As California lawmakers tackle their state's $24 billion deficit, one little-known proposal on the table is a $20 million cut to the state crime lab.

That may not sound like much alongside the hundreds of millions in proposed slashes to the state's education, prison and health care systems. But it's half the lab's budget and would likely halt or delay the testing of rape kits, DNA and other crucial crime scene evidence in many counties, law enforcement officials warn.

The $20 million cut was approved by the state's budget committee last week and now goes to the entire legislature for approval. If it is passed, the lab would have to charge law enforcement agencies for tests it has always provided for free, even though many of those agencies are facing budget cuts of their own. Last year, the state lab tested evidence in about 50,000 cases, including more than 1,400 containing DNA.

Advocates for crime victims are urging lawmakers to reject the proposal, because they worry that delays in testing evidence will allow rapists, murderers and other violent criminals to remain on the streets.

"It's a public safety emergency," said Gail Abarbanel, who heads the rape treatment program at the Santa Monica-UCLA Medical Center. "The last thing that should be cut is public safety. I don't know what they're thinking."

Hundreds of police departments and district attorneys' offices in 47 of the state's 58 counties currently rely on the state lab to test their crime scene evidence. The other 11 counties, mostly concentrated in the Los Angeles and San Francisco areas, have their own labs to test forensic evidence.

But many law enforcement agencies in small or rural counties doubt they'll be able to afford the new charges, which are likely to run about $215 an hour. If the agencies can't pay, the lab will have to close some of its branches and lay off some of its scientists, said Jill Spriggs, the lab's bureau chief.

The agencies also could be forced to shelve thousands of DNA samples, bullet casings and other pieces of evidence used to identify violent criminals. There are already more than 350,000 untested DNA samples nationwide, according to federal government statistics.

Ultimately, some police chiefs said they might have to choose: pay to process evidence, or lose more cops on the streets. More than 1,000 police officers were eliminated statewide in the past year.

"I think that most law enforcement agencies would not be in a position to pay those services," said Jerry Dyer, the police chief for the city of Fresno and past president of the California Police Chiefs Association. He estimated that the state lab's assistance to Fresno, which has some facilities of its own but relies on the state to process DNA evidence, amounted to approximately $1 million worth of testing last year.

Joe Grebmeier, a police chief from Greenfield, Calif., said his budget is already so tight that detectives are paying for crime scene supplies, including cameras, out of their own pockets.

"Decisions on how to proceed with investigations will now include, �can we pay for it?'" said Grebmeier. "We might have to go to the public and have a fundraiser just to process a rape case."

Even in Los Angeles County, where the Los Angeles Police Department and the County Sheriff's Department have their own labs, DNA testing is in danger. Since May, the cash-strapped and understaffed Sheriff's office hasn't tested DNA evidence from thousands of rape and sexual assault cases, according to news accounts.

State budget officials acknowledged the danger the cut poses, but said it is needed to keep the state from plunging even deeper into debt.

"We have had to make many difficult decisions to close our budget gap this year," said Noreen Evans (D-Santa Rosa), chair of the Assembly Budget Committee.

Dan Carson, of the state legislative analyst's office, which has recommended cutting the lab's funds for the last few years, agreed that "the easy choices are gone."

But Carson also defended the cuts, saying that it's unfair to allow 47 counties to get free services while others pay for their own crime labs. He said a state law already allows the lab to charge for testing.

"If this is a priority, one would assume they'll work out a way to do it."

But it could take years for a county to build its own lab or secure enough funding to pay the state. In the meantime, police and prosecutors could find it more difficult to send violent criminals to prison.

"Juries expect forensic evidence," said Spriggs, the state lab's chief. "When it's not there, cases could be lost."

Spriggs also noted that her lab "provides a very important service" to people wrongfully accused of crimes-those who rely on DNA testing to prove their innocence.

The proposed cut could go into effect between July 1 and Jan. 1, she said. It's unclear if it would be permanent. The entire state budget is likely to go to the full legislature for a vote on Wednesday.

