Chris Brown Sentenced To Probation, Ordered Not To Contact Rihanna For 5 Years

ANTHONY McCARTNEY   08/26/09 12:21 AM ET   AP

Chris Brown

LOS ANGELES — A judge on Tuesday sentenced Chris Brown to five years' probation and six months' community labor for the beating of Rihanna and ordered the R&B singer to stay away from his former girlfriend for the next five years.

Los Angeles Superior Court Judge Patricia Schnegg told Brown that he could be sent to state prison if he violated any terms of his sentence, including an order to stay 100 yards away from Rihanna unless they're attending music industry events.

A probation report prepared for Tuesday's sentencing describes two previous violent incidents. It said the first happened about three months before the February beating while the couple was traveling in Europe; Rihanna slapped Brown during an argument, and he shoved her into a wall. In the second instance, Brown allegedly broke the front and passenger side windows on a Range Rover they were driving while visiting Barbados, Rihanna's home country. Neither attack was reported, the probation report states.

Brown will serve his sentence in his home state – Virginia – and his community labor will be overseen by the police chief in Richmond.

The judge said she wanted to ensure that Brown, 20, performs physical labor instead of community service, such as mentoring young people. He will also undergo a year of domestic violence counseling.

Rihanna did not attend Tuesday's sentencing.

At one point, Brown, who was accompanied by his mother, agreed to the terms of the sentence before Schnegg had finished going through them all.

The hearing had been planned for Thursday afternoon, but Brown's lawyer, Mark Geragos, asked to move up the singer's sentencing to Tuesday. A previous attempt to sentence Brown was postponed when Schnegg said she hadn't received adequate assurances that Brown would perform physical labor if allowed to serve probation in Virginia.

The judge said she was satisfied with a letter presented by Geragos that Richmond Police Chief Bryan T. Norwood will directly oversee Brown's labor program.

After Brown pleaded guilty to felony assault in June, Schnegg ordered the pair to stay away from each other and to not contact one another. Her order Tuesday essentially extended that until Brown completes his sentence.

Donald Etra, Rihanna's attorney, has said he didn't think the strict rules were necessary, but that he and Rihanna favored a less-stringent ruling that simply ordered Brown not to annoy, harass or molest the 21-year-old pop singer. He said after Tuesday's hearing that Rihanna did not object to the stay-away order, which allows the former couple to be within 10 yards of each other if they are attending music industry events.

Schnegg said she was aware of reports that Brown had been spotted on several occasions in the same places as Rihanna.

"I am not amused with the chatter that has been on the airwaves and any violation of your probation in this case comes with the potential for state prison," Schnegg told Brown.

A felony charge of making criminal threats was dropped during Tuesday's sentencing.

"We feel that the sentence for Mr. Brown is an equitable one," said Sandi Gibbons, a district attorney's spokeswoman. "He has his future in his hands. He has control of his fate."

Gibbons said Brown's charge could eventually be reduced to a misdemeanor if he completes his sentence.

Brown was arrested Feb. 8, hours after he was accused of beating Rihanna.

The attack occurred in Los Angeles' Hancock Park neighborhood as Brown drove a rented sports car. A Los Angeles police detective described a brutal attack in a search warrant affidavit filed in the case, stating Brown hit, choked and bit Rihanna and tried at one point to push her from the car.

Brown's career suffered after his arrest, with sponsors dropping him and radio stations refusing to play his music. Both he and Rihanna had to cancel several high-profile appearances, including planned performances at the Grammy Awards the day of the attack.

In a probation report released after the sentencing, Brown is quoted as saying he was "depressed" since the attack and that he "'does not want to carry on that cycle.'"

The report included letters of support for Brown from RCA/Jive Label Group Chairman Barry Weiss as well as an entertainment lawyer and a pastor.

Chris Brown should've went to his pastor or priest and beg for forgiveness. Knelt down and kiss the statue of the Virgin Mary inside a Los Angeles carthedral, instead of moving on and putting the incident behind him. He should also cut himself up in a religious ritual, as to please the gods of womenhood. He also should have gone to a women prison; and apologized for those women who killed their husbands and submitt himself to be sacrifice for the evil deeds of all men. Then, maybe then, the incident with Rihanna might be forgotten and and he will forgiven. I hope not...

Make legal argument, motecarlo.

This has nothing to do with feminism. A guy beat up his girlfriend. It happens everyday.

