COLUMBIA, S.C. — South Carolina's Supreme Court ordered Gov. Mark Sanford on Thursday to request $700 million in federal stimulus money aimed primarily at struggling schools, ending months of wrangling with legislators who accused him of playing politics with people's lives.

The nation's most vocal anti-bailout governor had refused to take the money designated for the state over the next two years, facing down protesters and legislators who passed a budget requiring him to. While other Republican governors had taken issue with requesting money from the $787 billion federal stimulus package, Sanford was the first to defend in court his desire to reject the money.

But he said Thursday he will not appeal the Supreme Court ruling and plans to sign paperwork to request the money Monday.

Educators quickly hailed the court decision. They had predicted hundreds of teachers would lose jobs and colleges would see steep tuition increases without the money, though sharp budget cuts will still take a toll.

"Finally. It took way too long. It was so unnecessary and took so long to do what 49 other states figured out how to do a long time ago, but finally is better than not at all. It will allow districts to immediately begin to reconstitute programs and fill positions they didn't think they could fill," state Education Superintendent Jim Rex said.

While Sanford raised the issue, it was Casey Edwards, a Chapin High School student graduating Friday, who brought it to the state's highest court. She beamed as she told reporters she "was very excited that our schools and our teachers and our education system will be getting the funds that are so desperately needed here in South Carolina."

The stimulus fight has raised the national profile of Sanford, the chairman of the Republican Governors Association, and provoked talk of a 2012 GOP presidential bid. But at home, the episode became a power struggle between Sanford and the Republican-dominated Legislature.

The former congressman objected to the stimulus money on several levels that were consistent with his small government, anti-spending stances. He claims it will devalue the dollar and increase debt. When legislators pushed for the cash, Sanford said they were overstepping their reach into his executive powers.

The unanimous court ruling said the governor had no say in the matter.

"At this stage in the process, the Governor certainly has no discretion to make a contradictory decision on behalf of the State," the ruling said. "He has no discretion concerning the appropriation of funds."

Sanford on Thursday lamented what he said was a decision that underscores how the little power governors of the state have is ceded to the Legislature.

"In South Carolina, in many ways, we don't have three branches of government. We have only one," he said. "If you put too much power in one place, not many good things happen."

The Supreme Court's ruling came a day after arguments in two lawsuits filed by students and school administrators. Sanford had tried to get those cases merged in federal court with his lawsuit against the state, which he filed moments after legislators overrode his budget veto. But he lost that battle Monday when a federal judge refused to take those cases.

Sanford had refused to request the $700 million _ the portion of the $2.8 billion bound for the state that he says he controls _ unless legislators agreed to offset state debt by an equal amount. The White House twice rejected that idea, noting the money must be used to help education and avoid job losses.

South Carolina, which had the nation's third-highest jobless rate in April _ hitting a state record high of 11.5 percent _ cut more than $1 billion from its $7 billion spending plan for 2008-09 as tax revenues slumped in the recession.

Sanford's refusal has raised the ire of U.S. Rep. Jim Clyburn, the No. 3 House Democrat, who accused the governor of being a foe of public education. Amid budget cuts and uncertainty over the federal money, districts had told hundreds of teachers they don't have a job in the upcoming school year.

State education officials estimated schools would eliminate 2,600 education jobs, including 1,500 teachers, without the stimulus money.

Clyburn, D-S.C., inserted an amendment in the federal law with Sanford's anti-bailout stance in mind, saying legislators could go around a governor's refusal. While the legality of that was questioned, U.S. District Judge Joseph Anderson on Monday cited it in saying it was clear Congress intended to allow legislators to get around governors who didn't want the money.

Here is an apt visual of the repubs and their effect on our nation.

Picture a bed of ants. Along comes Obama. He steps on the ant bed and the kooks are forced to scatter. The kooks scamper out of the bed, biting anything that comes their way. Obama poured poison (a real fiscal plan that seems to be working) on the bed. The kooks have to set up shop in new places, find a new queen (leader), and keep showing their prowess. But, the Obama poison
is working so well that all the kooks' efforts are frustrating them because they can not rebuild the bed like it was. The ants just bite any and everything they can.

Uh, folks, NORTH and SOUTH Carolina are two different states. There are several comments about NORTH Carolina. This happened in SOUTH Carolina. NORTH Carolina's governor is a Democrat. Just FYI from a South Carolinian & Wake Forest grad (meaning, I've lived in both states).

