A Senate Democratic leader is hoping to blow up the deal reached between the White House, drug makers and Senate Finance Committee Chairman Max Baucus (D-Mont.), by introducing an amendment on the floor to allow prescription drugs to be re-imported from Canada.

It's one of the simplest ways to reduce health care costs but was ruled out by the agreement, which limits Big Pharma's contribution to health care reform to $80 billion over ten years.

North Dakota Sen. Byron Dorgan, a member of Democratic leadership, isn't a party to that bargain. "Senator Dorgan intends to offer an amendment to the health reform bill and his expectation is that it will be one of the first amendments considered," his spokesman Justin Kitsch told HuffPost in an e-mail. "Prescription drug importation is an immediate way to put downward pressure on health care costs. It has bipartisan support, and has been endorsed by groups such as the National Federation of Independent Businesses and AARP."

U.S. patients pay far more than the rest of the world for prescription drugs. The Canadian government keeps prices down by using its purchasing power to negotiate for lower rates. Dorgan wants American consumers in on the deal.

A bill to allow re-importation -- S. 1232 - has 30 cosponsors, several Republicans among them, including Olympia Snowe and Susan Collins of Maine, John Thune (S.D.) and David Vitter (La.).

The Congressional Budget Office estimates that the bill would result in $50 billion in direct savings over the next decade, with $10.6 billion of that being savings to the federal government.

Jim Manley, senior communications adviser to Senate Majority Leader Harry Reid (D-Nev.), said that he sees no reason the amendment won't get a floor vote. "To the extent possible, we intend to have a full and open amendment process," he said. Reid has himself voted to allow re-importation in the past.

The amendment threatens to blow up the deal Baucus and the White House cut with the drug makers. According to the deal, re-importation would not be part of comprehensive health care reform. And if the measure does save $50 billion, that will come from Big Pharma revenue and take it above the $80 billion in cuts it agreed to over ten years. It puts Congress on a collision course with its trade association, the Pharmaceutical Research and Manufacturers of America (PhRMA).

Ken Johnson, PhRMA's senior vice president, told HuffPost in August that the trade group was prepared to go back to battle with Democrats over individual bills such as re-importation once health care reform was passed. "The only thing I can say is we'll do what we always do. We'll roll up our sleeves and fight them one fight at a time," said Johnson.

Those individual fights, however, might be bound for the Senate floor sooner than PhRMA thought. Senators, meanwhile, will face the question of whether to buck a deal they didn't agree to in the first place.

"This is not the way that I would like to be treated," Sen. Tom Carper (D-Del.) said during a Finance Committee debate over an amendment that would have broken the PhRMA deal. "Whether you like PhRMA or not, we have a deal."

Nonsense, said Sen. Chuck Schumer (D-N.Y), insisting that he and his colleagues were not bound by the agreement. "That's a value judgment," Schumer said. "This is going to be a constant debate when we come to this bill, and I don't disagree that this is a difficult balance, but how often do we side with one of the interest groups, and how often do we side with the average citizens?"

Johnson made the case that the savings expected form re-importation might not materialize and wouldn't be worth the safety risk.

"If health care reform is done in a smart way, importation loses its political relevance because any potential benefits are far outweighed by known safety risks," Johnson said. "CBO has compared importation to parallel trade in Europe, where pharmaceuticals meant for marketing in one country are repackaged for another country. The European experience clearly demonstrates that this practice benefits middlemen, not consumers. So why take the chance? Why play Russian roulette with the safety of patients?"

Big Pharma cutting deals with the government to cut profits by only a certain amount? Does this sound suspicious to anyone? Is the White House approving and helping to preserve their monopoly power?
Have we gotten so far from enforcing the anti-trust laws, that nobody gives a second thought to this kind of "deal". I am proud that there are members of Congress who recognize that they are not bound by any such "deal" and are standing up for the people.

