Dropping in at 615 pages is the Senate Health, Education, Labor and Pensions Committee's attempt to fix the broken health care system. The HELP Committee is chaired by Sen. Ted Kennedy (D-Mass.). The second-ranking Democrat, Sen. Chris Dodd of Connecticut, had a large hand in drafting the bill as well, given Kennedy's absence from the committee while he battles brain cancer.

The bill can be read here. A HELP Committee aide cautioned that the bill is not in its final form and that part of the reason for filing it is to meet a committee rule that requires a bill to be filed seven days before a vote can be held.

Committee Democrats will be meeting with their Republican counterparts Wednesday and Thursday to hash out the bill's details.

"On the legislation we'll introduce later today, there are some gaps in it and done so intentionally," said Dodd at a press conference earlier Tuesday. "There are no gaps in our determination, in my determination and that of my colleagues to have a public option, to have something done with the pay or play and deal with the follow on biologics. But I left those areas open for discussion, not because they're open for some sort of decision about whether or not we ought to move in that direction. But I want my Republican colleagues to know, I want their ideas, I want to hear what they have to say. This is a bill, it's an opening step."

Kennedy's bill will get its first hearing on Thursday and is scheduled for a committee vote on Tuesday, June 16th.

Sen. Max Baucus (D-Mont.), chairman of the Senate Finance Committee, said Tuesday that a committee vote on a health care bill could come as early as the week after next. The battle over the future of health care in America now enters a span of several months as important as any in a generation.

Below is a statement released by Kennedy and further down is the health care bill itself.

For the past year, Chairman Edward M. Kennedy and Democratic Members and staff of the Senate Committee on Health, Education, Labor and Pensions (HELP) have been working to develop legislation that reduces health care costs, allows Americans to keep the coverage they have if they want it, and makes health insurance affordable to those who do not have it today.

Today, while discussions between HELP Committee Democrats and Republicans on key outstanding issues continue, Chairman Kennedy released the landmark "Affordable Health Choices Act." Click here for a copy of the bill, http://help.senate.gov/BAI09A84_xml.pdf.

"Our health care system is a crisis for American families and President Obama and members of Congress of both parties recognize the urgency of the problem. Our goal is to strengthen what works and fix what doesn't. Over the next few days, we will continue working with our Republican colleagues on common sense solutions that reduce skyrocketing health care costs, assure quality care for all and provide affordable health insurance choices. Much work remains, and the coming days and weeks won't be easy. But we have a unique opportunity to give the American people, at long last, the health care they need and deserve," said Senator Kennedy.

Earlier this year, Kennedy and Senator Max Baucus, Chairman of the Finance Committee, which shares jurisdiction of health care reform with HELP, established a joint process that will lead to complementary legislation being marked-up in June and on the Senate floor by July. The HELP Committee is on track to meet that goal. On Wednesday, June 10 and Thursday, June 11, Democrats and Republicans on the Committee will meet to discuss outstanding legislative options such as the public option and employer mandate.

A public hearing is scheduled for Thursday, June 11 at 3 p.m. in Dirksen 430. Mark-up will begin Tuesday, June 16 at 2:30 p.m. in Russell 325.

Last year, Kennedy asked Senator Christopher J. Dodd, vice chair of the HELP Committee, to be his chief deputy on health reform to help lead the overall effort. In addition, Senators Tom Harkin, Barbara A. Mikulski, Jeff Bingaman and Patty Murray have also assumed leadership roles on key aspects of reform within the Committee. Since January, the Committee has held over a dozen public hearings on improving the quality of care, prevention and wellness, and expanding insurance coverage.

"Health care reform cannot and must not wait. Today, we will introduce legislation that will strengthen what works and fix what doesn't. If you like the insurance you have today, you can keep it. If you don't like what you have today, we'll give you better choices, including a public option for health care. This does not symbolize the end of the game or even the end of the first quarter. We still have a lot of work ahead of us and are looking forward to working with our colleagues on a bipartisan basis to resolve the remaining issues and move forward with a mark-up of this legislation next week," Senator Dodd said.

