Burris' Ethics Bubble Bursts, Opening Door For Expulsion

By admitting that he tried, without success, to raise money for former Gov. Rod Blagojevich prior to Blagojevich appointing him to the U.S. Senate, Sen. Roland Burris has exposed himself to whole new set of complex and potentially damaging legal hurdles, ethics lawyers say.

No longer is the question -- as was the case during Burris' controversial appointment -- whether or not he is qualified to serve in office. Now it is a vaguer dispute over whether, by acknowledging that he left out information during his impeachment committee testimony and (unsuccessfully) tried to fundraise for the embattled former governor, Burris has exhibited conduct that deserves reprimand, censure or even expulsion from the Senate.

"We are beyond the constitution now," said Ken Gross, a Washington lawyer who heads Skadden Arp's Political Law practice. "It is within the Senate's authority to expel him from office. And the standards are amorphous... In recent history I don't know if a flat perjury conviction has ever been the basis for removal but it certainly could be. And in this case the Senator came in with two strikes against him already. There won't be many people standing up for him now."

The Senate has the authority to remove Burris from his current post, provided two-thirds of the body votes to do so. The process by which that would happen, however, seems far-fetched. For starters, as Gross notes, history shows that such punishments "are few and far between." Senate Democrats would have to willingly submit themselves to the same political histrionics that accompanied Burris' initial appointment. Even if they decided to walk down that path, there is hardly a guarantee that they would have the votes, though Gross says it is conceivable. Democrats could unanimously support the measure but be stymied by Republicans trying to keep an ethically tainted Burris in office as long as possible.

"My hunch is that if they want to go through this again, to wind up the machine one more time, they will fail to garner a 2/3 majority," said Tom Gerety, a legal professor at New York University and former president of Trinity and Amherst College.

And yet, the wheels are turning. Good government groups are already demanding Burris' expulsion, even before perjury has been proven. In the meantime, the Senator himself and Majority Leader Harry Reid have supported sending the matter to the Senate Ethics Committee, though that institution is notoriously slow and often lenient when it comes to investigating its own. Certainly the optics are damaging enough that it could spur the type of political reprimands that Congress rarely sees.

"What Congress can do ultimately is to censure him if they find his testimony was not consistent," said Stan Brand, an ethics expert with the Brand Law Group. "Theoretically they could expel him, though they would have to find that somehow this was intimately related and germane to his fitness to serve in the Senate and that his misstatements, if they were such, went to the heart of the Senate's agreeing to his being seated."

Complicating matters for Burris is the fact that he lacks the type of institutional support structure that has saved the hide of embattled officials in the past. He's served only a few weeks into office and came into the position under an ethics cloud. Senate Democrats view him as a liability who endangers their chances of holding unto the seat.

"It's becoming ridiculous," one senior Democrat told the Huffington Post. "It's time for the drama to end so we can actually win this Senate seat. We need this seat in 2010 -- it's the President's seat -- and while the Republicans are lining up solidly behind a potential [Rep. Mark] Kirk candidacy, we have a deep bench of talented candidates who can't jump in yet because of Burris."

In short: when Burris needed a smooth transition into office, he got a bumpy ride; when he needed distance from Blagojevich, he was drawn closer; and when he could use backers, his corner is empty. Whether this is enough to endanger his spot in the Senate seems unlikely. And yet, he has handed Democratic leadership in Washington an excuse to (at the very least) push him to sidelines in 2010 and (at worst) consider a more extracting punishment in the weeks and months ahead.

"It seems to me," said Brand, "that the Senate can argue with some force: 'Look, we stepped back because we thought he was qualified to serve. But if in the very act of him qualifying to serve in the Senate he perjured himself, how than can we not take cognizance of that?'"

He left out this information at the time of the hearing because he knew that it would be much
harder to get him out, once he'd been confirmed, than to disqualify him from the get go.
The man is clearly a liar, and a self-serving egotist, desperate to have his last shot at
the best entry yet on his tombstone: US Senator, after failing to get elected. He deserves
to be expelled from the office.

Cantor was all for TARP since it would bail out his wife's company and she could be paid her $400K but the stimulus package, which was about the same size as TARP, was too expensive.

Cantor is the lone jewish repub. The old guard repubs are simply using this guy only as a winning tool for FL, NY where the repubs have lost what little clout they had in those states. Aero smith has now banned him from using their music.

'Pack it up' Burris, it's time to say good bye.

You had your chance to tell the truth and you chose to hide a lot of information.

Don't go playing the race card either, you will just embarrass yourself and Obama.

We have bigger challenges facing this nation than to play games with a man who hid the truth.

Let's get somebody in that Senate seat that will NOT be a distraction from Obama's agenda for America. If you drag this out like Blago, shame on you.