2001 ---Bush Adminstration changed rules in the University Research Program . The Universities no longer had to seek the repaymment of the U.S. Governments investment when the Researchers sold the compounds and chemicals they had devolped. They gave away the Tax Payers Equity !

yeah but not reclaiming the Government Investments when they sale the discovers to drug compnays and chemical companys is not right. The Universities could be self funding by now if they would include the really cost of the research in the sale price.

Drug Companys give small grants to gain favor with Universities then threaten to withdraw those small ones if the prices are high . It is a con game.

I smell a dirty trick in the works by Baucus and his cohorts.

While I believe we Americans should not be paying more for the same drugs that Canadians buy, this could be yet another trick to derail reform.

Why?

President Obama made a deal, like it or not, with big Pharma in exchange for them supporting reform. They spent millions on ads to support reform because of the deal. Perhaps it is not the best deal but without it the same Big Phama would have spent their money fighting reform, not helping.

Along comes Baucus with a plan to derail the deal...is he hoping that doing so will turn Big Phama against reform and get them to switch sides to help derail reform?

Do I put it past Baucus and his henchmen? Not for a second, because they work for the big insurance companies. Congress is just their side job!

I think one of the reasons the public option remains under consideration is the wide support it receives from the populace in spite of all the pooh-poohing it has received from the media and politicians. That's what needs to happen with this bill. We, the people, need to get behind it and make a lot of noise.

What part of a Pharma deal dont u get? Im sorry but i think obama trying to get the paharma to lower thier prices was a great move. Id much rather pay 200 for nmy meds, than the 500 im paying now. I dont have insurance, and im all for public option. I have a son who's medication would cost 600 a month, but thru a program within the paharma company who makes his meds, he pays nothing. . and that is a big blessing. .

Im hoping that the original public option, goes thru and we can finally have health care for anyone who needs it,. Ill be 65 soon and ill finally have some form of coverage thru medicare., which contrary to the lies being spread, will not be changed no matter what kind of public option we get.

For years now the US Federal Government and all US-based multi-national corporations have been espousing the benefits of "free trade" and doing business world-wide.

Since that has become the standard, it needs to apply here as well.
Why am I denied the right to buy medicines from another country?
Why do I, as a US citizen and tax-payer, need a so-called "law" to give me the 'right' to buy something for a better price than what is being offered here at home?

Break down this trade barrier! I'm an adult, I take responsibility for my health, life, work, finances, etc.
I want to buy wherever I can get the best price!!
Is this not the "American way"??

Correct...our country does not have free trade or a "free market". Big corporations depend upon protections and non-interference from government to rake in billions at the expense of the middle class.

The very people shouting "free market" are constantly lobbying Congress for special consideration to protect their business from free markets.

How is it that insurance companies are exempt from anti-trust laws designed to protect the consumer from monopolies? Is that really "free market"?

Were trillions of bail out dollars "free market"...that was welfare as a reward for failure.

Wish I could get that.

Every country should be paying the same price, that is what is unfair!

Low-income seniors who are eligible for both Medicare and Medicaid were switched from Medicaid drug coverage to Medicare Part D/Medicare Advantage and actually lost a big selection of benefits.

The program signed by Bush in 2004 paid $177 billion in government subsidies to insurance companies. This wasn't Health Insurance Reform this was Corporate Welfare.

Even Bush and the Republicans were for single payer when it lined their pockets.

Example – just drugs- nothing else. Some 25% of out-of-pocket spending by individuals is for prescription drugs Currently, the U.S.negotiates some drug prices but is forbidden by law from negotiating drug prices for the Medicare program due to a Medicare bill passed by the Republican-controlled 109th Congress and signed into law by President George W. Bush in 2005.

This allows the pharmaceutical industry to profiteer off of the Medicare program. Patented drug prices in Canada average between 35% and 45% lower than in the United States.

The price differential for brand-name drugs has led Americans to purchase upward of $1 billion US in drugs per year from Canadian pharmacies. (So because of republicans billions of US dollars goes into Canada’s coffers to help pay for their health care)

Bushes Medicare program is single payer – but in no way paid for. It entirely went on the debt . It also has a donut hole that penalizes the very people it is supposed to benefit but instead benefits the drug companies and insurers.
