Black Lawmakers: Burris Pick Won't Help Blagojevich

CHICAGO — Roland Burris is battling for a U.S. Senate seat in court and through the media, briefly shifting the spotlight away from the man who picked him for the job, embattled Gov. Rod Blagojevich.

Burris filed a motion with the Illinois Supreme Court seeking to force Secretary of State Jesse White to certify Blagojevich's appointment of Burris to the seat. Getting White's signature on the document would make it easier for Burris to argue that Senate leaders must accept him.

Burris also made his case in interview after interview Wednesday, arguing that his appointment shouldn't be tainted by the corruption scandal that has engulfed Blagojevich.

The former Illinois attorney general said he will show up in Washington next week when new senators are sworn in, but he won't create a scene if Senate leaders turn him away.

"That is not my style. I am not seeking to be confrontational," the 71-year-old Burris told The Associated Press.

Federal prosecutors, meanwhile, asked a judge for another three months to indict Blagojevich, saying they have "thousands" of intercepted phone calls and "multiple" people to assess. A 90-day extension would give prosecutors until April 7.

In Washington, Senate Democratic officials spent New Year's Eve reviewing procedures that haven't been used in decades in anticipation of Burris' arrival on Tuesday. They also were searching for a way to defuse the dispute, according to officials who spoke on condition of anonymity because they were not authorized to speak publicly.

Generally, they expected to make a motion to refer Burris' credentials to the Rules Committee for a review, then to deny Burris floor privileges until the investigation is completed.

That could take months, by which time Blagojevich may no longer be governor, these officials said. Burris would not be granted a paycheck or office space in the meantime, the officials said.

Blagojevich was arrested Dec. 9 on charges that he tried to sell President-elect Barack Obama's Senate seat for money or a high-paying job and other allegations.

That triggered calls for his resignation and the beginning of impeachment proceedings in the Illinois Legislature. U.S. Senate leaders said they would refuse to seat anyone appointed by Blagojevich.

But Blagojevich went forward with an appointment anyway, announcing Burris as his pick Tuesday.

Four days after Blagojevich was arrested, even Burris called the charges "appalling" and "reprehensible." He applauded an effort by the attorney general to have the courts remove Blagojevich, saying the governor could no longer do his job.

Burris said Wednesday that he stands by those statements. But he also said that Blagojevich can continue performing his duties, such as appointing a new senator, and he refused to take a position on whether the governor should resign.

Burris said friends _ he would not identify them _ are studying his legal options. He insisted that being named to the Senate by Blagojevich does not mean he is tainted by the governor's scandal.

"I am not associated with him. The governor made an appointment of me to be the senator," Burris said. "He's carrying out his constitutional and statutory duties. That is not being 'associated' with him."

But White, the secretary of state, officially refused to certify Burris' appointment Wednesday. Normally, he would sign off on a gubernatorial appointment as a matter of routine.

Senate rules say Burris can't be seated unless the secretary of state certifies Blagojevich's action, so Burris is asking the Illinois high court to force White to sign.

"His failure to do so may cast doubt in the minds of the public as to the legitimacy of Mr. Burris' appointment," the motion says.

White spokesman Dave Druker said they had not reviewed the court filing but believed the office has acted within its authority.

Blagojevich's appointment of a black politician could be seen as a move to win over black lawmakers considering his impeachment and perhaps even jurors in his corruption case.

Long before his Dec. 9 arrest, the Chicago Democrat had made a habit of courting the black community, both with broad policies and small gestures.

His closest ally in Springfield was Emil Jones, the powerful black leader of the Illinois Senate. The governor fought hard to improve education and health care, two issues at the top of the agenda for many black voters.

He also handed out grants to black institutions, such as the historic Pilgrim Baptist Church when it burned. And he publicly turned to black ministers during times of trouble and refused to dump a high-ranking Nation of Islam official from a state anti-discrimination panel.

State Sen. Kwame Raoul said black lawmakers won't be swayed by Burris' appointment. "We're just not cheap," said Raoul, a Democrat.

"There's no empathy for him because he's done a good thing," agreed Sen. Donne Trotter, a black Democrat from Chicago.

A Chicago Tribune poll in October, before Blagojevich was arrested, showed his support among black voters slipping _ from 70 percent to 32 percent. The impact of the appointment on blacks who might wind up sitting on a jury is probably nil, said Daniel Coyne, a law professor at Chicago-Kent College of Law.

Blagojevich's predecessor, former GOP Gov. George Ryan, cleared death row before he left office in 2003, but still ended up in prison after he was convicted in a federal corruption trial.

"Any time you start trying to do things in a way that you think would make a jury more favorable to you down the road, it really is nothing but speculation," Coyne said.

Burris would not speculate on whether Blagojevich was currying favor with blacks by naming an African-American to replace Obama, and he didn't think the seat must be filled by another black lawmaker.

"I'm not in any way seeking to play the race card in this situation," Burris said. "Under no circumstances."

Blago shouldn't have appointed Burris, and I feel Burris shouldn't have accepted under the circumstances. If he's a good man, then the Lt. Gov. could have appointed him. I can't imagine why Burris would want to go in under this cloud, forcing himself on the Senate.

Blago is a smart guy. Sympathy for Burris is going to spread to Blago. Hell it is already working with me. I feel sorry for Burris. Blago is starting to look like the sane one compared to what Reid is planning on doing in Washington with the cops.

