This is a major civic event of the time, and no one pays for their tickets, and we believe no one should be required to pay for their tickets," Feinstein said in an interview.

Besides eBay, Feinstein aides said they are looking at writing to Craig's List and possibly other sites. An eBay spokeswoman, Nichola Sharpe, said the company was in discussions with the Committee on Inaugural Ceremonies but couldn't comment until an outcome was reached.

Feinstein said she was readying legislation for Congress' lame duck session, which begins next week, to make scalping the tickets a misdemeanor punishable by a yet-to-be-determined fine.

She said her own Senate office received 8,000 ticket requests the first day after the election.

Demand was overwhelming supply all over the Capitol. Sen. Jim Webb, D-Va., had received more than 15,000 ticket requests as of Monday morning, and his spokeswoman said they only expected to have about 500 tickets to give out, though allocations have yet to be made.

Feinstein said she's also concerned about security for the event, which will occur outside the Capitol with crowds likely spilling over the National Mall.

"I am very concerned that this be as secure as is humanly possible. It's a difficult area to secure and we need to give it special attention and that is in the process of being done," she said. Feinstein said she was "of course" concerned that Obama would be a particular target as the nation's first black president.

"We're going to do everything we can to see that he is fully protected," she said. Feinstein will be attending a security briefing Wednesday with the U.S. Capitol Police, the Secret Service and the Armed Forces Inaugural Committee.

Aides couldn't estimate how many people would likely come to Washington, D.C., on top of those with tickets.

"If you don't have a place to stay I think you ought to reconsider coming. It is very cold that time of the year and it's going to be very difficult to get around," Feinstein said.

Coincidentally, 2009 marks the 200th anniversary of Abraham Lincoln's birth. The theme of the inaugural, "A New Birth of Freedom" _ a phrase from the Gettysburg Address _ was chosen even before Obama won the election.

"It's fortuitous it worked out that way," Feinstein said, "when you think that he will stand up there and take the oath of office and look out at the Lincoln Memorial, where these words are engraved."

This story shows how incompetent our Congress is. A brief visit to the web site of the Inaugural Committee shows how little these "very important people" care about regular people. There is poor planning, thoughtless distribution of a quarter million tickets and a callousness that is breathtaking.

I spoke with the person in my Congressman's office "responsible" for this fiasco yesterday and it became clear that since I am not "connected", I can just go pound sand. This is a disgrace. Of course, the fact that Feinstein, Reid and Pelosi were read in to the torture and warrantless wiretapping "programs" was scandalous. No wonder that the Republicans thought they would get traction with elitism charges. The Congressional leadership IS elitist. Us regular folks are JUST voters or members of a crowd to be herded, manipulated and pushed around.

I think everyone is worried about Obama's security. Hopefully, she's just on the committee - not actually planning the security logistics (considering that's the Secret Service's job ... I sort of doubt it).

Security will need to be tighter initially but in time once the folk see the sky has not fallen, they should chill.

The day after the election I called my family in NJ and invited them. (I live in MD) and they are all coming. All of us have written for tickets. I'd like to think we have a chance. Regardless, we are going down to the mall with binoculars and hot pads in our shoes.

I live in DC, and our sole congresswoman (you know, the one who isn't allowed to vote) has gotten so many requests that they're not even taking names anymore. I wish I had a senator to write to, but you can only get tickets in your own district :(

You don't have to have a ticket. Its only for an area up front. I went to Clinton's first Inauguration. There was a secure area near the capital for ticket holders. We could see Bill in the distance, and there were big screens so you could see his face. Keep watching for the details. Its going to be crowded.

Jeez. Why on earth would you not hold a national lottery to distribute the tickets? I mean, come on... even the World Cup's got that figured out. If you've got to make a law... well, maybe it's just easier to accept that people are going to scalp. The majority wouldn't give up their pair, though, unless they needed it, I'm sure. If there's that much demand, there'll be little supply to buy.

People would DEFINITELY scalp them. Are you kidding? I would love to see the inauguration, but if I got a ticket, and I could sell it for $40k, I wouldn't blink. Much as I'd like to be part of history, as I'm sure most Americans would, there's a whole lot of debt going around.

I contacted my Congressman and both Senators -including our brand new one-Jeff Merkley. I've got my fingers crossed. My folks live in Alexandria so I'm going regardless. Well see....
