JENA, La. — Five members of the Jena Six pleaded no contest Friday to misdemeanor simple battery and won't serve jail time, ending a case that thrust a small Louisiana town into the national spotlight and sparked a massive civil rights demonstration.

State District Judge Tom Yeager then sentenced the five, standing quietly surrounded by their lawyers, to seven days unsupervised probation and fined $500. It was a far less severe end to their cases than seemed possible when the six students _ all of whom are black _ were initially charged with attempted murder in the 2006 attack on Justin Barker, a white classmate. They became known as the "Jena Six," after the central Louisiana town where the beating happened.

"I just thank God that it's all over," said John Jenkins, father of Carwin Jones. "It's been a long, painful journey for everyone on both sides of this thing."

Barker and his family and friends sat without expression throughout the hearing. Barker's attorney said he graduated and is now an oil field worker. The family did not comment.

As part of the deal, one of the attorneys read a statement from the five defendants in which they said they knew of nothing Barker had done to provoke the attack.

"To be clear, not one of us heard Justin use any slur or say anything that justified Mychal Bell attacking Justin nor did any of us see Justin do anything that would cause Mychal to react," the statement said.

The statement also expressed sympathy for Barker and his family, and acknowledged the past 2 1/2 years had "caused Justin and his parents tremendous pain and suffering, much of which has gone unrecognized."

Barker spent several hours in the emergency room after the attack, but was discharged and attended a school event the next night.

By pleading no contest, the five do not admit guilt but acknowledge prosecutors had enough evidence for a conviction. LaSalle Parish District Attorney Reed Walters said in a statement that he could have won convictions but wanted to end the matter for Barker.

Charges against Jones, Jesse Ray Beard, Robert Bailey Jr., Bryant Purvis and Theo Shaw had previously been reduced from attempted murder to aggravated second-degree battery. All but Shaw were assessed $500 in court costs. The judge did not tack that punishment on to Shaw's case because he stayed in jail for almost seven months, unable to raise bail, following his initial arrest.

Each paid the fine and court costs immediately. The payment of restitution to Barker was also part of the deal, but the amount was not released. A lawsuit filed by Barker against the group was also settled Friday, though the terms were confidential.

The only member of the group to serve jail time was Bell, who pleaded guilty in December 2007 to second-degree battery and was sentenced to 18 months in jail.

Four of Friday's defendants have graduated from high school, and all are attending or getting ready to attend college. Purvis has completed his first year and Bell is planning to attend college this fall. Beard is a senior in high school in Connecticut.

"They can move along with their lives," said Bailey's attorney, James Boren. "And because there are no felonies they can look forward to full lives ahead."

The severity of the original charges brought widespread criticism and eventually led more than 20,000 people to converge in September 2007 on the tiny town of Jena for a major civil rights march. Some $275,000 was raised to hire a large defense team for the six, said Beard's attorney, David Utter.

Racial tensions at Jena High School reportedly grew in the months before the attack. Several months prior to the attack, nooses were hung in a tree on the campus, sparking outrage in the black community. Residents said there were fights, but nothing too serious until December 2006 when Barker was attacked.

"Everybody pointed a finger at Jena during this, but this happens to African-American males across the country," Utter said. "These young men were lucky that people cared and donated money so they could afford good attorneys. That made the difference."

Any 'disgruntled whites' who are wondering how this happened, bringing up OJ & Twana Brawley, etc. should should look no further than the actions of your DADS, GRAND-DADS and UNCLES. (and mothers, grand-mothers and aunt who made false claims) Ask them about Emmit Till, the Scottsboro boys and all the other miscarriages of justice and about the legacy they left for you to deal with....if you're looking for culpability, look no further than across the dinner table.

And if you're keeping score, you're still waaaay ahead.

how about the scott(s) sister case. two life sentences for ALLEGEDLY stealing 20 or less dollars total. witnesses say they were not involved and have changed their stories after being coerced by police to finger them in the first place.

Anytime, there is a racial incident between Blacks and Whites, someone has to bring up the Tawana Brawley case which has nothing to do nor compares to this case. Based on that fact, I don't think you really know much about this case although you started off with that inference.

I hope this teaches kids black and white to stop picking and calling each out of thier names. I hope they all decide to go to college and get an education, this should be a lesson learned that you can not resort to violence in any incident.


We need to get back to teaching kids " sticks and stones may break your bones but names will never hurt you".

There's a reason we don't tell kids "sticks and stones" anymore - because words DO hurt. If a black guy is called an N-word, or a gay guy is called an F-word, then that's incredibly hurtful.

The trick of it is, we have to teach kids that even though words CAN hurt, it's not the right thing to do to resort to violence.

That's a feminine mentality of, "I should be able to run my mouth and say reckless things without any reaction whatsoever". I see lots of males raised by mothers thinking this way nowadays. Perez's diatribe is a perfect case-in-point. Fact is, people shouldn't spout off whatever comes to their mind. There may be consequences.

As a white woman of mature years who has lived in several states this is what many don't see and will never agree with. When you are a black man accused of a crime you rarely get this good a plea bargin. I realize they may or may not be telling the whole story but for five young black men to get this small a penalty is (believe it or not) progress. The white men who drug a black man to his death behind a pick up truck in Jasper Tx got NO time. Charges were dropped. This is typical of the difference in the way people are treated every day in this country. Just look at the men who have been released from prison after having DNA proved they didn't do the crime. Most of them were arrested because police get a description of a young black man and they make the evidence fit the person they have arrested instead of actually finding the right man.

We the People of the United States of America, in order to form a more perfect Union, establish Justice....

When those famous lines were writing, this nation was controlled by slave holders profiting off the labor of an imported African people. Therefore, the foundation of America was laid on white supremacist ideals, and justice has always been black and white in the United States. Ironically, as a multi-racial President resides in the white house, hate crimes have actually increased, policy brutality is on the rise, and racism is surging in this nation.

History always repeats itself, but we learn little from history. The Jena 6 are the modern day Scottsboro Boys.

Justice in America for minorities is a work in progress.

Accorrding to FBI stats 90% of all violent crime is "intraracial", only 10% of the time "interracial", of that 10%, nine times out of 10 the victium is white therefore if "h@te crime" laws where implemented impartially, nine times out of ten a "non" white would be charged with a "h@te crime" violating liberal moral relativism.

You clearly know nothing about this story. It's not a hate crime because there's no history of minorities singling out whites specifically for their race as a means to terrorize the larger white community. For example, blacks don't randomly hang nooses to intimidate whites by alluding to a 300+ yr history of lyn.ching. I know this is a hard concept to grasp since it ruins your attempts at victimized "reverse racism", but the simple fact is the person they are charged with assaulting provoked the situation by using an ethnic slur. In the real world, kinda like Perez Hilton, that sort of thing still might earn you a earn you a trip to the emergency room.
