Huckabee's Clemmons Decision Questioned After Shootings

LITTLE ROCK, Ark. — As governor of Arkansas, Mike Huckabee had a hand pardoning or commuting many more prisoners than his three immediate predecessors combined. Maurice Clemmons, the suspect in Sunday's slaying of four Seattle-area police officers, was among them.

For a politician considering another run for the White House, Clemmons could become Huckabee's Willie Horton.

Prosecutors have said Huckabee, a Southern Baptist preacher, was more inclined to release or reduce the sentences of prisoners if he had direct contact with them or was lobbied by those close to him. Clemmons' letter perhaps appealed to Huckabee's Christian faith.

In his application for clemency, Clemmons wrote that he prayed Huckabee would show him compassion and said at the time of his crimes he had just moved to Arkansas from Seattle. Clemmons also wrote that he had changed his life since "the angel of death has visited and taken away my dear sweet mother."

At Salon, Joe Conason reports that Huckabee has a pattern of releasing violent criminals after interventions by fellow Baptist preachers or professions of Christian faith by the inmates themselves. Wayne Dumond is one such case; in another instance the public outcry was so strong that Huckabee was forced to reverse his decision.

"So if people are wondering why Mike Huckabee took it upon himself to grant clemency to Maurice Clemmons, look for a religious angle," wrote Barbara at Mahablog. "I don't know that there is one, but I'll be surprised if there isn't."

In 1989, Clemmons, then 17, was convicted in Little Rock for aggravated robbery and other charges and sentenced to 108 years. Between 1989 and 1998, Clemmons broke prison rules more than two dozen times – sometimes violently, said state prison system spokeswoman Dina Tyler.

Clemmons didn't stay out long. He was convicted of robbery in Ouachita County in 2001, but was released again in 2004 by the parole board. Little Rock police say Clemmons also faced charges here in 2001 but prosecutors dropped the additional charges when Clemmons was released a second time.

Clemmons also had the backing of Pulaski County Circuit Judge Marion Humphrey, who urged the board to grant clemency. Humphrey later presided over Clemmons' 2004 wedding in his court chambers.

Huckabee cited Humphrey's support Monday and noted local prosecutors didn't object to Clemmons' commutation. Jegley said his office doesn't have any record that the governor notified him of the intention to grant clemency.

"In a primary between a law-and-order Republican and him, I think it could definitely be a vulnerability," said Art English, a political scientist at the University of Arkansas at Little Rock. "It is very damaging when you have someone like that whose sentence was commuted. That's pretty high profile and very devastating and very tragic."

English said it's hard to avoid comparing the case to Horton, a convicted killer who raped a woman and assaulted her fiance while on release as part of a prison furlough program supported by Michael Dukakis when he was governor of Massachusetts.

Allies of former President George H.W. Bush ran ads criticizing Dukakis for his support of the program, undermining the Democrat's presidential campaign.

As recently as Sunday, hours before the shooting suspect was linked to him, Huckabee said he was leaning against running again for president, telling "Fox News Sunday" he was "less likely rather than more likely" to run.

On Monday, Huckabee said he takes responsibility for making Clemmons eligible for parole in 2000, and called the case a failure of the justice systems in Arkansas and Washington. Huckabee cited the length of Clemmons' sentence – 108 years – and a state judge's recommendation that it be reduced as factors in his decision.

"If I could have known nine years ago that this guy was capable of something of this magnitude, obviously I would have never granted a commutation. It's sickening," Huckabee said on Fox News Channel's "The O'Reilly Factor."

Clemmons was among 1,033 people who were pardoned or had their sentences reduced during Huckabee's 10 1/2 years as governor. Bill Clinton, Frank White and Jim Guy Tucker granted 507 clemencies in the 17 1/2 years they served. Beebe, Huckabee's Democratic successor, has issued 273 commutations and pardons since taking office in January 2007 – all but one of them were pardons after the completion of the inmates' prison terms.