When lawmakers debate the budget this week, Grebmeier, the police chief from Greenfield, suggested that they keep crime victims in mind.

"It's an academic discussion about these cuts and what we can afford and not afford until you look into the eyes of a victim or a family that's lost a loved one."

The California Commission on the Fair Administration of Justice reported recently that capital punishment is broken and dysfunctional and will cost billions to fix. Recent reports also demonstrate that each day that we choose to continue with the death penalty as it is in California we contribute to wasting millions per year more than we would if we simply abandonned the death penalty and replaced it with permanent imprisonment. That's right, it costs more to have capital punishment than it does to put someone in prison permanently.

When my brother was murdered in 2003 I hoped that his killer would be apprehended and prosecuted quickly. Today I'm still waiting along with hundreds of thousands of other family members whose crimes are unsolved for justice. Yes, we have a public safety crisis. We also have immediate solutions that will allow us to direct funds to critical services like DNA labs, cold case units, and victim services. Who exactly are we serving with this broken system? Let's end it now.

Cali Gov. need to stop subsidizing in-state tuition at their universities. If the market will bear $20,000 increase in tuition (and if there are any out-of-staters attending, that proves it will) then everyone should pay the same. Cal Tech requires all to pay the same, and I'll be they have full incoming class. Guv won't do it because then even repubs will balk. Much easier for him to live off the backs of state-paid health care workers and poor victims.

California's budget was was around $70 billion until revenues exploded during the dot-com boom and all the government programs caused the budget to grow to $100 in 2 years or so. The dot-com bubble burst but the government spending bubble did not. Go back to 1997, add inflation to the programs then, cut all programs that came after that and you would have a balanced budget. BTW this is where the US government is headed. All the expansions in the name of stimulus will not go away. Nobody loses a government job and no dept. gets eliminated ever because you then have the cries of discrimination and class warfare from people who were not competent to hold any job to begin with.

All you manipulative, lying dirtbags [Bass, Steingberg, and anyone else suggesting it] are living in liberal la-la land if you think the people of this State will ever give the incompetent idiots in the State Legislature the power to raise taxes even further with just a simple majority. They're too stupid to realize what the voters told them loud and clear last May 19th. They really think the people of this State want more taxes but we're just too stupid to know how to express it properly.
With regard to this rape kit baloney, LA Co. just threw out thousands of rape kits that had been sitting around for so many years unprocessed that the statutes of limitation had been reached on them. Where was the priority for treating them properly those years back when there was no budgetary crisis?
In all this spin about the self-created State budget fiasco, the Democratic leadership and Party advocates keep braying about the horror of the cuts, the cuts! As if we should all get tearry and wet our pants about it. What you don't see these manipulative liars discuss is this: the State took in over $85 billion in revenue this past year; just what did they spend THAT on that resulted in not having enough left over for child medical programs and mental health clinics and funding state parks - and processing rape kits?

I have heard the disturbing news that California is headed for a possible financial crisis. This is doubly alarming because California has the reputation of being a prosperous forward-looking state. The image of you, The Terminator, possibly going hat-in-hand to the President of the United States requesting a bailout, is very disturbing and unbecoming to your reputation. One would expect it perhaps from a girly-man governor, but certainly not you.
I have enclosed $1 in hopes it might forestall this possibility. Please use it wherever it will do the most good.
On a more personal note, if you find the financial crunch gets deep enough to affect you personally, I would like to suggest a substitute for those expensive Cuban cigars you smoke. I find Swisher Sweets equally satisfying, and much cheaper. My personal favorite is Captain Black Jamaican Sweets.

What utter nonsense! After this budget bloodbath, every county in the state of California will still have their vicious narcotics task force harassing the same, mostly poor, drug users over-and-over; we will still have over 100,000 non-violent drug users in California prisons at untold expense. The prison guards union will still be the largest contributor to state politicians --- thus guaranteeing that the leg will ratchet up that waste of money and lives.

