Josef Fritzl Pleads Guilty To All Counts On Third Day Of Trial

ST. POELTEN, Austria — Josef Fritzl abruptly pleaded guilty to all of the charges against him Wednesday _ a surprising twist amid disclosures that the daughter he imprisoned for 24 years in a dungeon where she bore him seven children secretly sat in on the trial.

Adding intrigue to a case that has drawn worldwide attention, Fritzl calmly acknowledged his guilt, including to homicide, and said his change of heart came after hearing his daughter's heart-wrenching videotaped testimony.

"I declare myself guilty to the charges in the indictment," Fritzl, 73, told a panel of judges, referring to what he called "my sick behavior."

Fritzl was charged with negligent homicide in the death of an infant boy as well as enslavement, rape, incest, forced imprisonment and coercion. Initially he pleaded guilty to incest and forced imprisonment, and partially guilty to rape and coercion. The change means he could face up to life in prison for the homicide charge.

Legal experts say the eight-member jury will still have to deliver verdicts despite Fritzl's guilty pleas, although his confessions could be grounds for a lesser sentence. Verdicts and sentences were expected Thursday after closing statements.

Fritzl's daughter Elisabeth was the prosecution's key witness. Now 42, she was 18 when he imprisoned her in the squalid, windowless cell he built beneath the family's home in the town of Amstetten, where he raped her for years, sometimes in front of the children.

Asked by the judge what led him to change his mind, Fritzl said it was Elisabeth's testimony. Fritzl, jurors and others in court viewed 11 hours of her videotaped statement during closed-door sessions Monday and Tuesday, but officials were not allowed to provide details.

Fritzl's lawyer, Rudolf Mayer, said his client asked to see a psychiatrist after Tuesday's court hearing.

"It must really have shaken him up," he said of Elisabeth's testimony.

However, a person familiar with the trial told The Associated Press that Elisabeth herself was in court on both days, when the public and media were excluded _ suggesting her presence might have unnerved Fritzl and prompted him to change his pleas. The person spoke on condition of anonymity because discussion of the closed proceedings was not authorized.

Before the trial, prosecutors had said Elisabeth would not be present. Court spokesman Franz Cutka said Elisabeth was not in court Wednesday and declined to comment further.

The homicide charge came for the death of a 2-day-old twin boy _ Michael _ born to Elisabeth in April 1996 who prosecutors say might have survived with proper medical care had he and his mother not been locked in the basement.

Elisabeth and her six surviving children, who range in age from 6 to 20, have spent months recovering in a psychiatric clinic and at a secret location. Prosecutors have described her as a "broken" woman.

Psychiatrist Adelheid Kastner told the court Wednesday that Fritzl has a serious personality disorder and would pose a threat to others if freed. She recommended that Fritzl serve his sentence in a special prison for psychologically deranged criminals or a ward for abnormal criminals in a regular jail.

Fritzl expressed regret that he didn't bring the ailing infant out of the cellar and get medical help.

"I don't know why I didn't help," he said. "I just overlooked it. I thought the little one would survive."

"I should have recognized that the baby was doing poorly," he added.

Fritzl's lawyer had previously claimed his client only saw the newborn once he was already dead; Fritzl told investigators he burned the body in a furnace.

Erich Huber-Guensthofer, deputy head of the St. Poelten prison, said Fritzl had an "extensive conversation" with a psychiatrist after Wednesday's hearing.

Police say DNA tests prove Fritzl is the biological father of all six surviving children, three of whom never saw daylight until the crime was exposed 11 months ago.

The other three children were brought upstairs to be raised by Fritzl and his wife, Rosemarie, who was led to believe they were abandoned by Elisabeth when she ran off to join a cult.

Prosecutors told the court Fritzl refused to speak to his daughter during the first years of her ordeal, coming downstairs only to rape her.

Kastner, the psychiatrist who met with Fritzl several times and wrote a psychological profile for the court, said the Austrian had a deep need to control people. She said Fritzl had an ability to block out his crimes but knew what he was doing was wrong, acknowledging he had a guilty conscience when he went to bed at night and when he woke up in the morning.

"Fritzl is guilty for what he did," she said, adding he also believed "he was born to rape."

The AP normally withholds the names of victims of sexual assault. In this case, withholding Elisabeth's name became impractical when her name and her father's were announced publicly by police and details about them became the subject of publicity both in their home country and around the world.

