MINEOLA, N.Y. — A Hofstra University freshman who had claimed she was raped by five men in a dormitory bathroom changed her story after prosecutors confronted her with the revelation that a video of the encounter may have been recorded, a prosecutor said Thursday.

The recantation on Wednesday night led to the immediate release of four men, including one student at the Long Island college, who had been arrested on rape and other charges. Police had been seeking to arrest a fifth man when the charges were dropped.

The sex did occur in a bathroom but was consensual, a prosecutor said. Authorities could decide within weeks whether to charge the 18-year-old woman for making up the story.

The woman was identified as Danmell Ndonye of Manhattan by a law enforcement official with firsthand knowledge who spoke on condition of anonymity because he was not authorized to release the name. A call to a Manhattan phone listing for a Ndonye was returned by a woman saying it was a wrong number.

Nassau County District Attorney Kathleen Rice said Thursday that the woman, whom she would not identify, was interviewed Wednesday night by two senior prosecutors as a routine part of a follow-up investigation.

The woman first told police she was lured to the dormitory and raped early Sunday after her cell phone was stolen by a man she had met at a dance party, Rice said. She said she was bound with rope while the five men took turns sexually assaulting her in a men's bathroom stall.

Almost immediately, Rice said, the woman's story began to unravel with "significant inconsistencies," but she declined to elaborate. "The turning point was when she was confronted with the fact that there may exist a video of some or all of the incident," Rice said.

"Her actions and demeanor depict a very troubled young woman in need of much help," the prosecutor said.

An attorney for one of the accused men, 20-year-old Kevin Taveras, said he was shown a copy of the cell phone video and said it confirmed reports that the woman was not attacked.

"It looks more like a porn movie," Victor Daly-Rivera said. "It showed just the opposite of what the allegations were. There was no tying up, there was no bruising, there was no screaming."

Ndonye has been suspended from school until a disciplinary hearing is held, a Hofstra spokeswoman said. Melissa Connolly also said a suspension against Rondell Bedward – the only Hofstra student among the five men implicated – had been lifted.

Two of the men who were released said outside the Nassau County jail on Wednesday night that said they had feared the possibility of serving 25 years to life for a felony rape conviction.

"It's crazy; the system is supposed to prevent these things from happening," Taveras said outside the jail late Wednesday.

"It's supposed to be innocent until proven guilty, not guilty until proven innocent," he said. "Inside I thought I was going to do a bit for something I didn't do."

Bedward, 21, declined to comment after he was released.

On campus, students shook their heads at the latest twist in the case.

"It's definitely a shock," said Megan Michler, a junior from Penargyl, Pa. "I guess she completely lied about it and it's not fair to the guys that were involved. Everyone was shaken up by the whole thing, and now we were shaken up for nothing."

Hofstra, a private university of 12,600 students, played host to the final presidential debate of the 2008 election.

The rape report "just really gave the university a bad name," said Dani Frank, a print journalism major from Easton, Conn. "I really wish there hadn't been conclusions jumped to because it put the boys in a negative light, it put Hofstra in a negative light, and people will give her a lot less credibility in the future."

To salvage reputations, I have long advocated keeping the names of both the alleged victims and perpetrators undisclosed pursuant to the outcome of a trial. Once the name and picture are out there, it is hard to "unring" that bell. Remember Richard Jewel?

The presumption of innoncence until proven guilty is fully compromised when public opinion can be easily influence by media images.

I'm not sure we'll ever know how much duress or consent there was in this case, HOWEVER, this points out that boys, and men, are one sexual encounter away from being charged with rape. And, presumably, if there is more than one male involved, the chances probably go up.

Everyone should warn their sons that it pays to spend some time ensuring that the girl they are with is consenting. Which means that, no matter how much alcohol or drugs you've consumed, sex on a first "date" is not a good idea. Nor is "group" sex.

I know that the guys will be screwed reputationally regardless of their innocence. However, I haven't seen anyone point out the fact that all of the accused will be financially set for life as a result of the lawsuits that will ensue. Not just against the girl, but the school, the media, etc. Their earnability from this has much more potential than a regular job netted from a Hofstra degree (and I don't know if the other accused men even went to college).

Crying rape is nothing new. Women that have consensual sex and then later feel ashamed of it do this all the time. Thank the Lord for the age of camera phones. It makes it hard for women that are actually victims of rape now and in the future. People will think twice before believing them. Men that actually want to commit rape may use this to their advantage. Such a shame.

I'm still dumbfounded how much some people just hate men or just hate sex or both.

Even AFTER they find out these men raped NO ONE, now they say....wel­l, it's still wrong, they should have known better (including they should have known better than this woman what she wants and refused even if she foolishly thought she wanted it) they are morally bad, etc. etc.

This SHAME, this moralizing is the VERY reason this young woman LIED and almost ruined 4 lives.

So the people on their high horse because group sex offends their morality are partly to blame for this girl's destructive lies.

Anyone who says these men deserve some or any of the terrible things that have happened to them because they had consensual sex....SHA­ME on you.

How about this logic, "anyone who self righteously explains how another person's inability to follow the self righteous person's OWN personal code of morals should result in false accusations and public humiliation DESERVE anything they get"?

The police should charge that woman.
The prosecutor is making her look like a victim again, like she's some troubled girl who needs help. Yeah, right. She lied to place 5 young men in jail and facing 25 years to life in prison.
Stop the non-sense.
No excuses for her. Arrest her and place her mug shot all over the news. She needs to be brought to justice.

I hope these guys sue the hell out of the police department and the DA's office. they did a terrible job. They only took her word and no other evidence to arrest them, imprison them and plaster their mug shots all over the news and have them face 25 years to life.
It's a good thing that there was a camera video of this consensual sex, otherwise these young me would have been convicted. Prosecutors don't care about justice, they only want to get a good record of convictions.

Thank god for camera phones. It's the only things that saved them.

Hey, I can go for that. Women can falsely accuse a guy here and nothing happens to them. There is definitely something wrong with that, but the guy stands to spend the major part of his life in prison, even if the accusation is false. What is wrong with this picture?

Sorry, but you are wrong. I used to be a rape crisis counselor and personally know of instances where the woman was prosecuted for making a false report. It happens often in instances of false reporting. Although it is difficult to do accurate studies, researchers estimate that only 10% of women who are raped actually go on to report the rape, and a very small percentage of those reports are false. That said, false rape reports should be prosecuted. There is never any good excuse for it.

How do these "Law enforcement officials" get away giving out privileged information such as names just by staying anonymous? It seems most news stories have an anonymous official giving out information that shouldn't be let out. It also happens with military officials.­(treason?)
Also, why can they splash the names and faces of the guys involved all over the media with no convictions, and they don't show the "victim"/now defendent?