"All stakeholders in the health reform debate agree one of the keys to reining in the rising costs of health care in this country is to reduce chronic disease. Data shows that with an investment of $10 per person per year, community prevention programs could yield net savings of more than $18 billion annually within 10 to 20 years," said Senator Harkin. "This reform provides one of the largest investments in prevention and wellness initiatives, offering choices throughout the health care system. At the federal level, it creates a new inter-agency council to develop a national health strategy and a dedicated funding stream to support these efforts; at the clinical level, it provides coverage of preventive services and the elimination of co-pays and deductibles for these services; and at the grassroots level offers grants for community initiatives. It short, it realigns incentives to make it easier to be healthy and removes the barriers to preventive services like screenings for diabetes, depression, tobacco cessation, and nutrition counseling - to name just a few."

"We can't fix the economy without fixing health care so families can afford it and businesses can afford it. We can't afford not to fix health care," said Senator Mikulski, who was asked by Chairman Kennedy to lead the Senate effort on improving health care quality. "A national health care quality strategy will provide solutions to the biggest problems - medical errors, preventable hospital readmissions and failure to manage chronic disease - that severely impact people, their lives, their checkbooks and national health care costs. Emphasizing quality improves lives, saves lives and helps pay for reform by saving money."

"This bill introduction marks a very important step toward fixing our nation's broken health care system. As we continue developing this measure in the coming days and weeks, our primary goal will be to ensure that all Americans have access to affordable and quality health care," Senator Bingaman said.

"Our health care reform bill is a step toward ensuring all Americans can see a doctor when they need one and that our long term economic strength is not held captive by the skyrocketing cost of care," Senator Murray said. "I applaud my colleagues for the hours of work they have all put in and thank Senators Kennedy and Dodd for their leadership in moving this forward. I am particularly proud that as we work to offer quality, affordable coverage to all Americans that we have included a plan to ensure we have enough health care professionals to provide that care. We still have work to do, but this bill is a good step forward on protecting patient choice, lowering costs and providing coverage for the millions of Americans who currently have none."

A Quick Summary of the Affordable Health Choices Act

Senator Edward M. Kennedy, Chairman of the Health, Education, Labor and Pensions Committee (HELP), today released The Affordable Health Choices Act, legislation that aims to reduce health care costs, protect individuals' choices of doctors, hospitals and insurance plans and guarantee, quality and affordable health care for all Americans.

The Affordable Health Choices Act includes the following five major elements:

CHOICE: An important foundation of The Affordable Health Choices Act is the following principle: If you like the coverage you have now, you keep it. But if you don't have health insurance or don't like the insurance you have, our bill will give you new, more affordable options.

COST REDUCTION: The Affordable Health Choices Act will reduce health care costs through stronger prevention, better quality of care and use of information technology. It will also root out fraud and abuse and reduce unnecessary procedures.

PREVENTION: The best way to treat a disease is to prevent it from ever striking, which is exactly why The Affordable Health Choices Act will give citizens the information they need to take charge of their own health. The bill will make information widely available in medical settings, schools and communities. It will also promote early screening for heart disease, cancer and depression and give citizens more information on healthy nutrition and the dangers of smoking.

HEALTH SYSTEM MODERNIZATION: The Affordable Health Choices Act will take strong steps to see that America has a 21st-century workforce for a modern and responsive healthcare system. America must make sound investments in training the doctors, nurses, and other health professionals who will serve the needs of patients in the years to come. It will make sure that patients' care is better coordinated so they see the right doctors, nurses and other health practitioners to address their individual health needs.