The State of California does not need more money; we need better priorities. Until they establish rational priorities, they don't deserve more money. We also need better governance, than what comes from this legislative cesspool in Sacramento. These clowns do not prove that California is ungovernable, merely that we have elected the wrong people to govern us. Democrats and Republicans alike, our legislators prioritize ideologica­lly-driven headline-hunting over over doing the peoples business.

We had a nun in the forth grade who told us that: "In the end, everyone gets the vocabulary they deserve." Well, in the end, everyone gets the government they deserve. Bob Dylan asked: "Where do we pay to get out of doing these things twice?" I answered long ago" We pay attention. The time to do that is before there is blood on the floor. Now, we have a mess to clean up which will take a long time while the most vulnerable people are hurt worst... That is pretty much the definition of dysfunctional government.

All you have to do is to take the Texas budget and adjust each line for the additional population and you are done. There is no free lunch ... Taxes are already one of the highest in the nation in California, New Jersey and New York. Better health care or roads there than say Texas? I don't think so. More crime - yes.

Each member of the CA government gets:

ONE assistant
ONE cellphone
ONE computer.

ALL other personnel gets transferred.
SHUT SACRAMENTO DOWN - and have the whole caboodle meet for 3 MONTHS A YEAR.
Period.

They have WAY too much time and WAY too much $$ and WAY too many enablers hidden away in that swamp (literally - it's a marsh).

California's budget is in crisis for several reasons - but one of the most troublesome issues is our 2/3 supermajority requirement to pass a budget. I think we are the only state that has this. It is asinine and it allows the Republicans, who are in the MINORITY far too much power. Adding to the problem - California's districts are drawn such that the Republicans in our legislature are ultra-conservative.

They are categorically refusing to raise taxes. This is the case even though the tax breaks / loopholes they (and I'm talking about both parties here) have given corporations over the past few years total $12 billion dollars, and the car fee they rescinded cost $8 billion dollars a YEAR ... so I think that the Republicans' ideas about cutting education, mental health, child welfare and now services to crime victims and law enforcement...speak volumes about the "values" the Republicans are constantly touting. When are people going to start paying attention to the actions of these "pro-life" members of the "moral majority"?? Isn't there something in the Bible about "whatever you do unto the least of these..." or is that just one of the verses they skip over when they are trying to find "proof" that homosexuality is a "sin"? When are these people going to stop skating by - simply paying lip service to their gullible constituents year after year after year....?

California's people put the rules in place. Do not blame a single party for this issue. Your state and your problems. You could look at the root cause to all these issues and repeal the laws your people put in place. Put away the finger pointing at the Bible because the Bible has not room in government.

We just had the largest tax increase in state history and that is still not enough? The only thing that has saved the people of this state is the super majority rule! Tax breaks for corporations saving $8 Billion, where did you pull that number from? Look around, companies are leaving this state in troves! Jobs are vanishing quicker than they can be created. California is the least business friendly state in the union.

As far as district boundaries, who do you thinks draws them? Both Democrats and Republicans. They both pick their voters! Sacrament is the most corrupt political machine that has ever existed.

I'm guessing you just had the largest tax increase in state history for two reasons: taxes were kept articificially for decades since Prop 13; and there's a recession on, and tax revenues are hemorraging.
There is a crisis, no doubt about it. But Californians are going to have to wake up. It costs a certain amount of money to provide a certain amount of service. If you won't pay for it you won't get it.

As far as my information is concerned - don't believe me - check it yourself...it isn' t that difficult.

Tax Cuts enacted since 1993 cost California $11.7 BILLION in 2008-09 - I apologize, upon re-checking my source, I realize that I exaggerated by $300,000 (got the info from the California Budget Project - a reputable NON-PARTISAN organization.)

As for the Vehicle License Fee - Google it. The figures are between $6 and $8 Billion.

And yes, both parties are to blame - but the one party that likes to tout their values all the time is the one that seems the most willing to cut services to the most vulnerable people in our society.