History Lesson:
1. Rahm Emanuel contacted the Governor to give(Obama's) acceptable list of names, including Valerie Jarrett.

2. Poor Jessie Jackson, Jr got his name smeared because he lobbied for the position(African American).

3.Harry Reid contacted the governor for three females, including Lisa Madigan (Illinois Attorney General) and some woman who got her legs shot off in Iraq.(non African American)

4.The Governor was threatened not to appoint anyone.

5.The Governor was told it would be illegal for him to appoint someone, although it was prescribed by by the Illinois law.

6. Harry Reid, Dick Durbin, and Obama issued a statement saying No one appointed by Blago should be seated.

7. Illinois Representative Madigan(Lisa Madigan's father) led the House in impeachment against the Governor.

8. The Republicans in Illionois all wanted a Special Election and did not want the Governor to appoint another Democrat.

9. The Republicans in the U S Senate were quiet, because the Democrats were fighting to keep a Democrat out of the Senate.

!0.The Governor appointed Burris. He was smeared , threatened and refused a seat in the Senate.

11. Burris filed with Illinois Supreme Court to get signature for Senate seat, after Illinois elected official would not sign paperwork.

This was Blagojivich's clever parting kick in the groin to the Democrats. How could the Democrats stand in the doorway against a black candidate for Obama’s old seat with loud-mouths like Bobby Rush crying "rascism"? They couldn’t and folded like a cheap tent in a stiff breeze showing once again how spineless the Democrats are.

This was a little mischief-making by Blagojevich as he exited the stage and will weaken the Democrats and hand a golden opportunity to the Re THUG lie cons. And Burris, in his ambition to add "U.S. Senator" to his mausoleum wall, not only played along but lied under oath in the process. He's tainted the Democrats with his sleazy ambition, created a damaging distraction from their agenda at a key time, tarnished his own reputation, and created an opening for the Re THUG lie cons to possibly gain an important Senate seat.

The Democrats can't afford the distraction or giving the Re THUG lie cons more ammunition or the Bobby Rushs of the world more opportunity for grandstanding. Give Burris the Larry Craig treatment; ignore him and hope nobody notices that he's still around.

I think that this is a tempest in a teapot (one that conveniently for the gops will upset the balance of the Senate). The manufactured and overblown "crimes" for which Senator Burris is being demonized usually result in an admonition, not expulsion. I don't care what the Wash Post, and NYT think. They have long lost all credibility and have no more clout. I hope the Senate Committee will keep its wits about on this, and move on.

I am sorry but the Dems can't take a b ullet on this one. Had Roland Burris been a more honorable person we wouldn't be having this conversation.

The Dems can not jeopardize their political gain by accepting or excusing Roland Burris behavior. He either must resign or be kicked out the Senate. And if he thinks the process is unfair well he just needs to looks how unfair this process was when he was forced upon us. And as you can see there is no one rushing to the media to defend him not even his race card pushing Bobby Rush.

"Overblown" is exactly right. The fact not reported is that Burris never attempted to raise campaign funds for Blago during the time a replacement was being sought ! If being asked to assist in raising campaign funding is criminal, woe be it to ALL politicians !! But, what does facts have to do with a gleeful yet sick public lyn ching !

We knew before the Senate approved him that Burris's lobbying firm had secured Blagojevich's wife a position on some lofty foundation.

How anyone could over-look it is criminal itself. And that's what the Democrats are facing here.

They knowingly sat a man who pre-paid for his appointment from a governor known to be selling it.

Roland Burris clearly lobbied Blago (and/or his people) for the Senate seat, and now he's caught in a lie. Just because he's Black doesn't make him pure. He lobbied for a seat he would not have gotten on his own merrits, and chances are Blago probably got something back for it. He should have never been seated in the first place, and he's proving himself a disgrace to all African-Americans who work hard to make their way through politics by legitimate means. People like Burris only serve to further the stereotypes that people harbor about African-Americans, and as painful as it may be, its past time we start calling them out.

I'm wondering why you Dems aren't on Cantor and his conflict of interest issues, regarding the bailout -- that is much more salient.

This Burris issue is minor, old, rehashing an old affadavit and you are falling for, only because the media is dictating the terms to you.

Check out Cantor and insist that the MSM investigate this major issue of ethics.

The MSM is guilty/complicit in creating issues, where none exist and igorning the really important issues -- don't fall for it.

My first inkling was that there's just people who don't like the man (Burris) ... my second was that people still get their kicks scapegoating ... and now, I think you're right. Just another opportunity to smear.

Again, Burris raised no campaign funds for Blago during the selection process ... and if raising funding is somehow criminal ALL politicians are as guilty.