No possible way has he had any "feelings" of any kind in terms of his daughter's testimony. This criminal is beyond human feelings. If he could do what he did for years, how would her presence in court or on tape for a few hours have any effect. This type of criminal always pleads remorse when their action so they are just not capable of it. Sounds like no death penalty. Too bad.

He'll probably only serve 6 months at best, and die of a heart attack.

I always wonder about his wife. She is just like John Wayne Gasey's wife. Both claim not to have heard anything when their husbands were brutalizing people in their homes for decades. I do not know if this is willful blindness, they were scared to say anything, or if they are brain dead.

This is so monstrous. I hate that he is alleging that he raped his daughter, fathered 7 children with her, killed one of his children/grandchildren, and kept these people in a dungeon is all because his mommy wasn't nice to him. I wouldn't believe this monster if he told me he was lying. One of the tools in the sociopath's arsenal is the ability to deceive. They are capable of false charm, manipulation, and wearing all sorts of masks. Even if he did have a troubled relationship with his mother, the vast majority of victims of abuse do not go on to be abusers. His behavior is so off the charts that I must wonder if considering what is likely a false story about his childhood is even instructive when trying to figure him out. Incest, rape, murder, enslavement, physical and psychological torture (he raped his daughter in front of their 7 children) is not concomitant with a mean mother.

I wish Austria would send him here. The boys in Attica would give him a taste of what he deserves. God help that family.

Your comment reflects a stereotypical understanding regarding what someone who brutalizes vulnerable members of society "looks" like! The belief in "Stranger Dangers" is a myth that has allowed society to turn a blind eye to look more closely at people who are "upstanding" citizens and "pillars of the community" that have perpetuated despicable crimes against women, children and men!

And he isn't the first and he won't be the last to do something this horrif|c to his own child or someone else. I'm sure it's going on right now somewhere on this planet that we will hear about years from now. He should be tortured and left her to d|e just like he did one of his children. There is no room for a light sentence or mercy on this man's remaining years.

The thing i was amazed at is that when this was first revealed, it turne out there were other women who had gone thorugh similar ordeals and were willing to provide the daughter with emotional support. A woman in France who also had a bunch of kids by her father after being locked up by him for like 14 years, and one in Romania, I think. And now there have been several similar stories in the US.

I keep trying to imagine a world where men and women were in totally equal positions of power and in which the idea of domineering someone was completely unfathomable.

What a ghastly man. I guess after 20 years she didn't resist, so it must have been consensual. He will have no idea of the damage he has done to his whole family, even the ones he allowed to live in the light.

Not resisting does NOT equal "consensual." She was a broken woman, sure that she would never be rescued, sure that her children would never be rescued. He had the power. He had the psychological edge (telling them that booby traps would go off if they ever tried to escape). There was nothing she could do. Nothing. Not resisting does NOT equal "consensual." Not resisting does NOT equal "consensual." Not resisting does NOT equal "consensual."

Otherwise I agree with you. The entire family, except perhaps the youngest boy, will always be horrifically damaged, even the upstairs children. Imagine finding out your "grandfather" was not only your father, but that he was a monster too.

It sickens me that he's playing the mental health card here , lining himself up for life in a hospital.

He had enough nous to build a cellar with a high tech electronic door ( or DID someone help him with that ?) to shop away from his home town for goods for the captives , to make up and embroider stories about the arrival of 3 or 4 doorstep babies. Of course he knew that what he was doing was wrong that he had to hide his appalling crimes
Even the covering of his ugly face with the blue folder shows that he KNOWS very well what he did was beyond despicable

His only 'disorder' is that he is morally bankrupt .
He suffered from overwhelming sense of entitlement and arrogance and is a foul, and despicable waste of oxygen.

I hope like hell that the psychiatrists don't somehow convince The Court that this sub human should be cared for in a hospital

One mystery to me in this: The children who were brought upstairs to be raised by the wife--how old were they when this occurred? Didn't they have memories of living in the cellar ? I don't understand t his. Or was each one brought upstairs separately as an infant?

Each separately as an infant. Always with notes he forced her to write in which she was supposedly dropping off the lovechild resulting from commune orgies.

It was appalling.

The Fritzls were considered these poor beleaguered grandparents who had to take care of their daughter's mistakes. Unbelievable.
