Luis Ramirez Killers Found Not Guilty After Beating Mexican Immigrant To Death

POTTSVILLE, Pa. — Prosecutors called the beating death of an illegal immigrant from Mexico a hate crime, and they urged an all-white jury in Pennsylvania coal country to punish two white teenagers for their roles in the attack.

Instead, the jury found the teens not guilty of all serious charges, a decision that elicited cheers and claps from the defendants' families and friends _ and cries of outrage from the victim's.

Brandon Piekarsky, 17, was acquitted of third-degree murder and ethnic intimidation, while Derrick Donchak, 19, was acquitted of aggravated assault and ethnic intimidation. Both were convicted of simple assault late Friday following a trial in which jurors were left to sort out the facts of an epithet-filled brawl that pitted popular football players against a 25-year-old Hispanic man, Luis Ramirez, who appeared willing to fight.

A representative of Ramirez's family said the jurors got it wrong.

"There's been a complete failure of justice," said Gladys Limon, staff attorney for the Mexican American Legal Defense and Education Fund, who attended the trial and informed Ramirez's family of the verdict. "It's just outrageous and very difficult to understand how any juror could have had reasonable doubt."

On Saturday the group's interim president, Henry Solano, called on the Justice Department to "bring justice to the Ramirez family and send a strong message that violence targeting immigrants will not be tolerated." Piekarsky's attorney declined comment on the possibility of federal charges against the teens.

Prosecutors had cast Ramirez as the victim of a gang of drunken white teens motivated by a dislike of their small coal town's growing Hispanic population. They said he was killed by a kick to the head from Piekarsky after he'd been knocked unconscious by another teen.

The jury evidently sided with defense attorneys, who called Ramirez the aggressor and characterized the brawl as a street fight that ended tragically.

Jury foreman Eric Macklin said he sympathized with Ramirez's loved ones but that the evidence pointed to an acquittal.

"I feel bad for Luis's friends and family. I know they feel they haven't gotten justice," he said.

The simple assault convictions carry possible one- to two-year prison sentences. Donchak was also convicted of corruption of minors and an alcohol charge, both stemming from his purchase of beer and malt liquor that he drank with his underage friends the night of the fight. Sentencing has not been scheduled.

The case exposed ethnic tensions in Shenandoah, a blue-collar town of 5,000 that has lured Hispanic residents drawn by cheap housing and jobs in nearby factories and farm fields. Ramirez moved to the town about seven years ago from Iramuco, Mexico, working in a factory and picking strawberries and cherries.

The 2000 U.S. Census showed that Schuylkill County's population was 96.6 percent white, with 1.1 percent of the county listed as Hispanic or Latino.

The fight began late July 12 when a half-dozen teens, all Shenandoah residents who played football at Shenandoah Valley High School, were walking home from a block party and came across Ramirez and his 15-year-old girlfriend in a park.

Brian Scully, 18, asked the girl, "Isn't it a little late for you to be out?" That enraged Ramirez, who began yelling in Spanish and dialing friends on his cell phone. Scully admitted shouting ethnic slurs. The verbal sparring soon turned into a physical altercation as Ramirez and Piekarsky traded blows, though prosecutors and defense attorneys disputed who threw the first punch.

Donchak then entered the fray and wound up on top of Ramirez. Prosecutors said he pummeled Ramirez, holding a small piece of metal in his fist to give his punches more power. Defense attorneys said Donchak tried to break up the fight between Piekarsky and Ramirez and denied he had a weapon.

The two sides eventually went their separate ways. But Scully kept yelling at Ramirez, leading the immigrant to charge after the group.

Colin Walsh, 17, then hit Ramirez, knocking him out.

"Does Mr. Ramirez fit the description of an innocent soul who just happened to get picked on by a group of kids?" Piekarsky defense attorney Fred Fanelli asked jurors in closing arguments. "He's the only adult, and he makes some bad choices."

Fanelli accused prosecutors of ignoring exculpatory evidence, including statements by two of Ramirez's friends shortly after the fight that the kicker wore white sneakers _ the color Scully was wearing.

Fanelli also said prosecutors offered leniency to key witnesses _ including Scully and Walsh, who admitted knocking Ramirez unconscious with a punch to the face _ giving them a strong motive to lie.

Walsh pleaded guilty in federal court to violating Ramirez's civil rights and could be out of prison in four years. On the witness stand, he identified Piekarsky as the kicker. So did Scully, who told jurors he tried to kick the immigrant but missed. Scully is charged in juvenile court with aggravated assault and ethnic intimidation.

Fanelli derided the prosecution testimony as "bought and paid for."

Robert Franz, the prosecutor, denied any misconduct on the part of the district attorney's office.

Displaying a candid photo of Ramirez, Franz told the jurors, "He was assaulted and he was beaten, and he was killed for walking the streets of Shenandoah. He didn't deserve that."

Actions have consequences. Even though their sentences do not fit the crime, the actions of these young men will have life long consequences. The same is true for the victim. Starting from the fact that if he was indeed in the US illegally through his decision not to leave well enough alone. As far as the white jurors, they acted no differently than the OJ jurers in nullifying this crime.
Every crime is an act of hate by definition! If some groups are elevated by Hate Crimes legislation doesn't that violate equal protection under the Constitution? Seems like a 6th grade Social Studies class could argue that point.

