Attorney General Eric Holder restated his intention on Wednesday to release a comprehensive report, declassified to the fullest extent, on the legal advice provided by the Bush administration in its authorization of enhanced interrogation techniques.

Speaking before the Senate Judiciary Committee, Holder said that delays in releasing the findings of the Office of Professional Responsibility's (OPR) investigation into former President George W. Bush's Office of Legal Counsel (OLC) was the result of administrative obstacles and not political foot-dragging or objections from the CIA

"No it is not," he said, when asked if CIA interference was a factor in delaying the publication of the OPR report.

"It is our hope to release as complete a report as we can," Holder said. "And one of the things that I think we want to do is declassify as much of this report as we can so that when people read it... they will have a full feeling for what it is, how the lawyers in the OPR dealt with (the investigation) and what is the basis of the conclusions that they reached."

Holder's remarks came in response to questioning from Rhode Island Democrat Sen. Sheldon Whitehouse, who noted that the Senate had been told more than a year ago of a pending investigation into the legal rational used by the Bush administration lawyers.

The Attorney General's testimony came on the same morning that the Washington Post reported that the CIA was pushing the Obama White House to suppress key findings of a separate report by the agency's own inspector general. That report is believe to show that the torture of terrorism suspects had not yielded strong or operational information.

Whitehouse pressed repeatedly as to whether in the case of the OPR report, the CIA was trying to influence the study's findings. Noting that the agency had a role in reviewing the report and advocated keeping some of the findings classified, the senator asked Holder what kind of assurances he had received that those agency officials, who might be implicated, were not influencing the process.

"I don't think we have gotten anything yet from the CIA," responded Holder, "at least nothing I'm aware of with regard to what their position is concerning the declassification issue.... This may be not an issue at all. And to the extent that it is an issue, I will interact with [CIA] Director [Leon] Panetta and raise the questions that you raised in addition to our general feeling that we want to have as much as this declassified as we can."

Several hours before Holder testified, a group of human rights and civil liberty organizations released a letter to the Attorney General calling on his office to release the OPR report quickly.

"We welcomed your decision to release several OLC memoranda that authorized the use of abusive and illegal interrogation techniques such as waterboarding, forced nakedness, stress positions, and exposure to frigid temperatures," read the letter, signed by the American Civil Liberties Union, Amnesty International, the Brennan Center for Justice, and others. "But within the four corners of these legal documents is only a small part of the picture," the letter stated. "By releasing the OPR report, you will demonstrate the administration's continuing commitment to transparency and openness. You will also help strengthen a proper understanding of the important role played by government lawyers serving the United States."

I generally appreciate Senator Whitehouse's comments and perspective, but from my reading (especially "Chain of Command" by Seymour Hersh and to a lesser extent "Angler" by Barton Gellman) of the torture program and for that matter the faking of the evidence of Iraq WMD and Iraq/Qaida ties, I don't understand his suspicion of CIA in this context. I'm suspicious of the Agency's existence and whether it is a net benefit to foreign relations, but in the war crimes currently in question, it seems very clear that the pressure came from the White House and mostly the Vice President, and any CIA wrongdoing was at the level of former directors Tenet and Hayden, and perhaps their first tier of underlings. Maybe Senator Sheldon Whitehouse just wants to confirm that Attorney General Holder is finding evidence supporting the same conclusion, that the CIA was not the source of the problem?

It's not just Holder, they may call themselves one thing, or another, but their all politicians and that goes for Bush and Obama teams. They will take care of each other and they could care less for the people. Believe me, nothing will come of this or anything else when it comes to our so called government.

One point that needs to be made clearly is that if the USA does not choose to prosecute suspected war crimes, then morally and legally it becomes imperative for some other signatory nation to the international treaties against war crimes TO prosecute.

I can't see the English quibbling over the niceties or the political feasibility of indicting an American ex-official. I think they'd be on it like a duck on a June bug. I think Denmark, Sweden, Spain, and a few others would go for it too.

If the US economy totally collapses and the CIA is disbanded, it is possible US gov't officials will face trials in other nations.

But, that is highly unlikely.

I also suspect that those other gov't's politicians are equally guilty and they want nothing to do with any trials. The US had lots of help, much of which was from Great Britain and European nations. All of whom are equally guilty. War crimes is an international crime.

The DOJ is still full of lawyers acceptable to Karl Rove (ie the ones he didn't feel the need to get fired). You suppose they have anything to do with "administrative obstacles?" When is Holder going to clean this cesspool out? And don't tell me about only being there for a couple of months. They should have been fired on Day One.

