MIAMI — A judge on Tuesday ruled that a strict Florida law that blocks gay people from adopting children is unconstitutional, declaring there was no legal or scientific reason for sexual orientation alone to prohibit anyone from adopting.

Miami-Dade Circuit Judge Cindy Lederman said the 31-year-old law violates equal protection rights for the children and their prospective gay parents, rejecting the state's arguments that there is "a supposed dark cloud hovering over homes of homosexuals and their children."

She noted that gay people are allowed to be foster parents in Florida. "There is no rational basis to prohibit gay parents from adopting," she wrote in a 53-page ruling.

Florida is the only state with an outright ban on gay adoption. Arkansas voters last month approved a measure similar to a law in Utah that bans any unmarried straight or gay couples from adopting or fostering children. Mississippi bans gay couples, but not single gays, from adopting.

The ruling means that Martin Gill, 47, and his male partner can adopt two brothers, ages 4 and 8, whom he has cared for as foster children since December 2004.

"I've never seen myself as less than anybody else," Gill said. "We're very grateful. Today, I've cried the first tears of joy in my life."

He said the two boys have been practicing writing their new last names, and the older one said: "That's what's going to make us a family."

Attorneys for the American Civil Liberties Union, who represent Gill, said the case was the first in the nation in which numerous experts in child psychology, social work and other fields testified that there is no science to justify a gay adoption ban.

The state planned a swift appeal, likely setting up a battle that could reach the Florida Supreme Court. A judge in gay-friendly Key West also found the law unconstitutional in September, but that ruling has not been appealed and has limited legal reach.

The state presented experts who claimed there was a higher incidence of drug and alcohol abuse among gay couples, that they were more unstable than heterosexual unions and that the children of gay couples suffer a societal stigma.

Organizations such as the American Academy of Pediatrics, American Medical Association and American Psychiatric Association all support permitting same-sex couples to adopt.

Lederman rejected all the state's arguments soundly.

"It is clear that sexual orientation is not a predictor of a person's ability to parent," the judge wrote. "A child in need of love, safety and stability does not first consider the sexual orientation of his parent. The exclusion causes some children to be deprived of a permanent placement with a family that is best suited to their needs."

Florida Assistant Attorney General Valerie Martin said an appeal would be filed on behalf of the state Department of Children & Families. She declined additional comment.

Neil Skene, special counsel for DCF, said the judge did an "excellent job" on the case, but the department still must enforce state law. He noted that DCF placed the foster children with Gill.

"We think this is a wonderful foster parent," Skene said.

Reaction came quickly from advocates of gay, lesbian and transgender parents who have long considered Florida's law the most draconian in the nation. Jennifer Chrisler, executive director of the Boston-based Family Equality Council, said the decision is a "long-overdue recognition of the equal ability of lesbian, gay, bisexual and transgender people to raise happy, healthy families."

"The best interests of children should be decided by parents, families, professionals and judges, not opportunistic politicians and interest groups," Chrisler said.

John Stemberger, chairman of a successful drive earlier this month to pass a constitutional amendment banning gay marriage in Florida, called the ruling "classic judicial activism" and predicted it would be reversed on appeal.

"Everywhere in the law where children are affected, the standard must always be what is in the best interest of the child," said Stemberger, an attorney in Orlando. "What is stunning to me is that when it comes to dealing with gays, that standard goes out the window. Children do better with a mother and a father."

Good news!
One aspect of same sex parents that I don't hear a lot about is all the work and forethought that goes into creating a family. It takes two adults committed to planning and raising children the best way they can.

Gay couples don't have 'accidents' - there's no "Oops the condom broke!" or "Gee, I forgot to take my pill".

Most couples have to jump through all kinds of hoops to adopt. I think anyone willing to do that to give a good life to a child should be allowed to.

okay, i asked this question before, but there are lots of sensitive folks here, who would prefer to have hurt feelings than engage in a discussion... so i will ask it again, and hopefully get some intelligent responses... first though, i will introduce a couple of concepts and then asked the question...

(a) there is a critical concept in education research called the "hidden curriculum"... it's used in to talk about those dimensions of the public school curriculum that are taught implicitly... anyone who has attended K-12 public schools should be able to identify many different ways heterosexual behavior is signified to youth...

(b) sexual orientation is different from other 'suspect classes,' e.g. race, gender, disability, in that it is not an immutable category... strictly speaking, sexual orientation is a behavior not an physical quality... and this is to say, your sexual orientation is not apparent and obvious to others... it is a minority status that must be claimed...

so this is the question: in the future, to keep these adopted kids from being alienated at school, will public school curricula need to become more explicitly LGTB-oriented given parents' claimed sexual orientation?

It's called teaching tolerance. Not Joe don't play with dolls, that's for Jane. It's about accepting that in teaching a specific limited 'traditional' view of 'the american family' - you alienate more than adopted children, but most others that don't fit that narrow mold, such as single parents.

It's ironic that a homosexual man could marry a homosexual woman and could adopt a child legally in every state of the union, thus giving the child a man and a woman as parents. Of course, let's disreguard the happiness of the parents, because the mother and father might never have sexual pleasure from one another. This union would be considered sanctified according to certain people because the gender difference somehow fulfills something holy. Right?

This is indicative of why religious people require being saved in the first place...they are unable to function in reality and must construct rules of discrimination to make their fantasy views relative. No wonder 50% of heterosexual marriages end in divorce...we never figured out what marriage was about in the first place, so at what point are we the standard?

