Obama Moves To Curb Federal Secrets, Encourage Declassification

WASHINGTON — President Barack Obama on Tuesday ordered the federal government to rethink how it protects the nation's secrets, in a move that was expected to declassify more than 400 million pages of Cold War-era documents and curb the number of government records hidden from the public.

Among the changes is a requirement that every record be released eventually and that federal agencies review how and why they mark documents classified or deny the release of historical records. A National Declassification Center at the National Archives will be established to assist them and help clear a backlog of the Cold War records by Dec. 31, 2013.

Obama also reversed a decision by President George W. Bush that had allowed the intelligence community to block the release of a specific document, even if an interagency panel decided the information wouldn't harm national security.

Advocates for a more open government are cautiously cheering the move.

"Everything will depend on implementation," said Steven Aftergood, director of the Project on Government Secrecy at the Federation of American Scientists. But the order "has tremendous potential to reduce the level of secrecy throughout the government."

In a memo to agency heads, Obama said he expects that the order will produce "measurable progress" toward greater openness in government while also protecting the nation's most important secrets.

"I will closely monitor the results," he promised.

The still-classified Cold War records would provide a wealth of data on U.S.-Soviet relations, including the Soviet invasion of Afghanistan, the fall of the Berlin Wall, diplomacy and espionage. A Soviet spy ring in the Navy led by John Walker headlined 1985, which became known as "The Year of the Spy."

On his first day in office, Obama instructed federal agencies to be more responsive to requests for records under the Freedom of Information Act and he overturned an order by Bush that would have enabled former presidents and vice presidents to block release of sensitive records of their time in the White House.

The government spent more than $8.21 billion last year to create and safeguard classified information, and $43 million to declassify it, according to the Information Security Oversight Office, which oversees the government's security classification. The figures don't include data from the principal intelligence agencies, which is classified.

Are the kooky right wingers really still pushing the Obama birth certificate nonsense? Let's see. nine separate courts have looked at this and tossed it. The United States Supreme Court has looked at this twice and tossed it. The Republican governor of Hawaii looked at this and confirmed Obama was born there. The head of the Hawaii Office of Vital Statistics has verified Obama's birth certificate. Fact Check.com, funded by the Annenberg Foundation, a Republican foundation, looked at it and verified it. There are birth announcements from two Hawaii newspapers from August of 1961 showing Obama was born in Hawaii. The Office of Vital Statistics placed the announcements.

Honestly, why does the far right keep making fools out of themselves? They even tried to present in court a bogus Kenyan birth certificate. L-O-L

Thats not the American way. The American way is to keep most of it closed, and what is released will be mostly fudged over. See, in the last 50 years the American way is to keep lying about so many things as much as you can, that no one has a clue of what is really going on.

In the first months of President Jimmy Carter's Administration, his Attorney General released a "Justice Department Advisory" to all federal agencies and administrations. When Carter came into office, they found a huge back log, hundreds of thousands, if not millions, of pending FOIA requests going back three or more years.

All documents were withheld under alleged "classsified, national security highly classified, or other flimsy excuse "not to release". The Attorney General issued a memo to Cabinet Appointees stating that unless a document fell under specific criteria, as codified by a national security official or the DOD, "when in doubt, release". Within less than 6 months of the Carter Administration, the back log was cleared out with a waiting period of no more than six weeks to three months.

Ronald Reagan came into office after Carter's one term. One of his first acts, was to rescind the "when in doubt, release" executive order to all FOIA officers. To the best of my memory Bill Clinton, shrugged off the issue. I donot recall his administration doing anything about Reagan's directive to withhold.

I was quite surprised that it took Attorney General Holder this long, to getting around to address the issue. A large amount of the massive back log of FOIA requests are in a fuzzy area that requires a FOIA Officer's "judgement" call. That's why Carter's Executive Order, "when in doubt, release" was so historic and a breath of fresh air.

But the most important thing he did was to overturn George W. Bush's order that allowed "former presidents and vice presidents to block release of sensitive records of their time in the White House." Come on, Do we really have to let former Presidents and in this case FORMER VICE PRESIDENTS BLOCK THEIR OWN RECORDS!!!! That's already happened. No wonder Cheney is having a fit. Wait till they get through all millions of deleted Bush era emails that were deleted.

You dont get it do you? Obama has to go after them. He has no choice, Legally if he refuses its considered obstruction of justice, not just a penalty, but a federal crime as it is seen as acting in collusion to hide crimes committed here and abroad. The world is watching him, and how he responds could ellicit the mother of all international trials, that even past and present presidents cannot wiggle out from under. War crimes were committed here and abroad, along with several cases of crimes against hummanity and the staging of illegal wars for profit and personal gains. Federal crimes. Former CIA ops have stated they know crimes were committed and Cheney and Rumsfeld have more to worry about than Bush. Bush will be forced to testify against the two in exchange for fines and impeachment. They have serious worries as too many people know of thier crimes and who they hired to carry them out. Obama has no choice but to comply with the law.

Ok. So I may have to give Obama credit for doing something good. However, the devil's in the details.

Is this two steps forward before a hasty retreat? Will the implementation have obstacles and loopholes?

Given Obama's apparent tendency to play up a theme for a headline and an election slogan, while detailed inspection highlights overall weakness, until proven, the jury's still out.

The mere appearance of effectively doing something, when reality proves otherwise in time, is often worse than doing nothing at all.

However, this already seems a very nice step in a better direction.
