LOS ANGELES — Michael Jackson's father does not stand to inherit any of his son's assets and cannot challenge the appointment of the executors chosen by the singer to handle his will, a judge said Tuesday.

Superior Court Judge Mitchell Beckloff said Joe Jackson was not named in the will but could pursue a motion to receive a family allowance from the estate because he claimed his son had been supporting him.

Joe Jackson and his son had an often-strained relationship, and Michael Jackson said at one point that he would get physically sick – as a child and as an adult – at the sight of his father.

Beckloff ended a contentious all-day hearing by telling Joe Jackson's lawyer, Brian Oxman, that his client had no standing to prolong the legal fray over Jackson's estate and would gain nothing from doing so.

"I don't think he gets to step into this and create further litigation," the judge declared. "Joe Jackson takes none of this estate. This is a decision his son made."

In another development, the court released an accounting that the estate had paid nearly $1 million in expenses for the private family funeral held at Forest Lawn Memorial Park.

Some of the expenses were $11,716 for invitations and programs; $35,000 for burial garments; $30,000 for cars and security; and $15,000 to a designer.

"I would have done it less expensively. But it was Michael Jackson, who was larger than life," Howard Weitzman, an attorney for the estate administrators, said outside court. "There's no reason he should not have a funeral that's larger than life."

Earlier in Tuesday's hearing, Michael Jackson's mother withdrew her objections to the appointment of two longtime Jackson associates as executors of his will.

The surprise announcement came from Katherine Jackson's new probate attorney Adam Streisand, who said his client felt it was time for the legal battle to end over the appointment of attorney John Branca and music executive John McClain.

Katherine Jackson now believes their appointment, as spelled out in her son's will, can "enhance the legacy of Michael Jackson in the best interest of his children," Streisand said.

It was Streisand's first major move in the case since he was chosen last month by Katherine Jackson to replace the team that had represented her since her son's death in June.

Beckloff later made the formal appointment of the executors after deciding Jackson's father could not challenge the move. Oxman threatened to appeal, which could interfere further with the appointments.

Streisand said Katherine Jackson decided she wanted to let the executors go about earning money for the estate rather than incurring more legal fees.

Oxman, however, accused her of reneging on an agreement with her family to challenge the executors and called the announcement in court "one of the most despicable things I have ever seen."

He accused Katherine Jackson of making a secret deal with the executors, a statement vehemently denied by Streisand and Weitzman.

Streisand said no one but he and Mrs. Jackson knew of her decision until he stood in court and announced it.

"All the credit goes to Mrs. Jackson," the lawyer said. "She is really the wise sage of this family."

The judge scheduled a hearing for Dec. 10 on Joe Jackson's request for a family allowance. Streisand suggested Katherine Jackson would support that request.

The will left Michael Jackson's assets to his mother, his children and children's charities.

Branca is an attorney who represented Jackson for more than 20 years and is regarded as the architect of his financial empire. McClain is a music executive and childhood friend of the singer.

Katherine Jackson's original legal team complained that she was not being given enough of a role in making decisions after her son's death. While they considered a challenge, the judge allowed the administrators to go forward with projects including the movie, "This Is It," which brought $60 million into the estate and became a box office hit.

Branca and McClain were credited as executive producers on the movie.

A 60-page motion filed by Oxman detailed Joe Jackson's bid to get money from his son's estate. The father is seeking an allowance to help cover expenses that exceed $15,000 a month, according to the court documents.

The documents said Joe Jackson receives a $1,700 monthly Social Security payment and had relied on his son for support for many years.

Joe Jackson suffers from diabetes and had a stroke in 1998, the filing stated.

A former steelworker, he managed and trained his children and organized the Jackson 5. He has been married to Katherine Jackson for 50 years, but he lists his home in Las Vegas. She lives at a family home in the San Fernando Valley north of Los Angeles.

The filings list Joe Jackson's age as 80 in one place and 81 in another.

His list of monthly expenses includes $1,200 for rent for his Las Vegas home; $2,500 to eat out; $1,000 for entertainment, gifts and vacations; $2,000 on air travel and $3,000 on hotels.

It's sad that the only thing Joe ever loved about Michael was his money. He made enough money on Michael and the other kids when they were younger and under his thumb, he doesn't deserve to be supported in perpetuity. What a l0ser

Can we put a muzzle on this loser? The Travoltas lost their son and haven't even spoken until now, and still cannot speak about Jett. Joe tries promoting his stupid label right after his son died.