Huckabee's role in gaining the release of a convicted rapist, Wayne DuMond, was the subject of an attack ad during his presidential run. While Huckabee's predecessor, Tucker, reduced DuMond's sentence making him eligible for parole, Huckabee took steps almost immediately after taking office to win DuMond's release.

Two members of the state parole board said Huckabee pressured them to show DuMond mercy, while Huckabee publicly questioned whether DuMond was guilty of the rape of a teenage girl. During the presidential primaries, a conservative group aired television commercials in South Carolina featuring the mother of Carol Sue Shields, whom DuMond killed in 2000 after his release.

Pulaski County Prosecutor Larry Jegley, whose office opposed Clemmons' parole in 2000 and 2004, said Huckabee created a flaw in the Arkansas justice system by freeing the number of prisoners he did.

"(Clemmons) should have stayed locked up like the jury wanted him and we wouldn't even be having this discussion," Jegley said.

"I just have been figuratively holding my breath and hoping something like this wouldn't happen," Jegley said. "I just think that a lot of the people that were subjects of clemency during that period of time were some very dangerous people who didn't need to be let out."

Huckabee said Monday that Clemmons was allowed back on the street because prosecutors "failed to file the paperwork in a timely way." Jegley said the charges were dropped because the warrant wasn't served in a timely manner and because there was trouble locating witnesses to the 2001 robbery.

Jegley called Huckabee's comments "red herrings."

"My word to Mr. Huckabee is man up and own what you did," Jegley said Monday night.

Months after his 2004 release, Clemmons was named as a suspect in an aggravated robbery at a hotel in Little Rock but he was not charged.

Saline County Circuit Judge Robert Herzfeld, who as a prosecutor successfully sued Huckabee over clemency practices, said Huckabee's decision to give Rolling Stones guitarist Keith Richards a pardon for a 1975 traffic offense after meeting him at a concert showed how lightly the ex-governor approached the practice.

"That just said volumes about how he considered this serious ultimate power over freedom as a joke," Herzfeld said.

Obama and the FBI were clearly responsible for the recent military assassinations in CA. Muslim Fundamentalist Terrorism! How can we pin this on Obama? Do we know if Clemmons went to any Rev Wright sermons? In person? on the Web? Did he train in Kenya? Was he one of Obama's Healthcare consultants( in charge of death panels)? Was he an out of work Acorn worker? Since the police were white, he was clearly a racist...a­nother link to Obama. Now I am not saying that this is the case, but you can't rule it out....let­'s be Fair and Balanced Right?

Maybe Glen Beck can explain it all this evening because I have such a hard time figuring this stuff out all by myself.

Who ever titled this article is an ign.orant m0.r0n. Huckabee did not pardon Clemmons. Learn the difference between a pardon and clemency/commuting sentences.

LOL... I see that someone read the post or got the message and changed the headline to read, "Huckabee's Clemmons Decision Questioned After Shootings".

Of course the tag still incorrectly says "Huckabee Clemons Pardon", incorrectly spelling Clemmons and still mistakenly calling the action a pardon. Sigh....

I live in Washington State, and prior to killing the four Lakewood, WA Police Officers he was out on bail for rape of a child and other sexual deviant crimes. He got out on bail because it was over a holiday weekend and he didn't have to go in front of a judge to be reviewed. He just needed to post bond.
It's horrible! He should never have been released to the public.

I have not heard that. The only reason Huckabee has given was based on the recommendation by the judge due to Clemmons age (16) at the time of the crime.

Sure, it couldnt have been that a 100 yr plus sentence for a 16 yo who commited crimes with no weapon was at all out of line....Probably also had nothing to do with the judge who sentenced him saying that commuting some of the sentence was a good idea...And he probably bribed the parole board that unanimously voted to grant his parole...then he forbade the prosecutor filing charges when Clemmons violated parole...and THEN he....

The centerpiece of Clemmons request for clemency were that he had returned to Christian faith and that he had "been raised by a good Christian family". Even though he had numerous jail discipline problems the Clemency request was supported by Judge Marion Humphrey, who is also a Presbyterian pastor at Allison Memorial Presbyterian, in Little Rock and obtained a Divinity degree before going to Law School. On Anderson Cooper tonight Humphrey admitted his own religious faith led him to grant mercy to Clemmons.