Sorry about that...but the point was that many states, even with the stimulus package, are still having difficulty due to the shortfall of taxes. The point is that taxes will go up because the unemployed don't pay taxes and the stimulus package is really not enough to resolve the problem states face in their upcoming fiscal budgets.

I don't believe that was Sanford's reasoning. He has been working his entire political career to shrink government and undermine public schools. This was another method by which he could do both. I am a state employee in SC and the budget cuts we were already dealing with, thanks to Sanford's property tax "reform" (aka eliminating too many taxes such that there was no revenue for government and school districts) were horrendous. Sanford is a rich kid who's never lived any sort of normal life, never attended public school or had to worry about anything financial. Most South Carolinians are horrified to think of him on the national stage, as his popularity here is low. The bloom is off the rose for those who voted for him. The fact that our Republican legislature overturned his veto on the stimulus money should tell you something.

The people of South Carolina are American citizens. They pay taxes to Washington. When Washington votes money for South Carolina schools that money belongs to the people whether or not the subsidy is misguided. Mark Sanford, for personal and political reasons, tried to deny his own people what was rightfully theirs. He stubbornly refused to listen to reason until finally his own Supreme Court FORCED him to back off. Fine. Now he has established that he is cruel and unreasonable and is thus qualified to run for higher office as a Republican.

What is wrong with, in particular, the southern states populations? They elect some of the most over the top, repugnant, and backward men by and large. I cant decide if it sun stroke from to much sun or maybe heat stroke from the heat/humidity but damn they pick some obnoxious people for office

What will the the people of NC do next year when they don't have the money to sustain this kind of spending and people are faced with losing jobs and the State is forced into cutting things they were going to this year. This money just stalls the inevitable. I hope that the folks who saw their jobs saved start looking at next year and making plans. The Federal Government (you and I) cannot keep spending money we don't have and there will come a time when we completely collapse as a Nation. The Federal Government needs to get out of way and allow the States to make the hard choices that need to be made. The taxpayers cannot afford to bail out the States as almost all are on the brink of going bankrupt.

I kind of agree with you on the affordability of the stimulus package. I think what we're seeing here is beginning of the end and it goes back to Reaganomics - i.e. the trickle down theory.

Our government, over the years, has allowed corporations to export jobs overseas. This has eroded the middle class and the taxes that they pay. It has devastated the middle class so much that when the housing, banks and Wall Street debacle hit us, it put a lot of people out of work.

While the bank and Wall Street bailouts have prevented a devastating Depression, I believe that this will only be a temporary solution to the country's financial woes because when the interest on these bailouts come due, there will be nobody working to pay them. There will be an increase in taxes which will further devastate the economy. It's a vicious circle that will only lead to national bankruptcy.

This is why I think a Depression is around the corner with higher unemployment and unimaginable inflation on market goods. Add to that the price of fuel and you hammer the last nail in the coffin.

If this happens, it won't be President Obama's fault because of events that occurred before he was elected President. It's just that our failing economy will catch up from poor economic policy decisions from previous administrations.

The North Carolina legislature is already contemplating an increase in taxes to make up for shortfalls in public education. Many school employees received their pink slips last week. They're laying off first year teachers, teacher assistants, administrative employees and assistant principals. Classes will expand to more than 40 students per class.

The greatest irony is that "state's rights" Sanford wanted to have this issue adjudicated in federal courts rather than the courts of our state. That is clearly a form of hypocrisy for someone who doesn't want the feds meddling in state affairs. But in the tradition of SC which in the antebellum years wanted the federal government to squash abolitionists while letting southerners expand slavery everywhere.

The court is wrong. Governor Sanford is right. Stimulus money has to be borrowed, but the interest can never be borrowed. Therefore, the only money in circulation is debt money, which has to be repaid with interest, and the interest wasn't printed. It is another form of self-destruction for us, and the US.

The money that went into funding a war of choice had to be borrowed as well. Sometimes it's not the fact that you SPEND money that is detrimental, it is what you spend the money on that is. The stimulus spending, well , some of it is going to create some jobs for americans. Building highways, and funding alternative sources of energy,will definately creat some jobs. I don't think any economist will say that more Americans working is going to hurt the economy. Except for the ones bought and paid for by the right wing. The stimulous is more of an investment in the American People. Wars of choice and the creation of a police state are investments in fascism.

Sanford may have lost the battle, but South Carolina loses. The state's finances will be long-term worse off. The state will lose some autonomy. The big boot of the federal government will be on South Carolina's neck for the foreseeable future.