Can you please provide proof that she hit him first?

The point is any time you assault ANYONE you should accept that you MIGHT get hit back.
********************************
There is no proof she "assaulted" him. Your argument is based on a false premise that you cannot prove.

That being said, if you slap me, does that give me the right to escalate the conflict by pulling out a baseball bat and hitting you? Of course it doesn't.

Being hit does not give anyone carte blanche to retaliate against the person any way they please.

You admitted that you were not a lawyer, go ask one. Ask a lawyer if someone slaps you if you can then choke them until they are unconscious and then claim it was self defense.

No I am anything but dramatic. Sorry. I never said I was there. Um, were you there?
I am simply going by facts, which are CB was charged, convicted, and apologized.

Did you read before hitting post? You called me dramatic and you worried about another woman's personal, private business? How is what Rihanna does with anyone else relevant to this thread?
You are the example of the vitriol and seething anger I spoke of.

If he had called the cops when she attacked him, she would have gone to jail, but he would have been labeled a wuss for allowing a woman to beat him. You're not being very reasonable here.
******************************
You are making lots of assumptions, predictions, and generalizations that you couldn't back up if I challenged you to do so. I am not gonna, though.

Where in the police report does it even say that she hit him first? Anyway, I honestly don't care. Hitting someone first doesn't give that person the right to escalate a conflict, which is what CB did by choking her until she was unconscious, bitting her, beating her in the face, etc etc.

You will need to show where CB sustained those injuries.
03:13 PM on 08/26/2009
He did not choke her into unconsciousness. Stop exaggerating. Even TMZ, which has been anti-chris, stated that their LAPD sources confirmed that she admitted to initiating the violence on the night in question. As far as the police report, you've read the affadavit for a search warrant, not the police report. And you're right, hitting someone first doesn't give you a right to escalate the incident. But it DOES show that you have a problem. Did you read the article regarding the prior incidents?

And the previous incidents angle has devolved into:

1) She slapped him and he held her to calm her down. She threw a potted plant at him and he bust out the car windows.

which was twisted into:

2) She slapped him and he shoved her against a wall. He bust out the car windows.

which was twisted into:

3) There were two prior "domestic violence related" incidents. He's shoved her and bust out car windows.

which was twisted into:

4) He's beaten her before.

Post that link please. I also looked at TMZ today and there wasn't a retraction. That must be a Medi@ T a k eoutlie?

Regardless of how you want to spin it he choked her, the point of choking someone is to make them n ot breathe, which is to kill thems.

He got away from a attempted murder charge via the privileges he has. Only a rich man with a lawyer would get that for doing that to Rhianna. IF ANy male in this section, did that to her they would not get a5 years probation.

Photographs are doctored all the time. Newsweek , a well respected news magazine, admitted to "darkening" OJ Simpson's photograph in 1994 to "make him look more menacing."
******************************

OMG! Please let's compare apples to apples. Photographs are doctored all the time isn't proof that Rihanna's photo was doctored. Geez.

You also don't seem to understand that being hit doesn't give you the right to escalate a conflict.

For example, a man hits another man in the bar with his fists. The man who was hit does not have the right to escalate the conflict by pulling out a baseball bat and hitting the aggressor.

Please stop talking about an AA man. He beat up a black woman. I am a black woman, so I should side with the black guy? Why?

Your post demonstrates that you have anger issues.

Sexism.
That why some assume you must make Brown a victim and bash Rihanna.

Some are willing to talk about racism but seem to think its ok to treat women, even women of their own race, like second class poeple.

24kgold,

I have no way of knowing the s*x of anonymous posters.

"Why do you want to attack women that don't think like you?... you have to be d-u-m-b and s-t-u-p-i-d to think that she doesn't need anger management also"

Do you see that you accused me of attacking women who didn't agree with me, and then you went ahead and attacked me for not agreeing with you?

You don't seem to understand that just because a person hits you, doesn't give you the right to escalate the conflict.

For example, a man hits another man in the bar with his fists. The man who was hit does not have the right to escalate the conflict by pulling out a baseball bat and hitting the aggressor.

If Rihanna slapped CB, which is what you all claim, he didn't have the right to beat her in the face, push her head against the window, choke here until she was unconscious, bite her, etc etc. That's escalating the conflict.

Do you get it now? I am a woman too and I have never hit any of boyfriends. I have also never been hit either. So what? Who cares?