First of all, remember that Joe had a low wage job, thus more kids than he could afford, and pumped them to make a living off of them. It paid off for OUR entertainment, but now I guess we shouldn't be surprised. He's doing what has worked -- pimping his kids for his own gain. He has always been that type of man.

I agree with you Jestor. Love him or not the whole Jackson clan would not be in this position without his dictatorship. Good or Bad.
Talent must be nutured and formated for success.
Give the man his fair share. He's 80 years old for crying out loud.
In a very sincere speech on the last day of his life shown in "This is it" MJ thanked his production team, musicians and his whole family, Michael thanked Joe in that speech.

Also, you see how angry the public is with the rest of the Jackson's. That's because in interview after interview, Michael has said how he distanced himself from his family. He felt they used him for money. Dr. Klein really got into that in the TMZ interview. The family can't blame the public. Those words came out of MJ's mouth. I've seen countless interviews.

I wonder if any of them, with the exception of Rebbie and Janet, ever did anything for Michael without asking for money? Dr. Klein said MJ always hid money at home--millions and said Latoya's condo was in either in foreclosure or about to lose it but she was the one in the home right after Michael died. Hmmmm...

Excellent comment HT!!! I totally agree with you! But I also need to add that Marlon and Randy never asked MJ for anything. And at this moment , Randy is the only brother not involved in the "Jackson Reality" show.

Jackie has also moved on with his life as well. The only hangers on out there are LaToya and Jermaine. Tito's kids (3T) were extremely sucessful here in Europe , and he somehow has managed to manage his childrens careers and still have a close relationship with them. Guess he learned from his fathers mistakes.

At 80, reports still have Joe clubbing and traveling a lot. He shows up on the red carpet with young women with their breasts hanging out and skimpy dresses. For him to be legally married to Katherine over 50 yrs he's never shown her any respect in public.

If Katherine is going to act like she did in court, I say bravo. It's about time she makes her own decisions and not allow her boys or Joe talk her into haggling the estate for their support. Michael is gone now. The financial support of others ended the day he died.

With the lifestyle he lives today, I guess that's why he beat the h*ll out of Michael.

Why couldn't it had been Joe that d.ied instead of Michael? Joe beat MJ and his brothers to turn them into money making machines back in the late 1960's and 1970's. He was verbally abusive and cruel. He ignored his son's emotional problems and did not seek professional help (which he needed). The man was crying out for love from his father and never got it. He also had sexual confusion, body dysmorphic disorder, anorexia, obsessive compulsive, etc., etc. His mother put him on a religious guilt trip in my opinion. She also allowed her husband to abuse their kids. His father was constantly mooching off his son and mismanaging his money, then asking for more money and MJ basically supported his whole family. No wonder the man had major issues. It's amazing he became the superstar that he did with all of the pressures on him. He also managed to give millions to charity. Despite all of his problems he was trying to make a comeback when he died of propofol and various benzodiazapine overdose which were administered by an incompetent doctor who was introduced to him by his father, Joe Jackson and was being paid by A.E.G. according to the interview given last week by Dr. Klein (his dermatologist) to TMZ. Joe Jackson shouldn't get a dime.

Joe Jackson doesn't deserve an allowance he needs a kick in the a**.

They should go after the plastic surgeon as well, what kind of doctor does that many rhinoplasties on a single patient. A patient with emotional issues who needed therapy, not endless plastic surgeries. Where is the medical board. Would they allow other patients to undergo endless operations on a body part they perceive to be imperfect? The doctor basically destroyed MJ's nose, he should lose his medical license imo. I was so shocked when I saw the Bashir interview years ago, a once good looking man's features nearly destroyed by a greedy surgeon. So sad.

If Joe Jackson is 80 or 81 and has no job maybe he should scale down his quality of living. If you have no job why do you have to travel so much. I suggest that he gets cable tv because they have a great travel channel. Living large with no money is very hard to do.

Because families EXPECT to be supported once someone in the family makes it big. I think it's selfish. I'd only support my children and mother in this case. MJ should've specifically written that all others were not to get any of his money.

JJ blew the J5's investments that's why the other boys have no money so they looked to the cash cow for support, Michael.
