URUMQI, China — China on Tuesday executed a British man convicted of drug smuggling in its first execution of a European citizen in half a century, drawing a strong condemnation from Britain's prime minister.

Britain's Foreign Office confirmed the execution of Akmal Shaikh, whose relatives say was mentally unstable and was unwittingly lured into the crime.

"I condemn the execution of Akmal Shaikh in the strongest terms, and am appalled and disappointed that our persistent requests for clemency have not been granted. I am particularly concerned that no mental health assessment was undertaken," British Prime Minister Gordon Brown said in a statement issued by the Foreign Office.

Shaikh, 53, was the first European citizen to be executed in China in five decades.

Shaikh first learned of his death sentence Monday from his visiting cousins, who made a last-minute plea for his life. They say he is mentally unstable and was lured to China from a life on the street in Poland by men playing on his dreams to record a pop song for world peace.

Brown had spoken personally to China's prime minister about his case.

Shaikh was arrested in 2007 for carrying a suitcase with almost 9 pounds (4 kilograms) of heroin into China on a flight from Tajikistan. He told Chinese officials he didn't know about the drugs and that the suitcase wasn't his, according to Reprieve, a London-based prisoner advocacy that helped with his case.

He was convicted in 2008 after a half-hour trial. In one court appearance during his trial and appeal process, the judges reportedly laughed at his rambling remarks.

It was not known how Shaikh, who is of Pakistani descent, was executed. China, which executes more people than any other country, is increasingly doing so by lethal injection, although some death sentences are still carried out by a shot in the head.

An Associated Press reporter who was detained Tuesday by paramilitary police while trying to take pictures of the Xishan Detention Center, where Shaikh was held during his incarceration, was told by a prison police officer who refused to give his name that prisoners in the Xinjiang region were all now executed by lethal injection.

The officer said Shaikh did not appear to have mental problems, was friendly with other prisoners and had learned to speak a little Chinese while detained.

China has defended the handling of Shaikh's case, saying he received a fair trial.

"Drug smuggling is a grave crime. The rights of the defendant have been fully guaranteed," Chinese Foreign Ministry spokeswoman Jiang Yu told a news conference last week.

You know China is one that isn't forgiving when it comes to crimes, so if you did a pretty bad thign there and you're sentenced to death, pretty much your fate is sealed.

A few thoughts about mental illness...
Part 1

In my country, mental illness was, in the past, seen as a sin, a prima facia crime, and ads an excuse to lock innocent people up in mental "hospitals" forever.

In America there is no empirical medical method for determining mental illness. Therefore, in the past people were "accused" of being mental, while today people are dxed as being mental. Little has changed in "ordinary" people's understanding of what mental illness is, and how it affects what control a person has over his behavior and thoughts.

Here are some bery basic true facts...

1. Mental illness is ubiquitous, with millions of Americans living and working with mental illness.

2, Some people who commit crimes have been accused, or dxed with mental illness.

3. Some people who commit crimes have never been accused or or dxed with mental illness.

4. Some lawabiding citizens have been accused or dxed with mental illness.

5. Some law abiding citizens have never been accused or dxed with mental illness.

6. Research shows that people with mental illness are not predisposed to commit crimes.

7. In the past, in the US, some people, and some laws supported "emotional distress" as an acceptable excuse for murder. One example was Maryland law that said a man returning home from work, and finding his wife in bed with another man was justified in killing them because it was a crime of passion. Today we do not accept emotional distress nor other "mental" illness excuses as reasons that people commit crimes. We also have adopted domestic violance laws to protect women from men who may become momentarily "mental" and beat them, or worse.

For those of you who are howling about the abuse or ill treatment of this criminal in China, based on your view that he was so mental he could not help himself, I ask you this...Do you want to go back to the system of locking up people who are acused of mental illness upon their diagnosis, and never giving them a chance to break the law? Would that be more fair? Or do you believe that we should allow those dxed with mental illness to be "used" as drug runners, because they can then use the mental excuse to avoid any death penalties?

Just how do you propose to have law and order if the mentally ill are allowed to live free in society, and never held accountable for their crimes?

3) The legal representative of the accuased have repeatly claim his mental state as the explanation for his behaviors. Yet the legal representatives had unable to produce any prior documentations and medical records of his claimed mental illness. Personal accounts do not qualified as legal evidence in court. In addition, British government has failed to produce any of his medical records that serve as the context to grand him medical examination.

4) According to Chinese laws, medical examinations are not automatically granted. There must be criterias met before the court considers this action. As far as the court is concerned, the accused and his legal reprentives have not provide sufficent evidence for the court to make such a grant. Almost all criminals facing heavy sentence request for medical examination on their mental states. As a result, such a grant is conditional.

5) The conclusion from the court is that the accused does not even qualified to grant the rights for medical examination, much less on clenmency. Given the fact that it is a clear cut case of drug traffcing case, the court has delivered the sentence as such.