I think you are a black woman and I am a black woman, so I am just going to give my opinion: sometimes "we" are too hard on each other.

Just read your post. The things you say are really absurd.

PROBATION?????
This sets a very dangerous precedent and example for our young people, and for domestic violence victims of both genders. That stupid judge should have required jail time.
Michael Vick got 2 years for what he did.
A friend's husband ig 30 days in jail, then 30 days work release, plus a 3 year restraining order and probation of similar length.
Geragos did it again; money talks, Brown walks.
Positively sickening.

Get a life, the boy made a mistake, he gets to go on and live his life. None of us knows what happened between them. Rihanna was not innocent is all of this. I'm sick of listening to people that don't know the entire story, only holding Chris Brown for this crap. Women need to be held accountable for their behavior also. I am not condoning him hitting her back, but she is not innocent in this mess. She gets to go on with her life and so should he.

CB said what he did amounted to a felony assault. Let's take his word for it, MMkay?

He admited his guilt.

BRown did beat her face in and choke her. SHe did NOTHING on that level and you have no evidence to show otherwise.

I wonder if you bash any women in your family if she is abused and blame her.

I agree completely.

As a woman I would NEVER hit a man b/c I would fully expect to be hit back - relying on him to be 'the better person' isn't going to keep you safe. If you don't want to be subject to abuse then don't antaginize someone.
***********************
What if you don't antagonize a person and they still hit you?

You seem to be missing the point. Classic blame victim.

If a man hits another woman, the man who was hit has the right to hit the other man back. He does not have the right to pull out a knife stab his aggressor. That's escalating the conflict.

If Rihanna slapped CB, he had no right to escalate the conflict by bitting her, smashing her face into the window, choking her until she was unconscious, beating her in the face, etc etc.

This is a simple felony assault case and most of you folks are personalizing it and talking about women should never hit men and what not.

It has nothing to do with our own personal relationships with men.

I think you missed my point. I was not defending Chris nor condemning Rihanna. I was generalizing the point. Some women seem to think that they can slap, hit, punch , kick or otherwise assault men because men shouldn't hit women.
************************************
Well it that was your point, your comment was off topic. This thread is about a man who admitted to beating up his girlfriend and accepted a plea of felony assault.

He did not indicate that he was provoked or defending himself.

"Some women seem to think" I have no idea what that even means. You are making a lot of assumptions and generalizations.

This is a very simple topic. A guy admitted to beating up his girlfriend and accepted a charge of felony assault.

Lets leave it at that.
01:41 PM on 08/26/2009
TiffanyHB,

I did not realize that you are the moderator for this thread. The comment was in response to a prior comment and was stated as such with quotes.

You seem to be fond of accusing people of making "assumptions and generalizations" when you have misread or don't understand or agree with their point.

My only assumption is that people read from top to bottom. I have stated that it was a generalization. If you can't grasp what "Some women seem to think" means in the context of the comment then then you probably "have no idea" about what most of these comments mean.

Finally, as evidenced by the post here, abuse is NOT a very simple topic.

Lets leave it at that.

No way would I ever be a moderator.

I apologize.

I actually stopped reading after, " some women seem to think." I blame my English professor. He taught us to never make an argument by using a generalizations like, " some women seem to think". How could anyone debate for or against that? Can you prove what "some" women "seem" to think?
12:00 PM on 08/26/2009
Females, we must learn to spot potentially violent abusive men and situations, and avoid them if at all possible.

We must learn not to start a physical fight with a man, but if a man attacks anyway, don't fight "fair". Do whatever we can to get away, and if that's not possible, to survive the attack.

No matter how sorry he is afterward, know that man will probably do it again, again, except each "next time" will be worse than the last. Most murdered women are killed by their significant others. A few men do clean up their act, but they usually do it with another woman. Know when to cut losses and move on. Don't fantasize about reconciliation.

Put as much distance as possible between you and him. Screen your calls, block his number, and as soon as you recognize his voice, hang up. His violence feeds off interaction with you---any kind of interaction.

Change your locks, phone numbers, address, your town, and even your name if you have to, install a burglar alarm, get a big protective breed dog, spend some time on training, and bring it to live in the house with you.

Take a personal safety/ self-defense course, read Gavin Debecker, and consider learning how to handle a firearm.

Don't depend on a restraining order to protect you. Research what measures you can legally take to protect yourself from an attacker or an intruder, and be prepared to use them.