So a guy with over 100 years on his sentence, somehow gets out because of "Christian mercy" and a faux conversion...after 9 years served. Then he re-offends and gets out again in TWO years!

Hell...the woman who refused to tell lies about Clinton to Ken Starr was in jail for longer than THAT..and she was only held "in contempt".

I understand the chief reason he agreed to the commutation was due to the presiding judge's recommendation to commute his sentence from 108 years to 47 because Clemmon's was 16 when he committed the criminal act. The prosecutors did not respond to requests to weigh in on the case until after Huckabee commuted the sentence. The woeful late response from prosecutors on responding here and then the lack of speed in levying later charges (it took at least 3 years) after he was returned to prison to complete his first sentence after he violated the terms of his parole is kind of disturbing.

I am not going to point the finger directly at Huckabee and say it is his fault that those 4 Police Officers were murdered. It appears that there were a lot of breakdowns not only in Arkansas but also Washington's criminal justice system.
But Huckabee needs to do a better job and own up to his personal responsibility in this matter. For him to say I accept responsibility then turn right around and blame the state of Arkansas is a load of bs. It's almost as if he's saying yes I did it, but they never should have allowed me that power to begin with.
Yes, it appears that a lot of other people screwed up and this guy should never have been on the streets if DA's and Judges would have done their job as well. But please stop defending Huckabee based on other peoples actions. He should stand up and say, Yes, I did it. I took a chance on a young man and acted when I didn't have all the facts, and now I'm partially responsible for his actions. Going on friendly TV turf and receiving absolution from TV commentators is sickening.

If he hadn't commuted the killer's sentence then no parole board would have had a chance to release this guy and he would never have even been in Washington State. Blame anyone else you want but Huck is the responsible party.

Sviolette- Maybe you missed this sentence in my post. This post is not about blaming anyone else. It's about Huckabee accepting his own personal responsibility for acting without having all the information in front of him.

Huckabee DID take responsibility for his actions. And his actions had exactly zero point zero zero one percent (0.001%) to do with the end result.

You may be surprised to learn that governors are very very busy almost all of the time. They, like any other executive (including Barry), rely on others to provide them with the information they need to make decisions and don't have a lot of time to follow up as they are on to the next issue. He commuted the sentence because a respected judge lobbied for this guy, who was sentenced to a 108 year sentence when he was 16 years old. The governor reduced his sentence to 47 years. Still a long long time, but he had served only 11 years of the sentence.

If you want to blame people for allowing this bastage to remain on the loose, you may want to question his parole officer, who must have lost track of him when he left Arkansas (in violation of parole). Or you try to find out why he wasn't extradited back to Arkansas during any of his numerous arrests in Washington state. You might want to find out why judges in Washington state allowed him to post a minimal bail when they knew he had many arrests for serious crimes when he came before them.

The hate, blame and religious bashing against Gov. Huckabee is purely the result of anti-Christian and anti-GOP hate mongering and nothing else.

There's going to be all kinds of republican hypocrisy to go around starting with O'Reilly. Huckabee will get sympathy from his cohorts -- for now. If he does throw his hat in the ring and decides to run again, we'll see another side from his cohorts come the primaries. Right now it's "we all make mistakes", come 2012 we'll see "Huckabee: tough on crime?" They'll go Horton on him all over again. They won't be able to stop themselves.

If Clemmons was truly saved, then why didn't Huckabee leave that to God? Shouldn't an elected official be more concerned about how the people living in his state (and country) than what happens to them after they die?

I wonder if Huckabee was more concerned about what was going to happen to Clemmons after death than his current earthly behavior. After all that's what "saving" is all about. It has nothing to do with deeds, but it has everything to do with accepting Jesus as your savior. As long as you accept Jesus as your Lord and Savior before you die, then murder and rape are just like any other garden variety activities.