How? How exactly will these kids feel the consequences of their actions? Further the same is NOT true for the victim. He is DEAD, so sorry, he won't be feeling the "consequences" of his actions. And to bring up the fact that he may have been here illegally completely and utterly misses the point. You are doing nothing but trying to find negatives about this guy to justify your NOT feeling any remorse or sadness at his BRUTAL killing.

And not every crime is an act of hate by "definition". Are you serious?! If I run a traffic light, that's a CRIME. It is NOT an "act of hate".

And hate crimes legislation does NOT violate any Constitutional law. Every race, creed, religion and hopefully sexual orientation, will be protected under this legislation.

Lastly, you should maybe do some research into WHY hate crimes legislation was ever needed in the first place. That may help you to understand better.

You're obviously missing some of the most important points.

1) He is an illegal immigrant. He is not legally considered "American", hence, he does not receive the legal rights and fairness that we Americans have. Therefore, by going to court against "Americans", this man's side was already at a disadvantage (I don't doubt that there may have been biases)

2) Even though these idiots were given the "Not Guilty", they still did what they did; it's on their record for good. Therefore, they're going to get what's coming for them. Schools, and jobs will look at this record....it's gonna hurt their chances by a lot. So that's what Humbleopinion means by consequences.

First off I read that Ramirez's fiance his (girlfriend) was 24 not 15, second I do believe it was a racial crime if not it was still wrong it was three to one these boys knew what they were doing I know sometime when we fight we say things that maybe racial slurs. but these boys provoked Ramirez, all he was doing was having a good time with his girlfriend at a park and they came to bother them so as for me all I see is a man got killed for trying to protecting his girlfriend and himself.

As the adult in the situation and the sober one Ramirez could have done the responsible thing and walked away. After the first fight when everything was done and the two groups were parting Ramirez could have left well enough along but instead he attacked the group a second time.

If Ramirez had behaved like an adult he would be alive today.

if Ramirez were still alive he is the one that should have been charged with assault. As the adult he should have kept his cool and walked away but instead he chose to be confrontational and fight. Then, after the first fight was over and everybody was walking away, Ramirez, could have let it go but instead chose to instigate another fight which led directly to his death.

So many people on this board are ignoring the undisputed facts in the case and are screaming that the teens and jury are racist because they are white. This shows us who the real racists are.

First of all, he was an illegal alien, not an immigrant. And frankly trying to be oh so politically correct is a disservice to all latinos who have been citizens for generations or legitimately came here on an immigrant visa.

I don't wish harm to anyone. Okay I do get a chuckle when someone trips trying to walk in stilettos. But the hypocrisy here; let's dump all the jurors into that burning coal fire in Centralia. Hoping there is no vaseline in jail. Nobody ever ever deserves to be raped.

The people of Selingsgrove PA overwhelmingly protested the planned deportation of Filipino Drs. Servano. Their immigration snag was that they failed to timely report their change of status. They married each other whilst waiting for their individual green cards to be granted. Immigrant physicians, nurses and physical therapists have benefitted so many us rural areas in getting access to health care.

My guess is that all involved here were punks. If enough political juice is applied, yes there may be a federal trial. And maybe by that time the pope will have recognized Saint Luis's first miracle.

Stop RACE-BAITING!! There's a legitimate way to discuss race, crimes and their intersection. This is not the way. The page's headline "All-White Jury Finds Teens Who Admit Beating Mexican Immigrant To Death Not Guilty" is disgraceful at best. Concerns of the racial makeup of the jury can and should be reported AFTER the case's facts near the end of the article around the talk of appeals. I read the facts as you reported them, and there is nothing here to suggest that the white jury was corrupted by racial prejudice. The jury foreman was sympathetic! Any courtroom evidence of juror misconduct? Did the prosecution file a motion to move the trial beforehand? Did the prosecution voice any concerns with specific jurors during their selection?! This story makes Lou Dobbs look credible.

Something I don't get:

How is that exculpatory? They said Scully was wearing white sneakers, and the guy who kicked Ramirez also wore white sneakers. So, it matches. How is that "exculpatory"?

Scully had not been charged by the Prosecution for the fatal kick, Piekarsky was. The testimony of Ramirez's friends would have been in Piekarsky's favor since it would have implicated Scully as having struck the fatal blow .

Lets face it as long as we forget we are humans first we will always have this. Do we really know what happen no, but i have seen both sides here in san diego and it is not pretty on either side. It is ashame someone had to die over this, parents need to take more responsibilty of their kids. does anyone know what time it was it says late so what is late and why were they allowed to be out so late. They are still under 18 most so should have been home.

Either we did not hear the whole story or this was a shocking miscarriage of justice. I can say from personal experience having been the only white guy in an all Latino gang in Southern California for 4 years, that Latinos never made any comments to whites no matter how goofie or strange we might have found their routines or dress, yet Latinos were constantly harrassed and verbally abused by whites.
