In the Bernie Madoff case, the $50 billions money didn't go up in smoke, it goes somewhere.
The principle of a Ponzi scheme is to steal money from some investors to give others fantastic returns (keeping a generous cut for himself).
Why aren't those "others" force to give back those nonexisting returns to the victims?
Thousands of investors receive fraudulant money ($ bilions) and they should be at least moraly liable to return some of it.
