Interracial Couple Denied Marriage License By Louisiana Justice Of The Peace

(AP) NEW ORLEANS A Louisiana justice of the peace said he refused to issue a marriage license to an interracial couple out of concern for any children the couple might have. Keith Bardwell, justice of the peace in Tangipahoa Parish, says it is his experience that most interracial marriages do not last long.

"I'm not a racist. I just don't believe in mixing the races that way," Bardwell told the Associated Press on Thursday. "I have piles and piles of black friends. They come to my home, I marry them, they use my bathroom. I treat them just like everyone else."

Bardwell said he asks everyone who calls about marriage if they are a mixed race couple. If they are, he does not marry them, he said.

Bardwell said he has discussed the topic with blacks and whites, along with witnessing some interracial marriages. He came to the conclusion that most of black society does not readily accept offspring of such relationships, and neither does white society, he said.

"There is a problem with both groups accepting a child from such a marriage," Bardwell said. "I think those children suffer and I won't help put them through it."

If he did an interracial marriage for one couple, he must do the same for all, he said.

"I try to treat everyone equally," he said.

Bardwell estimates that he has refused to marry about four couples during his career, all in the past 2 1/2 years.

Beth Humphrey, 30, and 32-year-old Terence McKay, both of Hammond, say they will consult the U.S. Justice Department about filing a discrimination complaint.

Humphrey, an account manager for a marketing firm, said she and McKay, a welder, just returned to Louisiana. She is white and he is black. She plans to enroll in the University of New Orleans to pursue a masters degree in minority politics.

"That was one thing that made this so unbelievable," she said. "It's not something you expect in this day and age."

Humphrey said she called Bardwell on Oct. 6 to inquire about getting a marriage license signed. She says Bardwell's wife told her that Bardwell will not sign marriage licenses for interracial couples. Bardwell suggested the couple go to another justice of the peace in the parish who agreed to marry them.

"We are looking forward to having children," Humphrey said. "And all our friends and co-workers have been very supportive. Except for this, we're typical happy newlyweds."

"It is really astonishing and disappointing to see this come up in 2009," said American Civil Liberties Union of Louisiana attorney Katie Schwartzmann. She said the Supreme Court ruled in 1967 "that the government cannot tell people who they can and cannot marry."

The ACLU sent a letter to the Louisiana Judiciary Committee, which oversees the state justices of the peace, asking them to investigate Bardwell and recommending "the most severe sanctions available, because such blatant bigotry poses a substantial threat of serious harm to the administration of justice."

"He knew he was breaking the law, but continued to do it," Schwartzmann said.

According to the clerk of court's office, application for a marriage license must be made three days before the ceremony because there is a 72-hour waiting period. The applicants are asked if they have previously been married. If so, they must show how the marriage ended, such as divorce.

Other than that, all they need is a birth certificate and Social Security card.

The license fee is $35, and the license must be signed by a Louisiana minister, justice of the peace or judge. The original is returned to the clerk's office.

"I've been a justice of the peace for 34 years and I don't think I've mistreated anybody," Bardwell said. "I've made some mistakes, but you have to. I didn't tell this couple they couldn't get married. I just told them I wouldn't do it."

I am outraged by this. In a time when our president is a Black male and interracial marriages/relationships are very open and on the rise. We still have people that feel our rights as interracial couples should be less then what they would call the "normal" relationship. Yes I will admit it is harder, but that is just because of small narrowed minded people like this man. How dare someone deny the right for any couple to be married only because they are different races. Everyone is in-titled to their own opinion, but that should not play a role over in business. Just like your right to the first ammendent (freedom of speech), we have the right to be treated equal. Equality is our right and I demand to fight for that.

MASC (Multiracial Americans of Southern California) disagrees with the judge’s assertion that mixed race people “suffer.” If any issues faced by multiracial people exist, they often stem from having to contend with the negative attitudes and beliefs about our community by outsiders who hold prejudiced and racist views. Research shows that the experience of the multiracial has been incorrectly pathologized, and that their identity formation and overall adjustment is healthy. We also find that there is often a greater ability to interact with and an increased respect for different ethnic/cultural/racial groups. MASC recognizes that President Obama is multiracial, and asserts that his racial/ethnic background has served to benefit him rather than cause him to “suffer.”

The 2000 Federal Census created the first ever option to check off more than one race as an effort to allow accurate identification of oneself, or one's child as a person embodying more than one racial / ethnic background. This was created to make visible a community never before counted - multiracials – who are children of interracial/ethnic marriages.

MASC, a nonprofit in existence for 20 years, and many similar nonprofits locally and nationally in the US firmly oppose any person who defies the 1967 Supreme court decision that lifted the ban on interracial marriages.

A local authority in Israel has announced that it is establishing a special team of youth counsellors and psychologists whose job it will be to identify young Jewish women who are dating Arab men and "rescue" them.