Burris says he is not tainted by Blago in this appointment, Well Burris is tainted if you ask me by the Cruz/Brian Dugan matter in continuing to prosecute after evidence cleared the guy and let him remain sitting on death row. What a pick Blago ! Not only should Blago step down but Burris should rethink and decline the appointment. They are both a piece of work.

Forget the criminal issues; those come later.

Blago just cannot govern! To make matters worse he refuses to face reality and has since taking office.
He never intended to "help" the state of Illinois as Governor. He ALWAYS intended to help himself.
Thus his style of "governance" was an abject failure from the start. He will be impeached. Burris will
not cast a vote as a US Senator. And when Fitzgerald gets the case ready, part two, the criminal trial, will commence. Blago is doing what he does best right now...stirring the pot.

The Governor of Illinois has the sole legal authority to appoint a replacenment for Obama. He has not been found guilty in a court of law. Obama can make recommendations, but he is only the President -elect. We are a nation based on the rule of law. Obama, Reid, Durbin and the politicians in Illinois do not pre-empt the lawful authority of the Governor. The Democrats in Illinois are silly for the in- fighting over the position. The Democrats in Washington are silly for fighting their own Democratic appointment to the Senate. The MSM has denigrated to a brood of "cackling hens". Instead of reporting the news with facts to the American public they line up on the cable net works and spew the same Republican inspired talking points about the appointment being "tainted". By the way the Governor of New York is legally authorized to make the appontment to replace Hillary Clinton. There is not a politician worth his/her salt that would turn down an opportunity to become a Senator. Politics is not a place for wimps. The Governor of Illinois is not a wimp. Read the comments to this article. Shakowski would be acceptable? But not the African American appointed. The race card has always been played against Blacks.

Thank you for pointing out the media's role in feeding into this craziness of being tainted Why the public falls for it is a mystery.

Tainted .... let's see: Senators Craig and Stevens ... convicted ... and they were not tainted.

Perhaps the best thing Blago could have done that would have given the Senate a graceful way to handle accepting an appointee from an office he legally holds, and they lack the wherewithal to just accept it and move on.

If a politician represented his entire district instead of a few areas, we wouldn't need to replace a black person with black person or a white person with a white person in politics. I'm quite sure there's a qualified, culturally diverse person in Chicago somewhere, regardless of color.

Senators do not represent a district, they represent the entire state. It is the House of Representatives where they represent a district.

One of the reasons Jesse Jackson was interested in the appointment was because it would give him time to prove himself to the southern section of the state. He said in a news conference that he realizes that his family name does give him problems outside the Chicago area.

Burris is a very controversial figure in IL politics over the Rolando Cruz case where he continued to press for the death penalty even in the face of another person had confessed to the murder of the 10 year old Naperville girl. His deputy and the lead detective resigned their position because they did not want to be part of pursuing the death penalty for an innocent man. Burris was running for governor at the time. His actions and the fact that Cruz was innocent lead Governor Ryan to remove everyone that was on death row.

Burris has run for Senator and lost, he has run for Mayor of Chicago and lost and he has run for Governor three times and lost. His last run for Governor for 2006 where he lost to Blago.

He is seen by most people in IL as doing an acceptable job as State Comptroller and
Attorney General but is best known as a politician who put his political ambitions ahead of an innocent mans life.

I'm talking about any politican in general. Represent who you are obligated to represent and there would be no need to replace one ethnic person with another.

That's why the GOP is not popular among people of color. They look out for Mr. White only and could care less about their constituents of color.

Carol Mosely Braun, who was a past Senator, would have been a better choice; or even Jan Shakowsky.....but Blago went to his black constituent, his black base to get support. Like the story states, he intends to sway the Black Congressmen/women when it comes to impeachment vote.

what? who is he kidding?? He knew what he was doing when he allowed Bobby Rush to speak at that press conference. They are ALL playing the race card. Yes we need more minorities represented in the senate, I also believe that we need more women. But senators are elected by people that think they will represent their best interests, not to fill a diversity quota. Appointments should be made with the same criteria in mind.

Blago is still a governor. I don't defend Blago for whatever people are accusing me but I am defending the constitution. I am educated person. Blago appointment is legal therefore Burris is senator from Illinois. Like it or not. Sorry.

They are not questioning the legality of Burris' appointment in and of itself, or the authority the governor had to make that appointment. They are questioning the ethical context in which the appointment was made by a governor who has allegedly corrupted the appointment process and defied the consensus reached by both Democrats and Republicans in the state legislature that an appointment should not be made under this cloud of corruption, an appointment that has now unfortunately cast a cloud over Burris. The point of this article is that "those black lawmakers" will not be swayed to protect Blagojevich either from impeachment or from the investigation that is pending against him simply because he appointed a black man to the senate seat and has done other things favorable to the black community. In other words, even if Burris is seated, which I have no doubt he will be, the governor will still be held accountable by the state of Illinois, including the black lawmakers and the black constituency that Blago has tried to manipulate with this appointment.

I assume that by "distraction," you mean the attention the media is giving to this story, but that's because the media is still trying to make this story about Obama, who is no more a party to Blago's drama than they are.

Why is ethics suddenly an important consideration for these Senators in the acceptance of Mr. Burris as the appointee? Recall reviewing a list of lobbyist supporting many of these lawmakers which obviously swayed how they voted on certain issues ... and now we are to believe it is all about ethics???