I have yet to see the US government actually investigate corruption on a large scale, such as occurred during the Bush administration.

Individuals, yes; the entire government. no. But, even that is limited to minor flunkies such as those poor saps at Abu Ghraib prosecuted for following orders from the White House.

Bush's co-conspirators to commit mulitiple crimes extended far beyond the White House or US shores.

There will be no serious investigation.

Otherwise, Nancy Pelosi & Harry Reid would probably be facing war crimes charges, along with the majority of Congress, maybe the entire GOP.

You mean like the "serious investigation" of the JFK assassination that concluded a man did the impossible? And, failed to investigate the number one suspect, Israel?

You mean a "serious investigation" such as occurred during the Reagan presidency when he was violating all kinds of laws that led nowhere?

You mean a "serious investigation" such as the 9/11/01 "investigation" that apparently based its findings on whatever the White House claimed and concluded that the FBI & CIA were totally at fault but only because Congress failed to let them freely spy on Americans. And needed more money. So, Congress gave them both.

I've been around way too long to believe the US government is capable of investigating itself. When it finds wrong doing, the wrong doers tend to get even more money & authority, so I'd just as soon they not investigate since nothing ever comes of it other than more money & authority to agencies they find corrupt.

There is no doubt war crimes occurred. Torture is a war crime. Anyone in an official gov't capacity who knew about it and did nothing to prevent it is guilty of war crimes, including Harry Reid & Nancy Pelosi. Sitting on your hands is equivalent to approval.

Which is one reason there will be no serious investigation.

Clinton turned over documents on Henry Kissinger's involvement in the Chilean coup to the very same judge.

Henry Kissinger was almost arrested in Paris by French police while on vacation and taken to that Spanish court. Word is now Henry won't step foot out of the U.S. and lives in fear of being tried as a war criminal.

First of all, just in point of fact, an indictment occurs BEFORE the prosecution, not after. So what you meant probably is 'what happens after the investigation is concluded and indictments are issued?"

Well! 1) Cheney, Condi, Rummy and the Keystone Cops that posed as WH legal counsel better have themselves a slew of lawyers who are fluent in Spanish.

2. There will be open hearings, to which Cheney et al will be invited to attend. They will of course demure, being arrogant and therefore in denial.

3. Then, if the trial proceeds, it will enter a period where it will become mandatory for them to attend. If they do not, extradition orders will possibly issued. This is where it gets really interesting because there are all sorts of treaties regarding extradition, and in some instances it will be up to Obama to extradite. I really like thinking about that.

4. From that point on, if it gets to that point, whether they are extradited or not, they would be fools to set foot out of the USA because they could be arrested and taken to Spain against their will. I really like visualising that.

5. If they are tried and found guilty in a foreign criminal court, I don't know if they would serve time there, here or what would happen. All I know is me likey!

Thank you kindly for your correction. Now I will correct your misconceptions regarding any sort of extradition of Bush ,Cheney,et al.... it will never happen. Also,regarding your fantasies of them serving time anywhere....it will never happen.

Mr. Holder, you are the Attorney General of the United States of America, Try acting the part, you work for the American People not yours, nor Obama's self interest, stop playing the Washington cover-up and start doing the work you were hired to do.

Mr. Holder, you took an "Oath to the United States Constitution, not Mr. Obama. If you cannot hold to what you sworn to do then "please step down and walk away, this nation does not need anymore underhanded federal employee's on the payroll of the people. There has been to much "Whitewash of crimes, sweep the dirt under the rug, turn a blind eye, its time to grow up and do your job.

5 months on the job. Have you ANY idea how long a case like this would take to simply be researched and investigated?

Give some credit where credit is due: the Obama administration has very wisely in my opinion let things come out and allowed the persons in question to act out. Cheney basically admitted he knew it was torture. The Zelikow memo is significant as well.

I checked and I didn't see any news item on that. Will continue looking. What did happen in April I believe, is that the Spanish court decided to expand its investigation to included looking at policy makers - Cheney, Condi and Rumsfeld - as well as Bybee, Yoo et al.

This is all that you are going to report from this committee meeting, you are being very incredulous. This buffoon could hardly answer any questions, had no idea about many very important issues (ex: Gitmo prisoners), and when an answer was offered, it was incomplete and uninformed. I expected better from a career politician.
