DMX Sentenced To 90 Days In Jail

PHOENIX — Rapper DMX was sentenced to 90 days in jail Friday for convictions on theft, drug-possession and animal-cruelty charges. DMX, whose real name is Earl Simmons, also was placed on at least 18 months' supervised probation by Maricopa County Superior Court Commissioner Phemonia Miller.

Simmons pleaded guilty Dec. 30 to three felony counts _ theft, possession or use of marijuana, and possession or use of narcotic drugs _ and one misdemeanor count of animal cruelty.

The 38-year-old rapper has been in the Maricopa County Jail since being arrested Dec. 9 in Miami on a warrant after failing to appear in court in Phoenix. His attorney, Stephen Lee Crawford, didn't immediately return calls seeking comment.

The Arizona Republic reported that Simmons was smiling as he entered the courtroom but sat down writhing in pain and subsequently said he had pain in his feet and knees and thought he was suffering from gout.

Miller told him she was sentencing Earl Simmons, not DMX, the newspaper reported. "I don't know DMX. Mr. Simmons, it's time you do something different," she said. "What you have been doing is not working."

Despite the prosecutor's objections, Miller said she would allow Simmons to apply to serve his sentence in Florida, the Republic said.

The animal-cruelty and drug charges stem from an August 2007 raid that Maricopa County sheriff's deputies conducted at Simmons' home in Cave Creek, a Phoenix suburb. Authorities investigating a report of animal abuse found three dead dogs, guns, ammunition and drug paraphernalia.

He was not given credit for time served and will not get out of jail until the end of April, said Mike Anthony Scerbo, a spokesman for Maricopa County Attorney's Office, which prosecuted the case.

DMX's albums include "It's Dark and Hell is Hot," "Flesh of My Flesh, Blood of My Blood" and "Year of the Dog ... Again."

I love this. I absolutely love it. He looks good in prison stripes. I'm sure he's going to be fitted for several such suits in his lifetime. They should put him a cell with a pack of rabid dogs, and throw away the key.

Yeah, but 90 days in the Maricopa County Jail is like 900 days in the average US jail, especially if he has gout and isn't getting medical attention.

I am ok with the punishment. I doubt he would really mind 90 days in jail. Its not like its gonna really ruin his life or career. Actually it kinda gives him some "street cred"...lol...he might even leverage that to sell a platinum. you go dmx !!

I hope he gets his act together before its too late. The cruelty to animals is especially disturbing considering he was convicted on similar charges in New York States a few years ago. He doesn't seem to be learning from his mistakes.

Yes rap music has been soooo good for our kids. This 'music' has done wonders toward steering youngsters to being upstanding citizens.Hope he rots.

1. I only raised the question: when does someone become useless to humanity? Sure, that implies that we could start with Earl Simmons, a career criminal who has somehow been rewarded for it in the upside down world of chanting where teenagers are sold lies and fantasies of criminality. Through dialogue we might have found that he is not useless despite the evidence, but that doesn't seem to have been the result so far, does it? 2. I've taught hundreds of students in America as well as China at the high school and college level. I impacted their lives with insight and inspiration (or so they told me), based on literacy, history and the rule of law. I wrote a novel Salvation Road about homelessness in the US, and it inspired many to increased public service. I play music weekly w musicians who all know how to play a real instrument, or write a sonnet 100x more elegant than your average chanter. I've helped hundreds to make honest money and stay safe in the investing world, managing millions of dollars that will go to charities from the City of Hope to Western University and others. I post to blogs to counter the shoddy reasoning and criminal minded of society who care for nothing but themselves. If all that makes even one realize that they can contribute to society in a positive rational way, then I have done more than Mr. Dextromethorphan has ever done for the US.