Heterosexuality is not a moral value, it's merely a condition upon which conformity is required. My mom was a single mom, and I would have been a better person if she had been in a happy marriage with another woman. Her happiness would have increased my happiness. If there are those who don't see this, then I suggest they not be allowed to adopt, because there isn't a child on earth I would want raised by people who haven't got a clue what love is.

I would support a homosexual man-homosexual woman (married couple) adopting children. I'm against a same sex couple getting married and adopting children since there is no where in the history of mankind where same sex couples where allowed to get married except recently. The reason, is because same sex couples can't have children. If a lesbian wants to have a child, she can do it like 99% of straight women. Crawl in bed and have sex with a man. You can't just go to Walmart and buy a child.

OK so will you prohibit an elderly hetero couple from marrying? As sterile hetero couple from marrying? When does this end? Why do YOU get to dictate to OTHERS why they cannot get married?

I don’t see the problem! Two consisting adults wish to share their lives together! WTH has that got to do with me or you? Unless they are a friend of mine marrying a JERK, it is none on my business!

it is a logical fallacy to assume that because things have only been done one way for a long period of time, that that is then the only and best way to do things. think for example of slavery, it was around for thousands of years (and is still around) before even the U.S. changed its laws. so because people have been in bondage for ages then we should continue to enslave them? it must be right because thats the way that things have been done for so long! tradition can in no way equate correctness, hence the reason people everywhere have worked for change, against the sanction of tradition, for centuries.

As a gay man, I have no desire to have my own children. I do not wish to bring a new child here. After all the hate, hurts, and BS I have been through, and witnessed, all I can say is NO new child.
Having said that, I would take in a child who needs a help. If no one else would, or could, then I would have liked to do that. I would not be adding a child that way, but I would still be able and willing to try.
With close to 7 billion people now, and climbing to upwards of 9 billion by the time my "if I had any children" grand sons/daughters came of age. And all that without me even having to waste my time or DNA on any of this overgrowth. Why should we gays still not be able to raise an orphaned, or adopted child. If you believe it is because I and my partner could not give proper gender roles, then you have not met my Mom, aunt's, or pushy lady friends who are MORE than willing to stick their noses in on our business.

I agree. Better have mom and mom, dad and dad, than no one at all. No family, no love. Those who are orphans would know how miserable it is to live in an orphanage or community shelter. If gay families can provide a safe, warm and loving environment for the kids, then why not let them have a chance to do so?

I'm only forty-five and I can clearly remember hearing elderly relatives talking about how racially mixed marriages were unfair to the children because they would be stigmatized and would never be accepted by either race. Thirty years from now the argument that gay and lesbian adoption is in some way bad for the children will sound just as ridiculous.

This is wonderful news! Children need homes. We have desperate families neglecting or abusing their kids, we have desperate women considering abortion. We also have couples desperate to love and cherish a needy child. Let us not forget that this is about meeting the needs of children, first and foremost. More loving homes available for homeless babies and children is wonderful news!

Thank Goodness. These 'anti-gay adoption' initiatives are really sick. Can you imagine people who will hurt CHILDREN just to justify their homophobia?

I have 2 friends who are a gay couple. They are foster parents to two kids who were abused and neglected by their birth parents and bounced from one unhealthy foster home to another.

My friends took these kids in, gave them stability, taught them how to behave in public, got them into great schools and it took a lot of hard work because these kids are a handful after the abuse they have suffered. It is not easy at all. They have given up a lot of their lives just to help these kids.

Now they are going to adopt them because they love the kids. These kids were on the road to being juvenile delinquents, maybe prisoners or prostitutes, nobody wanted them. (that's what happens to most kids who 'age out' of they system)

A good stable home with parents who love them is all they needed. How dare people try to take that away.

Now they are thriving at a good school and in a loving home.

Unless these anti-gay adoption folks are willing to take in all the unwanted foster children in the system they better stop this nonsense.

i'm 18 and for the last four years i've gone to a high school with the highest rate of pregnant teens in my county...it's not totally my school's fault we have a program here so a lot of mom's get transfered from neighboring schools...i've known a lot of girls who've chosen to keep their babies and some that have chosen to give them up so reading this article it's sad to think that there's some people out there who want to deny perfectly acceptable people the right to be parents...pretty soon they're going to be putting signs on their foreheads

This past weekend I witnessed something that just deeply touched me.... I saw this white lady breast feeding a black infant that looked 4 months at most. I'm not talking half black, I'm talking black, black like myself. Black that could not possibly be half black; she was with her white husband. Tears rolled down my face....

Love is truly what we all need and should give. Discrimination and hatred of any kind needs to come to an end!

In other words, the same state arguments that a dark cloud hanging over homes of hetersexuals is stigmatizing and harmful to children has been rejected by the United States Supreme court as not compelling in Palmore v. Sidoti, 466 U.S. 429 (1984) and today the Florida State Court said the this argument is not rationally related to the best interest of the child; it is based in prejudice and fear and is, therefore, arbitrary. Wow, what a great day for JUSTICE !!!!!!!

When are we going to learn to keep out of other people's business? So long as they do not try to impose their beliefs on me, then they, meaning all law abiding Citizens, should be free to make their own choices without anyone butting in. Here, "Law Abiding" refers to Laws which do not discriminate against anyone on any basis.
Let the gays be; we let the religious fanatics, the Evangelicals, the Klan and other terrorist groups - like Fox News - alone, so why not the others??
