Kiefer Sutherland To Be Charged With Assault: Reports

Kiefer Sutherland will be charged with assault by New York City police tomorrow morning after he head-butted Proenza Schouler designer Jack McCollough at a party on Monday night, according to several reports.

According to the New York Post:

The "24" star will appear at the First Precinct station house downtown, a source said. There, he'll be hit with the third-degree misdemeanor charge for allegedly bloodying Jack McCullough, the source said.

The New York Daily News reports that Sutherland will be issued a desk appearance ticket for the misdemeanor, "meaning he won't be jailed and will be free to travel before he's arraigned."

An arrest could impact Sutherland's probation status - he was arrested for drunk driving in Los Angeles in 2007, which put him behind bars for 48 days.

People.com reports that a possible arrest in New York could land Sutherland back in jail in Los Angeles:

Sutherland, who's currently serving a five-year probation term in Los Angeles for his second DUI conviction, may have violated those terms, which clearly state the actor must "obey all laws."

"Our office intends to contact the NYPD and New York prosecutors to review the incident and determine whether Mr. Sutherland violated probation," L.A. City Attorney spokesman Frank Mateljan tells PEOPLE.

Sutherland was previously arrested for drunk driving in 2004 after failing a field sobriety test.

Meanwhile, there are conflicting reports about Sutherland's whereabouts. While the Post reports that he's in France, the Daily News tracked him down to his girlfriend's Greenwich Village apartment.

The Daily News reports that Sutherland answered the door "wearing sweatpants and a long-sleeve T-shirt," saying "No, no," when asked for comment and slamming the door shut on the reporter.
