I Like ItI Don’t Like It

AP: WASHINGTON — President Barack Obama expressed confidence Saturday that efforts to scuttle Sonia Sotomayor's nomination to the Supreme Court will fail despite intensified scrutiny of her judicial career. He said senators should work quickly to elevate the federal appeals judge.

"I am certain that she is the right choice," the president said in his weekly radio and Internet address in which he scolded critics who he said were trying to distort her record and past statements. Those include her 2001 comment that a female Hispanic judge would often reach a better decision than a white male judge.

With the Senate returning this coming week from its holiday break, Obama said he hopes it begins the confirmation process without delay. He said he expects his nominee to be on the bench when the Supreme Court begins its new term in October.

In the interim, Obama said he expects "rigorous evaluation" of his nominee but added: "What I hope is that we can avoid the political posturing and ideological brinksmanship that has bogged down this process, and Congress, in the past."

He derided "some in Washington who are attempting to draw old battle lines and playing the usual political games, pulling a few comments out of context to paint a distorted picture of Judge Sotomayor's record."

"But I am confident that these efforts will fail," Obama added, "because Judge Sotomayor's 17-year record on the bench _ hundreds of judicial decisions that every American can read for him or herself _ speak far louder than any attack; her record makes clear that she is fair, unbiased and dedicated to the rule of law."

On Friday, Obama personally sought to deflect criticism about Sotomayor's comment in a 2001 lecture that "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

The quote in question from Sotomayor has emerged as a rallying call for conservative critics who fear she will offer opinions from the bench based less on the rule of law and more on her life experience, ethnicity and gender. That issue is likely to play a central role in her Senate confirmation process.

"I'm sure she would have restated it," Obama told NBC News, without indicating how he knew that.

Obama also defended his nominee, saying her message was on target even if her exact wording was not.

"I think that when she's appearing before the Senate committee, in her confirmation process, I think all this nonsense that is being spewed out will be revealed for what it is," Obama said in the broadcast interview, clearly aware of how ethnicity and gender issues are taking hold in the debate.

A veteran federal judge, Sotomayor is poised to be the first Hispanic, and the third woman, to serve on the Supreme Court She appears headed for confirmation, needing a majority vote in a Senate, where Democrats have 59 votes. But White House officials also want a smooth confirmation, not one that bogs down them or their nominee.

As a senator, Obama supported a failed attempt by Democrats to stall President George W. Bush's nomination of Samuel Alito to the high court.

Sonia Sotomayor is not the wonderful progressive everybody seems to think she is. I'm on The Bazelon Center for Mental Health Law's email list, and they sent me a PDF detailing some of her past cases. One was the case of a woman with Down's Syndrome who the police took from her home and forced into a mental institution, where she was forcibly drugged. Sotomayor ruled that what they did to her was "not unconstitutional". After reading that, I understood that Sotomayor is completely worthless to me--as a Supreme Court judge, she is not going to protect my rights.

You might be right. But, the way it works is that the Appellate Ct Justices are bound by the case law of their appellate district. I don't know about this particular case. But, if her decision was so bad why hasn't it come in front of the Supreme Ct? That would be the next step. Sotomayor has written a decision in hundreds of cases and has been overturned three times, and all three times she was in the majority opinion.

The legislature makes the law and the judicial branch interprets it. Sometimes they have no choice but to go with what has been determined to be the rule of law in a particular district. If that same case came before the SC, Sotomayor may even rule differently.

I urge all republicans to continue the attack on Ms Sotomayor and maybe even toss in a few racial slurs about hispanics while you are at it. That way, in upcoming elections the GOP can count on getting, oh, say 50 hispanic votes nationwide and not many more from women voters. Watching the GOP shrink into a slightly less offensive version of the KKK and then into obscurity is the sweetest thing of all...keep at her, guys, dont stop now!!

Many Americans stepped into a new mindset with a leap of faith in electing Obama. In the process, we learned that we can change the world for the better. It is refreshing to see an American President working in this way to help us live up to the promise that is America. Her nomination, and appointment, will be a victory for America; for that idea, that promise that is America.

