RAYMONDVILLE, Texas — A judge dismissed indictments against Vice President Dick Cheney and former Attorney General Alberto Gonzales on Monday and told the southern Texas prosecutor who brought the case to exercise caution as his term in office ends.

Willacy County District Attorney Juan Angel Guerra had accused Cheney and the other defendants of responsibility for prisoner abuse. The judge's order ended two weeks of sometimes-bizarre court proceedings.

Guerra is leaving office at the end of the month after soundly losing in his March primary election.

"I suggest on behalf of the law that you not present any cases to the grand jury involving these defendants," Administrative Judge Manuel Banales said in court while ruling that eight indictments against Cheney, Gonzales and others were invalid.

He also set a Dec. 10 hearing on whether to disqualify Guerra from those cases.

Even in defeat, Guerra saw the outcome as confirmation of the very conspiracy he had pursued. "I expected it," he said. "The system is going to protect itself."

Banales withheld judgment on whether probable cause existed for the Cheney and Gonzales indictments because they were not represented in court and did not present any argument. For the other defendants, he found no probable cause to support the charges.

A White House spokeswoman said Monday night that Cheney's office had no comment. A call to Gonzales' attorney was not immediately returned.

Three of the eight indictments returned Nov. 17 targeted private prison operator The GEO Group, state Sen. Eddie Lucio Jr., Cheney and Gonzales, as part of an investigation into prisoner abuse at privately run federal prisons in the county.

Guerra ran the investigation into alleged prisoner abuse with a siege mentality. He worked it from his home, dubbed it "Operation Goliath" and kept it secret from his staff, he said. He gave all the witnesses biblical pseudonyms _ his was "David."

Banales dismissed all eight indictments because GEO Group attorney Tony Canales showed that two alternate jurors were part of the panel that day but had not been properly substituted.

Five of the indictments _ against two district judges, two special prosecutors and the district clerk _ were dismissed because Guerra was the alleged victim, witness and prosecutor. The indictments accused the five of abusing their power by being involved in a previous investigation of Guerra.

The indictment against Cheney alleged that his personal investment in the Vanguard Group, which invests in private prison companies, made him culpable in alleged prisoner abuse at privately run federal detention centers.

Gonzales was accused of using his position to stop an investigation into abuses at a federal detention center.

Lucio was alleged to have used his Senate position to profit as a prison consultant, but Banales ruled that the indictment failed to address whether Lucio knew he was only being hired to consult because he was a state senator.

It's almost over.....

Get over it. Pres. Bush and his administration will be gone in about 7 weeks.
Maybe this is one reason that Congress didn't do anything in the past 2 years while
the economy was going down the tubes. N. Pelozi -Reid and others were more
intent on trying to get Pres. Bush and Cheney impeached.

Too much fiddling while Rome was burning.....

After Jan. 20, 2009, we can all listen to the criticism start about the next administration.

Although, I bet that anything that gets messed up then will still be blamed on the Rep's.

We need all the whiners to tell us how to get prisoners to give important info so a further
attack on America can be avoided. Oh, I forgot, these terrorists are all nice people.
Hopefully there are plenty of American flags (not made in China) so they will be available
if we happen to have another sneak 9/11, so all you so called patriotic people can get one
to show your "true colors" and hang one in front of your house and on your car.
Oh, and maybe the churches will have a bunch come back that didn't stay long after the
safety bell was rung after 9/11.

Strange-I haven't seen any evidence of Pelosi, et al, doing a damned thing to get those two criminals impeached despite thousands and thousands of demands to do so. Crime pays. To much of the rest of the world the center of terrorism has been Washington. With the legacy of racism, lying, and deception we have had laid upon us by the outgoing misadministration, there is no reason not to blame them for problems that will persist for some time to come. They will likely escape justice in their lifetime, but not after that. There is indeed a special place in Hell for them and their willing accomplices who have used religion as a justification for their misdeeds for far too long. And if it is whiners who are not willing to lower themselves to using Gestapo tactics in interrogations, it is indeed Neonazis who condone this when there are other ways to extract information (drugs such as sodium pentathol or scopalomine, etc)
Finally this country has been burning for the past eight years-funny no one noticed until just recently and are still denying that we are in a recession-hell it's the Great depression II!

18 sailors were killed in the Port of Aden....
Bush didn't set all the fires....What did you expect him to do...
Maybe terrorists can be interrogated in a different way, but why don't you tell
them how to do it. Or maybe ask someone in the military what they think about it.

Pelosi did everything in her power to stop any impeachment proceedings against Bush & Cheney. The enormity of Bush & Co.'s crimes will go unpunished, giving a sure sign to future oligarchs that they may abuse their power however they wish; we should not "forget about it".

Bush & Co. belligerent tactics, their unnecessary, wasteful war in Iraq, their use of officially sanctioned torture and their trampling of the rule of law, have only served to increase terrorist attacks world wide since 9/11. The power and prestige of America are a mere shadow of what they were 8 years ago. Shame on our spineless legislators for not impeaching these two criminals.

How much was the bribe to the judge? I'd be watching to see if the judge buys a new house or a Lear jet or takes that much needed trip to New Zealand. Make no mistake about it, the judge was bought. Guerra might also want to take a look in his car every day just to make sure there is oil in the engine, if he knows what I mean.

What is going on here when a state prosecutor's case is thrown out by a judge?

Where is justice when the same judge "warns" the prosecutor NOT to do the very job he was elected to do?

Glad there is no partisanship in judge's politics, I mean decisions. WAKE UP TEXANS and DO SOMETHING about this atrocity of justice! Will anyone call out this man to any accoutability?

Hey, I think there is a movie coming out about our famous texas justice! It's about Tulia, TX lmao a sociopathic cop was hired by the local good ol boy sheriff to get the dopers (and some $$ for the sheriff's office) so they hired this freak. Well, he singlehandedly busted about all the black people in town and railroaded them all to the big house- without evidence, without witnesses, with nothing but the word of this cop. One was an 80 yr old porch rocking chair guy, another a woman who had a deposit slip from bank in OK on said day. It was all good and they were all in the big house. Some old farmer guy was in the ACLU and thought things were a lil weird. They came in after the COP WAS NAMED OFFICER OF THE YEAR mind you, and found out he had been fired from every law enforcement job he ever had. So the good dumb**** citizens of Tulia, TX got to pay millions in lawsuit money for bein such "real Americans"
