BUFFALO, N.Y. — Chicago Blackhawks star Patrick Kane was indicted Wednesday on misdemeanor assault and theft charges after he was accused of beating up a cab driver over a fare dispute.

The grand jury dismissed a more serious felony charge of second-degree robbery, Erie County District Attorney Frank Sedita III said.

Kane, 20, and his cousin, James Kane, 21, were arrested Aug. 9 after 62-year-old cabbie Jan Radecki told police they attacked him when he said he didn't have 20 cents in change for the fare. James Kane was indicted on the same charges.

The cab driver had bruises and broken glasses.

At a U.S. Olympic hockey camp in suburban Chicago, Kane said he had not heard any details about the indictment and wanted to talk first with his lawyer.

"If the felony is dropped, that's obviously a positive step," Kane said. "The sooner it gets over, I think, the more everyone will be happy about it."

The Kanes earlier pleaded not guilty to the charges. They were indicted on charges of third-degree assault and theft of services, both misdemeanors, as well as harassment, a violation. Arraignment is scheduled for Thursday afternoon.

If convicted, the Kanes could get up to a year in jail.

Calls to Patrick Kane's lawyer, Paul Cambria, were not immediately returned.

"As is the practice in all criminal cases, the assigned prosecutor and defense counsel will discuss a possible resolution of the case short of trial," Sedita said in a statement.

A plea deal would be based on the victim's wishes, the severity of his injuries and other factors, Sedita said. But Kane's celebrity status "is not such a consideration," he said, adding, "Kane will not be prosecuted more leniently or more harshly because he is employed as a hockey player."

The cabbie has said he wants a public apology from the Kanes, not jail time, said his lawyer, Andrew LoTempio.

"I can't comment as to his point of view," Sedita told The Associated Press. "The name of the action is the People of the State of New York v. the Kanes, not Jan Radecki v. the Kanes.

"We often have domestic violence cases where victims do not want to go forward, but we go forward with it anyway. I'm not saying that's the case here but just to illustrate the point. Obviously, we take a victim's wishes into consideration all the time."

Kane, the No. 1 overall pick in the 2007 draft and the rookie of the year in 2008, had 25 goals and 45 assists last season, and his team has built a marketing campaign around him. He helped the Blackhawks advance to the Western Conference finals last season.

The guy LOCKED THEM IN HIS CAB & cursed them out. That is illegal under any circumstan­ce...even if they had no cash & tried to stiff him altogether (which they did NOT), he has no right to do that.

HE should be charged as much as/moreso than the Kanes, and I hope he took a few good licks, too.

How would an arrest (more likely you meant a conviction) ruin Kane's life?

If Kane was studying to be a professional, I can then see how that would ruin his life.

How did it ruin Michael Vick's life? Other than serving time during what would have been part of his prime, he is currently training with the Philadelphia Eagles. He might be the target of insults from opposing team fans, such as the Eagle Beagle beater , that's football. Besides, Ricky Williams suffered much more for something as harmless as pot. And he never cowardly punched an old man in the face nor did he encourage the inhumane treatment of an animal.

#1. check him for steroid use,

#2. require him to take a series of anger management courses,

#3. require him to seek psychological counseling for uncontrolled anger.

Taxis are such jerks these days. Last time I was in vegas, he said swenson was closed, my buddies behind showed up 2 mins later for 8 bucks less. Needless to say, the cabbie got zero tip.

Vegas cabbies have a large percent of crooks and shysters that bilk the customers. I have had good cabbies there too, so I'm not saying they're all bad, but on an average trip with 4-8 cab rides, I almost always get one.

it seems they beat him up because the cabbie had a policy of locking the door of his cab until paid whenever he picked up youngsters. The Kanes got mad at the fact that they couldn't get out of the cab to get the wallet comfortably, didn't want to give the cabbie a tip, felt his refusal to change was an attempt to pocket an extra 20 little-ones and they decided they'd show him a lesson. Not defending it- real petty and immature.

As usual people think someone is guilty before they are proven innocent. A grand jury will indict almost anyone the prosecution want to indict. It means very little. It is also the usual case of prosecutors over charging people in order to get a plea bargain on a lesser charge.

Even the cab drivers lawyer says this has been blown out of proportion, and he said that the cab drivers in Boston have a habit of locking people in the cars if there is any dispute over money.

Maybe we should wait for the facts.

We didn't say he was guilty, we said he was indicted. If he's convicted, he should do time. No leniency because he "comes from a good family" or because he knows how to hit a puck into a net.