The Sotomayor nomination also shows us that there is still a lot of Americans suffering from fear and uncertainty. Perhaps more importantly, there are still elements in our society who will attempt to translate that fear into hate, prejudice and bigotry for political gain. The most instructive aspect of this response is that her credentials and her life story speak for themselves--as does their misguided attempts to discredit her. We are better than that.

We, as a country, are learning to do the work, to evaluate the complete person. We no longer have a mindset that allows an exemplary career of sacrifice and distinction to be undermined by an errant ambiguous phrase taken out of context. No longer can anyone--not even elected officials--tell us who to hate on such a weak platform. Americans susceptible to this type of sound byte manipulation has diminished to the point where those that attempt it, diminish their own political viability and suffer the karmic shame and disgrace of their own actions. This is indeed both illuminating and refreshing. Well done.

There should be an age limit on Justices. Seating someone for life? How ridiculous. The older and sicker they get, the more out of touch they are with mainstream America. No one deserves to be handed a job of such importance for life. It has to affect their decision making process to seem infallible because no one can fire them or run against them. The rules must change.

Maybe, but it's about the balance of power between the three branches of government. Many in the legislature have what turns out to be a lifelong job. They do get voted on at regular intervals, but it's not easy to beat an encumbant.

There is a good balance on the Court. Of course, I don't agree with much that Scalia, Roberts, Alio, and Thomas have to say, but they are balanced by the more moderate and liberal judges.

Problem is... how can her record be distorted by everyone, when everyone has already reviewed exactly what she said and are commenting on her exact words?

People are not looking at her record or even the statement made in context.

Here's the President on her record: "Judge Sotomayor’s career began when she served as an Assistant District Attorney in New York, prosecuting violent crimes in America’s largest city. After leaving the DA’s office, she became a litigator, representing clients in complex international legal disputes. She was appointed to the U.S. District Court, serving six years as a trial judge where she presided over hundreds of cases. And most recently, she has spent eleven years on the U.S. Court of Appeals, our nation’s second highest court, grappling with some of the most difficult constitutional and legal issues we face as a nation. She has more experience on the federal bench than any incoming Supreme Court Justice in the past 100 years. Quite simply, Judge Sotomayor has a deep familiarity with our judicial system from almost every angle."

Add that she graduated at the top of her class at both Princeton and Yale and she seems to have a broad range of achievement and experience. If she's not qualified to serve, I am not sure who is.

Sorry folks, there is something weird about his pick for SCOTUS. She has no business going anywhere near that court.

You ignore her qualifications. A person this qualified needs to be on the US Supreme Court.

Logic is something Republicans are lacking these days.

No matter what the truth is they imagine that their small world is everything.

Only mean spirited Republicans could turn a fine word like "empathy" into hate speech. But, demonizing everyone they disagree with has been their modus operandi ever since Joe McCarthy. Old dogs seldom learn new tricks.

The Republicans have labored to turn "elite" into a pejorative.

I always thought something elite was good, e.g., America's elite fighting forces.

It's a shame he has to dignify v*ermin like Beck, Rash on my Limpbone, and Tom Tancredo to begin w/ but, yet again, his hand is somewhat forced by the shrillness of it all. It's also a shame that the brilliance and wonder of a nomination that will, most certainly, lead to a great Justice, is diminished by all the periphery goings-on. What the aforementioned swine are doing, of course, is "umpire baiting"; that is, raise such an unwarranted ruckus well in advance in hope that the nominee, once confirmed and on the court, will be jaded from the experience and tend to lean more to the right in difference to her pundits. Of course, I'm confident that won't happen.

Republicans on the exteme right are trying to undermine all government institutions so they can justify treason and sedition, the Presidency, the congress, now the courts. They want to set up another secessionist war. Gingrich, Liddy, Hannity, et al are determined to fight for "white male supremacy" in the USA in this generation and make it easier for successive generations to do the same as North America becomes more and more brown, and women accomplish full equality.

They do want to undermine our government and court, but they themselves do not want to fight. They want to convince the ignorant and undereducated to fight for them. The republicans who are out front are all cowards, never having served in the military.

If they want to fight, they should realize that minorities are not going to be sitting around, like the in the past, to be slaughtered and tortured.
