Obama Birth Certificate Challenge Turned Down By Supreme Court

WASHINGTON — The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth. The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election.

Donofrio says that since Obama had dual nationality at birth _ his mother was American and his Kenyan father at the time was a British subject _ he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.

At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that Obama was born in Kenya, not Hawaii as Obama says and Hawaii officials have confirmed.

Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have dismissed Berg's lawsuit. Federal courts in Ohio and Washington state have rejected similar lawsuits.

Allegations raised on the Internet say the birth certificate, showing that Obama was born in Hawaii on Aug. 4, 1961, is a fake.

But Hawaii Health Department Director Dr. Chiyome Fukino and the state's registrar of vital statistics, Alvin Onaka, say they checked health department records and have determined there's no doubt Obama was born in Hawaii.

The nonpartisan Web site Factcheck.org examined the original document and said it does have a raised seal and the usual evidence of a genuine document.

In addition, Factcheck.org reproduced an announcement of Obama's birth, including his parents' address in Honolulu, that was published in the Honolulu Advertiser on Aug. 13, 1961.

We are the United States of America. Let's stand united. The solution is simple. BO must produce his long form birth certificate. If he lost it, he can get a new one for under $20. Instead, he has spent over $800,000.00 to fight those who would like to see the proof that would unite us. This resistance is dividing us. I had to produce my birth certificate for my passport. Does anyone check the POTUS-Elect's birth certificate? Who verifies the eligibility of a candidate? Obama should just present it and then there will be no question of his eligibility.

As a travel agent--I have to counsel travelers on acceptable proof of citizenship when going abroad.

Prior to the US requiring a passport for everyone, one could use a birth certificate and state issued photo ID. This is still OK for cruising in the Caribbean.

However, the hospital birth cert with footprints and doc's signature is not acceptable. You would be denied boarding. It had to be the version from your state's Dept of Vital Statistics that looks JUST LIKE OBAMA'S!

I don't understand all these lawsuits. If somebody thinks there are 'Obama Crimes" or that he's falsifying documents, or traveling on a false US Passport, or whatever, why don't they call the police or the FBI instead of filing a lawsuit or creating a web site?

But no matter what spin they take he is a natural born US citizen.
1. If he were born in Kenya - his mother is a US citizen and he would still be a natural born citizen. Although his mother was 18 when he was born (the law regarding the time the US parent had to live in the US changed from 5 years after age 14 years to 2 years after age14 years and this law was reoctractive to the 1930's). So he would still be a natural born citizen.
2. If he was adopted in Indonesia - he was a minor and cannot give up his citizenship and his parents cannot give up his citizenship - so he is still a natural born citizen.
3. Because his father was a British Citizen at the time - he would have dual citizenship. But having dual citizenship does not mean that he surrendered his US citizenship. A court case regarding dual citizenship resulting in the precedence that a dual citizenship would still be a US citizen.
So whatever nonsense they come up with, Obama would still be a natural born US citizen. But the facts are that he was born in Hawaii of a US citizen. He was not born in Kenya not adopted in Indonesia but if he were he would still be a natural born citizen and eligible to be president of the USA.

For this nonsense to be true you would need at the very least:

1. Amazing forsight on the part of Obama's parents to get the ball rolling on this cover-up from the start.
2. A world-wide conspiracy of journalists. It seems if this were true you would need to have some sort of left-leaning honcho telling every journalist in the WORLD to cover this up. If this were true this would be the scoop of the century and make the career of a journalist. I wonder why they are not covering it? Could it be that these allegations are a truckload of fresh fertilizer?
3. The CIA, FBI, Illinois State Bar, passport officials, Democratic Party and a bunch of other people would have to be in on the secret as well. How come none of them have squealed?
4. For me, the big one is WHY? Why would someone do this? Why would someone go to this much trouble? No reason exists for the Democrats to run a man for office who was not qualified.

If someone believes this I would presume either insanity or stupidity until they proved otherwise.

I was homeschooled in Appalachia and I could tell that this case was junk.
Berg's too. Read it sometime for fun. The man actually quote discrepancies between the Italian and English Wikipedia pages as "proof". That, along with repeated references to "internet rumors" are all he has to go on.

I love how these nuts quote the US citizenship act from the 40´s to prove this or that about Indonesian or Kenyan citizenship laws. These geniuses are apparently unaware that other countries have their own laws that are often nothing like our own laws.