Regarding some posts discussing on the lack of medical examination for the accused. Here is the response from an legal expert in this case on the China side on Dec 30th:

1) China has its own set of procedures on determining if an accused can be granted medical examination on his menetal state. There are two criterias: a) visual and physical determine if the accused can recognize himself and recognize his own actions. 2) medical standard, including extereme case of bi-polar where the individual can not recognize his own actions

2) The cases of mild bi-polar, personality metaphorsis, unusual display of personality, extreme case of stubborness are all not considered excuses for clemency and thus do not warrant medical examination

Actually no. Chinese court has explicitly states that mental illness by default does not gurantee any form of clemency. It is only when extreme case of mental illnes that can be provided as consideration for clemency.

In order for court to grant medical examination in case of extreme case of mental illness, the accused must demonstrate such an extreme case and provide prior medical record for the case.

You can not simply claim that court did not grant the accused medical examination and used it as the basis of your criticism.

Get real and deal with it.

I suspect that Chinese may discriminate against Muslims and people of color the same way White Americans in Southern States used to discriminate against Blacks. Chinese may have lots more respect for Whites.

He's not far off of the mark: there have been reports for many years of discrimnation against Africans who attend university in China, and it has become a popular proceedure for Chinese to have their skin whitened.

I've flown in and out of Tajikistan before.

First, a westerner needs a visa. They aren't too difficult to get, but require some effort, including a letter of invitation and a statement as to the purpose of your visit. It takes some paperwork and time. If someone was so mentally incompetent that they didn't know whose suitcase they were carrying, it is doubtful they could do the paperwork to get there in the first place.

Second, while their security isn't up to western levels, they have it. It is very doubtful you can just grab an unknown suitcase full of drugs and walk onto a plane - unless someone was bribed. To get him on the plane there had to be a support network of some type - give him the suitcase and bribe the customs officials.

Now, the man might have been set up. But he knew that wasn't his suitcase. If you have enough intelligence to get to Tajikistan, move around the country for a while, and get on a plane to, you have enough to ask why someone wants you to carry their luggage and what's in it.

It is very easy to win someone's trust and ask him to do you a favor. If you are not aware of the drug trade and the penalty for drug trafficking, you would not imagine that you are asked to do something so dangerous for someone else. I have been used before. So I know how people can be fooled into doing something against their own interest.

Let's get more to the point with the right questions to ask: On the very day that Admal Shaikh decided to carry nine pounds of heroin onto a plane, was he guilty of misjudgment because he thought he would get away with it or was he in fact able to say to himself ,

"I am carrying nine pounds of heroin onto a plane to China where they execute people no questions asked for drug smuggling. Do I understand and know this is what I am doing with this case of heroin as I am now walking on the plane?"

If he was truly a setup victim who truly did not know right from wrong as he was carrying a nine pound case of heroin onto a plane such as a person with severe mental illness, he is indeed a victim.

Has anyone made that claim? I haven't seen a source on that yet.

In this life you may indeed be a victim of other people ruining your life by declaring false statements about you, libel and slander packaged in many devious, vengeful ways by your enemy. The examples of injustice and unfairness resulting in humans young and old, rich and poor, famous or unknown becoming victims, are endless.

When I, a Chinese citizen, was duped by a Chinese into committing a crime in America, I was treated as a victim of a crime by the US government. This man was duped by a Chinese into committing a crime in China. And he was treated as a criminal by the Chinese government. America, for all of its short comings, is still more passionate than China, I think.

The court of the land has made the conclusion that he is guilty. This has gone through the criminal court, high court and supreme court of China. He got two appeals, just like everyone else in that land.

As a wheel chair warri*or who has no or little information other than speculations, you are in no position or right to question the court decision in the country that this drug trafficker dum*b enough to venture in.

The revulsion expressed by Gordon Brown has nothing to do with opposition to the death penalty, doubts about the guilty verdict or interference in China's sovereign right to implement its own laws on its own territory. It is all about the Chinese government's refusal to permit a medical examination to determine whether or not the man they were about to execute was mentally ill. Under China's legal system, clemency is normally granted where mental incapacity is proved. Nobody was asking for special treatment for this man, just the same chance of a medical review as would any Chinese citizen.

There are two recent cases in which Chinese people have been sentenced for manslaughter and murder in England. None was sentenced to death, because the death penalty was abolished 40 years ago. In one case, a Chinese gangmaster who caused the drowning of 21 Chinese cocklers in Morecambe was sent to prison for 14 years. In another, a Chinese illegal immigrant who brutally murdered a Chinese couple in Newcastle was sent to prison for life, with a minimum term of 33 years, earlier this year. In the latter case, in particular, there was great interest in China, so the English authorities allowed television access to some of the proceedings, which were thus watched by half a billion people. The trial was transparent and the English authorities did all they could to involve the Chinese government and other stakeholders. Compare this with the rough treatment offered to a British citizen.
