Congressional Democrats and labor officials pledged on Tuesday to push forward with the Employee Free Choice Act even as their best hope for a Republican defector, Sen. Arlen Specter, said he would oppose the legislation.

In private, union hands said they were stricken by and furious with Specter's pronouncement, pointing out that the Pennsylvania Republican had co-sponsored the legislation in 2003. One noted that Specter's main excuse -- that it was not best to consider measures that would increase unionization during a recession -- was debunked by history.

"Traditionally labor law is enacted during tough economic times," said one high-ranking official. "Look at the National Labor Relations Act that Specter himself cited," which was put into place during the Great Depression.

Angered but not deflated, these officials insisted that the EFCA debate was in no ways dead. Majority Leader Harry Reid struck the first note, telling reporters Specter "is not the only Republican who has indicated a willingness to see something done ... He's not the only suspect."

A Senate Democratic aide deeply involved in passing the legislation was slightly less defiant but similarly hopeful. "Look at it this way," said the aide. "It is not a complete set back. We are still going to move forward and we are open to compromise ... and bringing folks to the table."

Republicans, meanwhile, were downright gleeful. "This is not going to happen now," said Grover Norquist, president of Americans for Tax Reform and the man who broke the Specter news, "unless someone gets hit by a meteor or something."

Specter has certainly changed the playing field. A legislative battle that resembled trench-warfare has suddenly become far more diplomatic. Compromise on EFCA, in particular, began popping up frequently in Tuesday afternoon conversations. Specter, in the statement announcing his opposition, opened the door to supporting reform in labor law.

"In seeking more union membership and negotiating leverage, Labor has a valid point that they have suffered greatly from outsourcing of jobs to foreign countries and losses in pension and health benefits," said the Senator. "The better way to expand labor's clout in collective bargaining is through amendments to the NLRA rather than through eliminating the secret ballot and mandatory arbitration."

Meanwhile, the main Democrat leading the EFCA charge in the Senate, Iowa's Tom Harkin, showed a willingness to meet Specter on some middle ground.

"I am disappointed by Senator Specter's statement that he cannot support the Employee Free Choice Act in its current form. I do, however, welcome his recognition of the need for labor law reform. There can be no doubt that working Americans are looking to us to make the workplace a fairer, more secure place for them."

Indeed, in light of Specter's proclamation, the onus now seemed to be on finding a more palatable legislative vehicle to move the tenets of EFCA forward. But the most publicized alternative up to this point -- Democratic strategist Lanny Davis' proposal that would keep the secret ballot in place and not touch mandatory arbitration, while allowing provisions that would make it easier for some workers to organize -- was dismissed out of hand.

"That proposal made current law look like compromise," said the Democratic Senate aide.

I recall scores of posts on HuffPo ripping Specter for forcing centrist changes to Obama's stimulus bill. It seems that many people think it's easy to elect a progressive to any seat currently held by a Republican or a moderate democrat. If that's true, why worry about Specter bailing out on EFCA in what MUST be political suicide since all people everywhere support the progressive agenda. Just wait until after the next election when Russ Feingold clones will sweep every state.

Many progressives need to figure out that they help their agenda by tolerating relatively friendly pols in more conservative districts.

You may be more prophetic than you think. About 20 Senators with the character and intellect of Senator Feingold would be stupendous. Just one of that caliber replacing spineless Specter would be a windfall.

I wasn't criticizing Feingold, only the notion that someone like him would be elected in Pennsylvania to replace Specter.

And no, I'm pretty sure I won't be more prophetic than I think.

The fact is Specter needs Democrats more than they need him, he will loose the GOP primary in 2010 and the Democrats will pick up that second seat, because Governor Ed Rendell will run for that seat and win it. The new Democratic Majority is coming. Labor and the Dems are putting politicians in the cross hairs, they will all come out on the record opposing it and in 2010 election it will count against people like Specter. He just got punked, Labor and the Dems should wait until 2010 election cycle to bring EFCA to a vote, that will create more of a "shock wave" among "we the people", everything is timing, we need EFCA, but time is on our side, continue to use the EFCA coming to a vote this year and get all these GOP/DINO'S to verbally oppose it, then reschedule the clock to bring it to a vote next year and use it in election mailers and ads. Specter doesn't support union's, he is so over, he really think he will still attract votes in PA? SPECTER IS A GORNER!

The Unions are not doing enough to get the word out about the benefits of being a Union member. If more workers had the facts about Unions and not the twisted GOP/Corporate version, Unions would be thriving. It's in the best interest of the GOP/Corporate types to continue to have workers believe the boogie-man stories about the Unions. So, to all the non-Union workers out there, keep drinking the koolaid and there will be more money in the pockets of the GOP and their Corporate sponsors. It's up to all Union members to spread the word...Unions mean better pay, better benefits and representation at the decision-making table. Unions are pro-business and want companies to succeed; we just want a fair piece of the pie we helped to create. A successful company means a successful Union.

O.K., Senator Specter, you decided for us. You probably wouldn't make a good fit if you transferred to the Dems anyway..You would be very divisive and hurt the party more than you would help. I guess we just have to compete against the next Repub winner in a Pennsylvania primary and try to replace you with a real progressive. Blue Dogs can be more trouble than they are worth

I do not think anyone realizes that the culture surrounding all these corporate and political figures is a culture of corruption and dishonesty and this is why they act as if they do nothing wrong.
they have lived lives in it and surounded by this kind of corruption and have come to believe they are entitled to it. and they further believe in it. They see it as normal! and worse yet like nothing is wrong with it. i think they are stunned that they are even asked the questions. like "what, everyone does it" It truly is like the emperors new cloths. the emperor is the real one that is clueless about it.
There delusions of grandeurs are inflating there egos to heights unattainable by logic! or reality!
And who pays for it? all the rest of us suckers out hear being good little surfs! No wonder they throw parties!

Good point, many things will happen at a slow pace even though everyone seems to be clamoring for things to be immediately, if not sooner. Another bright note, I think, the Dem.'s will have 60,... no let me go out on a limb here,..62-65 at least by 2012. Maybe even more if the Pub's don't get their act together, and they won't!!

Why is labor not out there campaigning and creating flyers and passing them out to the people? We have a unique opportunity to get people to see the benefits of unions and organizing but we have to move soon. I think the flyers should say something like:

AIG executives get millions of dollars in bonuses because their CONTRACT required it. How much of a bonus did you get this year because of your contract? What? You don't have a contract with your employer? Well maybe you should. Contact your congressman and tell them to support EFCA.

OR

If CONTRACTS that provide big bonuses are good enough for executives of big corporations like AIG, then why are these same executives so opposed to contracts for the employees that work under them? Contact your congressman and tell them to support EFCA.

There's a lot of community outreach that Organized labor should be doing from both the point of view of raising public awareness and education, as well as an overall moral need for working people to be reaching out to one another in support in these hard times.

Organized Labor is missing a huge opportunity.

Wait till all those union voters swing to his Democrat opponent. Maybe he can get a job as a night manager at Walmart. Oh, I forgot, he is already on their payroll.