LONG TERM CARE AND SERVICES: The Affordable Health Choices Act will also make it possible for the elderly and disabled to live at home and function independently. It will help them afford to put ramps in their homes, pay someone to check in on them regularly, or any of an array of supports that will enable them to stay in their communities instead of in nursing homes.

After a great deal of reading, what this bill will offer among other things is an "Affordable Health Benefit Gateway". This "Gateway" is each state and "facilitates the purchase of health insurance coverage and related insurance products at an affordable price by qualified individuals and qualified employer groups". Your state (through Grant requests) will have the option of choosing whether to be involved and provide a state health insurance program.

This is no where near a Single Payer Health Insurance program.

'Single payer' certainly makes sense in theory, but the sad fact is that the Brits view their system very much as we do the DMV, so anyone who can afford it opts for private care rather than waiting anything up to 9 months to see some random specialist. Yet having scores of for-profit insurance companies running the show -- wonderful as the care is if you can afford a deluxe plan -- has generally proven to be even more of a disaster, so I'd propose taking the best of both.

First, by scrapping the cobbled-together mess we have now, and then asking the one company that consistently gets high marks from both patients and doctors -- Kaiser Permanente -- to design and implement a universal health care system, since they already have all the mechanisms in place around the country, and humming nicely. Payment would be made, as now, by either individuals or businesses -- but would obviously have to be mandatory to both protect us from ourselves, and to keep premiums as low as possible -- with, and here's where it gets real tricky and contentious, the Government helping to subsidize those that can't afford it through a small 'health tax' on not only the usual suspects, like alcohol, but also on some unusual ones, like, say, junk food, fast cars, guns and cosmetic surgery. Yes, only the Amish would be spared! But that's surely better than going bankrupt or losing a loved one for lack of regular check-ups,

If we are going to keep the insurance companies in the mix the government should take on catastrophic illness and injury. This would take the most expensive costs off the insurance companies so that the burden can be taken off employers and people wouldn't feel blackmailed into buying a "one size fits all" plan that they have no intention of utilizing. Many may even opt out of additional insurance altogether if they knew they had the big risks covered. Eventually the insurance companies would morph into providing "Cadillac" services for the higher end customer.

The large majority of people don't like going to the doctor and will avoid it if possible. Part of the government plan could also require simple check ups and lifestyle audits to keep people from self destructing and overloading the catastrophic protections.

When the doctors see patients who are paying $1000 pr month for their health care coverage and they do the math they would naturally want to get a better slot at the trough. They know that the premiums aren't going down no matter what they do. This is why insurance companies went to giving "in network" physicians preference. The big companies can make or break a doctor or clinic by forcing larger co-pays on patients who choose doctors that won't play ball with the insurance companies.

When my wife first got sick she was diagnosed with simple diabetes even though she had a familial history of pancreatic cancer and her weight loss red flagged the easy diagnosis. I had to pay for the testing to find her cancer. The doctor did attempt to push an anti-depressant on her though, which would have placed her case into the less expensive (for the insurance company) category of mental illness.

This always happens after republicans run up the deficit! They scream that the deficits they ran up are too high, so democrats can't do the work that the people want them to do!

Health care reform is going to go through -- deal with it! Taxes will be raised on corporations and the wealthy -- not just the Bush tax cuts will be repealed -- the Reagan tax cuts will be rescinded! Then we can all go back to a fairer distribution of the wealth, rather than the redistribution of wealth to 5% of the population!

That's how we're going to deal with it! Most of us would gladly pay higher taxes if it meant that we'd all have insurance that is better than what we have now and cheaper than what we have now!

I am trying out a new tinfoil hat today. I seriously question the entire validity of the "crisis" in the banking sector. I don't forward this as gospel, but I wonder if Wall St and Paulson didn't see the writing on the wall prior to the election and took the money and ran, effectively crippling the Democrat agenda. In one two hour period in mid 08 a run on the treasury siphoned $550 billion in transfers before the Fed stopped it. The only place it saw any daylight of public knowledge was a blurb on C-span. Some have said that most of that ended up in Israel.

