WASHINGTON — President Barack Obama's allies in the Senate will not provide funds to close the Guantanamo Bay prison until the administration comes up with a satisfactory plan for transferring the detainees held there, top Democrats said Tuesday. And in a further break with Obama, the Senate's top Democrat said he opposes transferring any Guantanamo prisoners to the United States for their trials or to serve their sentences. Secretary of Defense Robert Gates has said 50 to 100 Guantanamo detainees may be transferred to U.S. facilities.

"I can't make it any more clear," Reid said. "We will never allow terrorists to be released in the United States."

Sen. Dick Durbin of Illinois said Obama's plan to close Guantanamo is not dead _ only that the funding will have to wait until the administration devises an acceptable plan to handle the closure and transfer the detainees. Obama has promised to close the military prison by January.

"The administration has not come up with a plan at this point," said Durbin, who is the whip, or No. 2 Democrat in the Senate. He added that Democrats are likely to address the issue on later legislation. "I think Guantanamo should be closed and we have to wait for the president's direction on what happens to the detainees."

Durbin said that he could support transferring detainees to U.S. prisons. "Our prisons are filled with dangerous people, including terrorists. And not a single one has escaped," he said.

With debate looming on Obama's spending request to cover military and diplomatic operations in Iraq and Afghanistan, says Democrats will deny the Pentagon and Justice Department $80 million to relocate Guantanamo's 240 detainees.

The administration has yet to develop a plan for what to do with the detainees, and Obama's promise to close the facility is facing strong GOP opposition.

It appears to be a tactical retreat. Once the administration develops a plan to close the facility, congressional Democrats are likely to revisit the topic, provided they are satisfied there are adequate safeguards.

Explaining the reversal, Durbin said: "The feeling was at this point we were defending the unknown. We were being asked to defend a plan that hasn't been announced. And the administration said, 'Understood. Give us time to put together that plan and we'll come to you in the next appropriations bill.'"

The developments on Capitol Hill came as the Pentagon said it still expects the prison at Guantanamo Bay to be closed by January 2010 as Obama has ordered.

Pentagon spokesman Geoff Morrell told reporters on Tuesday that he sees nothing to indicate the January 2010 deadline will be delayed.

Republicans are poised with an amendment by James Inhofe of Oklahoma that would block any of the Guantanamo detainees from coming to U.S. soil to stand trial or serve their sentences. A detainee was released to France last week, leaving 240 at Guantanamo.

"Shuttering this facility now could only serve one end: and that is to make Americans less safe than Guantanamo has," said GOP Leader Mitch McConnell of Kentucky.

"Guantanamo is the perfect place for these terrorists," McConnell said later.

House Democrats also dropped funding to close Guantanamo when producing their version of the war funding bill, which easily passed last week.

The Guantanamo controversy has roiled Washington, with most Republicans adamantly opposed to closing the prison, which mostly holds enemy combatants captured in Afghanistan. Republicans say abuses at the facility are a thing of the past.

The Senate's massive war spending measure otherwise sticks closely to Obama's request. The House version effectively exceeds Obama's request by almost $12 billion, adding $2.2 billion for foreign aid and eight C-17 cargo planes despite Defense Secretary Robert Gates' desire to cease purchases of the aircraft as part of his effort to overhaul Pentagon procurement.

What about pulling the funding for keeping it open? Notice how they pulled the funding for "closing it"? You mean its cheaper to keep something open based on lies than to close it down? Yes.....because there were no commercial planes on 911. The very reason they have been detained was based on a treasonous lie. It is MUCH cheaper to keep it running than to close it down!

Using fear to stop one of the few progressive moves by this regime is about as low as it gets. We have a lot of bad, bad people in our prison and those in Gitmo are nothing compare to the thousands. A Gitmo is a huge blemish on our repitution and needs to clean up and turned back to Cuba, the rightful owners. No one who understand the Constitution can oppose this. No one who understand true American values would oppose this.

You are not speaking from a factual standpoint. We own the rights to Gitmo and have owned them for years through a long term lease that we have maintained with the Cuban government be it Batista or Castro. We have paid our annual lease fees to the Cuban government every year which gives us the legal right to occupy that property.
You are also misunderstanding what President Obama promised. He never said he was going to close down the Naval Base at Gitmo, only the prison. We have and will continue to operate the Naval Base there just like we do in other parts of the world. To close the naval base would be foolish and just shooting ourselves in the foot.
You really need to have a much better understanding of world events before you make claims about no one understanding the constitution can opposed this.
I oppose it and am a sholar of constitutional law and that law, along with international law allows us to operate that base in Cuba.

One reason might be that it's a symbol of the criminal acts committed by the previous administration against detainees. Bush created a gulag outside of the criminal justice system that was used to commit inhuman acts.
Closing Gitmo would show a commitment to correcting the sins of the past.
Just my opinion.

I agree with you entirely, it is like saying we have to tear down the White House for it is a symbol of the last eight years. Gitmo is the perfect, it is already housing the detainees, you do not need to find a new place. All you have to do is Clean house and make sure the same policies do not govern what happens there.

In my own humble opinion, dr., I don't think that the prison will ever truly get closed. I think all of the talk about closing down the prison was simply campaign rhetoric and funding the closing of a perfectly good, state of the art, modern prison would be another prime example of wasted taxpayer funds.
During the campaign it was a hot topic because it also was implied that prosecutions would be carried out against the former adminstration officials that had sanctioned waterboarding at the prison. I believe that we don't have to and will not close the prison and by the actions of the Democratic congressional leaders yesterday President Obama now has an out as to why he didn't carry out this campaign promise.
Again, this is my own humble opinion.

This issue is the one that caused me to turn from McCain.
The RINO McCain wanted to do the same thing. It is in Obama's nature to close Gitmo. McCain has no excuse.

Ried is just looking at polls for his next run. He does not believe one way or another. He just believes in winning elections. Sacrificing a few Americans along the way is an acceptable loss.

I would be concerned about organizing or recruiting, but maybe I'm just being too cautious. I think once someone imposes on others rights they then forfeit certain rights.

Both parties could stand to lose the arrogant stubborness. Both political parties have had more than enough chances to further their so called agenda's to aid and assist the American people live better lives and both have failed miserably at it. You don't have Senators in office for 30 years and have them claim that they still didn't get this or that program passed so they need another 6 year term.
Term limits for congress would go a long way towards solving a lot of problems that we face today. People in office for as long as we have had them in office only get corrupted by the power and seek to perpetuate their legacies by first and foremost working to get re-elected.
Their caring for the common working class American lies a distant 4th, 5th or 6th on their to do list. We, as caring American voters need to galvanize ourselves together and quit the partisan bickering that has been set as a standard by our elected officials and unite to throw these incumbents out of office in the 2010 mid term elections.

Nancy P caught in an out right lie........... by her own party. (slammed by the Obama CIA!) I heard that every time she lies her eye get bigger....­..........
The republicans have a very good shot at Harry's, Dodd's, and Spector's seats. ( going for the big guns!) and Nancy is more than likely out. (badly hurt at a minimum.)

This is a classic misconception about President Bush. As far as him being extremely far right I don't think there could be a more inaccurate description for the way he governed.
He only vetoed two bill from Congress in his 8 years in office, he spent us into such a deep hole that he was more fiscally liberal than most of his predecessors, not his successor though, and he allowed extremely rigid regulations to be put on busines and industry.
He was not conservative and surely not extremely far right. He may become, judged by history, more liberal than President Obama.
President Obama will be forced to become one of the most conservative members of his party if my predictions about how things fall out are even half true.
