Speaking to nominee Sonia Sotomayor's "wise Latina" remarks, Sen. Jon Kyl (R-Ariz) quoted at length from another Latino justice -- Judge Richard Paez of the Ninth Circuit. "'Recognize that you might have some bias, or prejudice,'" Kyl said in quoting Paez's oft-cited instructions to juries on how to disregard their bias. "Recognize that it exists, and determine whether you can control it so that you can judge the case fairly. Because if you cannot--if you cannot set aside those prejudices, biases and passions--then you should not sit on the case.'"

Because unlike Judge Sotomayor, they hold radical right-wing views that are in fact WAY out of the mainstream of American judicial history, thought and practice, including an acceptance of the neo-con "unitary executive" theory so beloved of Cheney/Bush, a theory that, if put into effect and accepted by the federal courts, would reduce this country to the dictatorship Bush was heard to long for. That theory accords to the president virtually limitless power with virtually no checks or balances.

Moreover, unlike many in the Senate, Sen. Obama was not fooled by the disingenuous answers Roberts and Alito gave at their confirmation hearings; he understood that they, and especially Alito, would set about reversing long-established precedent in ways that would reduce Americans' civil rights and freedoms and increase the power of government and corporations. And that is precisely what Roberts and Alito have done -- behaved like the "activist judges" so reviled by the right-wing, deciding cases according to an ideologica­lly-driven agenda rather than on the law and the facts, going so far as to subvert the clear intent of Congress in the Ledbetter case, for example.

All of which you would know had you listened to yesterday's Sotomayor hearing, at which Sens. Feinstein, Whitehouse and Durbin, among others, set out long lists of the cases in which Roberts and Alito have ruled in ways that belie what they said they would do and what they believed at their confirmation hearings.