Republicans know that if America gets single payer health care that it will be over for conservatives. Look how untouchable Social Security and Medicare have become politically. How could they ever take back people's health care once it began working? The GOP warned their representatives two years ago that they had better begin formulating a public health care policy that they could live with because it was going to happen anyway. With the turns that the election took, there was no way McCain could suggest anything less than extreme right positions.

On page 39, it states that the American people deserve the same coverage as the Congress. Read through it. It's very good!

And no where in this bill does it say they get to pick and choose -- that's a Rush talking point that you've bought from the insurance companies! Why do you think insurance is fighting so hard against the public option? It's not because they fight for the people. They don't want to lose their $$$$$$$$$$$$! when their CEO's are making billions, do you really think the insurance companies have the people's interest at heart? They've hired people to tell you that this will take away our choice -- and you bought it!

"the same coverage as the congress" means gold standard coverage THAT SOMEONE ELSE PAYS FOR. We're not going to get that and they have no intention of offering it.

The plan is 600 pages because they have to at least pretend to correct all the problems caused by selling out to the health insurance industry and not going with single payer.

We're screwed.

I doubt that you are aware of the language in the Health Care Reform Bill just released. It has dire consequences for the LGBT community and their families. Because DOMA precludes any legal recognition of our relationships (even when legally married, partnered or civlized in our home states) at the federal level, we are once again literally screwed. We need to get this out to the community before we blindly follow our leaders into the abyss. Read paragraph (b) of this section and you can see the nightmare this will cause LGBT families as long as DOMA exists. Nanyc Pelosi needs to get DOMA on the agenda and out of our lives once and for all.

SEC. 2709. EXTENSION OF DEPENDENT COVERAGE.
(a) IN GENERAL.—A group health plan and a health insurance issuer offering group or individual health insurance coverage that provides dependant coverage of children shall make available such coverage for children who
are not more than 26 years of age.

(b) REGULATIONS.—The Secretary shall promulgate regulations to define the scope of the dependants to which coverage shall be made available under subsection (a).

It would be a waste. They fought long and hard over the years to keep this country away from
socialist healthcare. They may throw us a few bennies. Obama promised us the same healthcare
and it did not go through, I am holding his feet to the fire here, he reneged on just about anything.
I realize, he alone can't do anything but it is high time we vote all of congress out of office, all of them,
regardless of party affiliation, there seems to be one party, the party of taking care of themselves.

SIGN THE PETITION

Give America a choice. We support healthcare reform that allows individual Americans to choose either a universally available public healthcare option like Medicare or for-profit private insurance. A public option is the only way to guarantee healthcare for all Americans and its inclusion is non- negotiable.

Any legislation without the choice of a public option is only insurance reform and not the healthcare reform America needs.

The AP summarizes Kennedy's Plan.

This "healthcare reform plan" provides private insurers with more products to sell, calling one a "federal plan", because it is modeled after Congress's plan, and calling another one a "public plan" because you purchase through a government brokers. There will be a mandate and a fine if you do not cover yourself with health insurance. If you cannot afford to, you will have to proove it and the govt will decide if you are able to afford it or not. "Choice" they defined as choosing among all of these 3rd party payor plans, just like what we have now. Everything else: gimmicks and come ons; provision for long term care for seniors is $50 a month for at home care....that is one week of 4 hour a day care for a sitter/homemaker to help a senior who is disabled....for $65 a month premium and only if you pay for it for 5 years, which excludes current seniors. Extend the kids to age 26yrs; no pre existing exclusions and no lifetime or annual limits, which should have been outlawed long ago; don't need "healthcare reform" for that if someone really cared enough to do it. It is another Medicare Plan D ripoff. We will be in the same situation we are in now but the insurance industry has another one or two products to market. It will pass because Kennedy is dying and he has a false reputation of "fighting for health care".