The move by the municipality of Petah Tikva, a city close to Tel Aviv, is the latest in a series of separate – and little discussed – initiatives from official bodies, rabbis, private organisations and groups of Israeli residents to try to prevent interracial dating and marriage.

In a related development, the Israeli media reported this month that residents of Pisgat Zeev, a large Jewish settlement in the midst of Palestinian neighbourhoods in East Jerusalem, had formed a vigilante-style patrol to stop Arab men from mixing with local Jewish girls.

Hostility to intimate relationships developing across Israel's ethnic divide is shared by many Israeli Jews, who regard such behaviour as a threat to the state's Jewishness. One of the few polls on the subject, in 2007, found that more than half of Israeli Jews believed intermarriage should be equated with "national treason".

Since the state's founding in 1948, analysts have noted, a series of legal and administrative measures have been taken by Israel to limit the possibilities of close links developing between Jewish and Arab citizens, the latter comprising a fifth of the population.

Is this some kind of joke?? He was worried for their kids?? Oh, I get it, he is afraid they may grow up to understand the problems and the pride of both races because they will be continually exposed to both. They may grow up having a sense of pride in being raised by two seemingly intelligent human beings who happen to find love and respect each other enough to want to bring children in the world with a married mother and father. Maybe he is afraid they will grow up to be another mixed race failure, like ohhh, lets see, Tiger Woods, Halle Barry, or horrors of horrors, THE PRESIDENT OF THE ENTIRE UNITED STATES.!!! WHAT A WASTE OF FLESH THESE PEOPLE ARE. This is pure and simply racism and in Louisiana, my home state (I left many years ago just because of this mindset) I do not find it suprising at all. This guy has broken several laws including federal ones that he now needs to be taken to task on. I know, the teabaggers will hold a rally for him to raise funds!! Fox has been suspicious in not covering this, wonder why??

Yes it is funny and you are both right. It has been an endless source of angst for both white males and black females. Also interesting how those two sides don't get together nearly as much as the other.

Anyway, this judge is a textbook example of a racist who simply cannot understand that he is a racist in the worst way. Has he not been made aware of the 1967 Supreme Court ruling or does he think he is above the law and/or can make it up as he goes along? He's worried about the children? Why? Because he knows how many racists are still amongst us as he plays the benevolent protector? What a crock. Tell him he need look no further than the White House (I'm SURE he voted for McCain). If that's not enough there are people like Tiger Woods, Derek Jeter, Michael Chang, Hines Ward, just to name a few, who have managed quite well enough, thank you. This guy needs to lose his job fast.

It's funny how the people opposed to "big government" interfering in our lives are the same ones who are ok with government telling you who you can marry and what to do with the contents of your womb, two of the most private parts of our lives.

We can't allow people to marry if they are same sex = We can't allow people to marry if they are of different races = We can't allow people to marry if they are different religions/faiths = we can't allow people to marry if they are in different families: Because that is the only real way we can know that they are the same race, same faith and truly opposite sex.

So the only acceptable humans are those that are the result of in-breeding. That explains a lot about some parts of the South (especially South Carolina). It's horrifying to realize that there is still such blatant racism and hatred out there in this country, and it seems as if same is emboldened suddenly.

I grew up in Pennsylvania not far from Philly, and there are still pockets of racism not far from Philly, but it's not as "in your face." Instead, these people pretend to like people of color to their faces and then call them names behind their backs.

I guess I'm glad those "in-your-facers" are out there. They say sunlight is the best disinfectant.

I'm hoping the next generation will wipe this all out, but if it's been handed down through the family like some kind of heirloom, that may be difficult.

Of course it’s wrong, but it is hard to garnish too much sympathy. As a gay man I can’t get married, can be fired, denied housing and other rights everyone else have. We are considered so low even when murdered the perpetrator only gets a couple years, or recently 90 days and a $50.00 fine.

I was desperately hoping that this would be a wake-up call to all those anti-gay marriage people. Perhaps this will help them recognize the silliness of denying two adults the right to marry. Because this highlights the false arguments that loom so desperately in attempt to keep gays from having the same rights as others.

When will people stop trying to equate being gay with race? They are nothing alike. Sorry but being gay is abnormal. Being Black, White, Asian or whatever is not. I wish gays would stop trying to hijack stories like this to further their own agenda. Now, back to our (hopefully soon to be former) judge Bardwell...

I wonder if this "Justice" of the Peace realizes that it's no longer the sixties and that most people in the most recent generations don't see race as an issue...
It's very odd that, in his mind, most of black society and most of white society does not interracial children, but over 50% of America voted for an interracial President.

Since he is so concerned for the well being of the children, does he also refuse to marry couples who earn very little money, whose children would be raised in poverty? Shouldn't he be saving impoverished children from their own birth as well?
Also, would he marry a mixed race couple who was beyond childbearing age?
