Court Says Thimerosal Did Not Cause Autism

Autism

RANDOLPH E. SCHMID   03/12/10 09:09 PM ET   AP

WASHINGTON — The vaccine additive thimerosal is not to blame for autism, a special federal court ruled Friday in a long-running battle by parents convinced there is a connection.

While expressing sympathy for the parents involved in the emotionally charged cases, the court concluded they had failed to show a connection between the mercury-containing preservative and autism.

"Such families must cope every day with tremendous challenges in caring for their autistic children, and all are deserving of sympathy and admiration," special master George Hastings Jr. wrote.

But, he added, Congress designed the victim compensation program only for families whose injuries or deaths can be shown to be linked to a vaccine and that has not been done in this case.

The ruling came in the so-called vaccine court, a special branch of the U.S. Court of Federal Claims established to handle claims of injury from vaccines. It can be appealed in federal court.

The parents presented expert witnesses who argued mercury can have a variety of effects on the brain, but the ruling said none of them offered opinions on the cause of autism in the three specific cases argued. They testified that mercury can affect a number of biological processes, including abnormal metabolism in children.

Special master Denise K. Vowell noted that in order to succeed in their action, the parents would have to show "the exquisitely small amounts of mercury" that reach the brain from vaccines can produce devastating effects that far larger amounts ... from other sources do not. The ruling said the parents were arguing that the effects from mercury in vaccines differ from mercury's known effects on the brain. Vowell concluded that the parents had failed to establish that their child's condition was caused or aggravated by mercury from vaccines.

Friday's decision that autism is not caused by thimerosal alone follows a parallel ruling in 2009 that autism is not caused by the combination of vaccines with thimerosal and other vaccines.

The cases had been divided into three theories about a vaccine-autism relationship for the court to consider. The 2009 ruling rejected a theory that thimerasol can cause autism when combined with the measles-mumps-rubella vaccine. After that, a theory that certain vaccines alone cause autism was dropped. Friday's decision covers the last of the three theories, that thimerosal-containing vaccines alone can cause autism.

The ruling doesn't necessarily mean an end to the dispute, however, with appeals to other courts available.

The new ruling was welcomed by Dr. Paul Offit of Children's Hospital of Philadelphia, who said the autism theory had "already had its day in science court and failed to hold up."

But the controversy has cast a pall over vaccines, causing some parents to avoid them, he noted, "it's very hard to unscare people after you have scared them."

On the other side of the issue, a group backing the parents' theory charged that the vaccine court was more interested in government policy than protecting children.

"The deck is stacked against families in vaccine court. Government attorneys defend a government program, using government-funded science, before government judges," Rebecca Estepp, of the Coalition for Vaccine Safety said in a statement.

SafeMinds, another group supporting the parents, expressed disappointment at the new ruling.

"The denial of reasonable compensation to families was based on inadequate vaccine safety science and poorly designed and highly controversial epidemiology," the goup said.

The advocacy group Autism Speaks said "the proven benefits of vaccinating a child to protect them against serious diseases far outweigh the hypothesized risk that vaccinations might cause autism. Thus, we strongly encourage parents to vaccinate their children to protect them from serious childhood diseases."

However, while research has found no overall connection between autism and vaccines, the group said it would back research to determine if some individuals might be at increased risk because of genetic or medical conditions.

Meanwhile, in reaction to the concerns of parents, thimerosal has been removed from most vaccines in the United States.

In Friday's action the court ruled in three different cases, each concluding that the preservative has no connection to autism.

The trio of rulings can offer reassurance to parents scared about vaccinating their babies because of a small but vocal anti-vaccine movement. Some vaccine-preventable diseases, including measles, are on the rise.

The U.S. Court of Claims is different from many other courts: The families involved didn't have to prove the inoculations definitely caused the complex neurological disorder, just that they probably did.

More than 5,500 claims have been filed by families seeking compensation through the government's Vaccine Injury Compensation Program, and the rulings dealt with test cases to settle which if any claims had merit.

Autism is best known for impairing a child's ability to communicate and interact. Recent data suggest a 10-fold increase in autism rates over the past decade, although it's unclear how much of the surge reflects better diagnosis.

Worry about a vaccine link first arose in 1998 when a British physician, Dr. Andrew Wakefield, published a medical journal article linking a particular type of autism and bowel disease to the measles vaccine. The study was later discredited.

New parents should research vaccines, find out the ingredients, and also consider their child's own medical history (bowel problems, food allergies, etc.) and design individualized vaccine schedules instead of following the CDC's one-size-fits-all recommendation.

Today, Global health leaders dropped a major bombshell, announcing that at least 9 billion people have been exposed to contamination with fragments of micro-organisms as a result of animal contact in the last few months.

As a precautionary measure, the WHO has advised a recall on all animal products labelled for human consumption. National Agencies are advising consumers not to panic, as previous similar alerts have resulted in rioting and widespread buchering of domestic animals, farm animals and pets.

However, they are also advising anyone who has had contact with any animal or who has ever eaten an animal product to see their emergency physician immediately, as it is feared that the contamination will result in longterm medical damage and possibly death. Alerts have been issued to healthcare agencies and funeral directors to upscale their activity in anticipation for the thousands of illnesses and deaths that will occur just from hearing of the announcement.

The antivaccine alliance endorses and supports these actions, since no risk is too small to be ignored (even when the risk comprises no risk).

How about linking to the actual story instead of Drudge.

http://www.cnn.com/2010/HEALTH/03/22/rotavirus.vaccine/

Read the full story. The virus in question is not known to cause any disease in humans. Also, it is not the actual virus that was in vaccine, but DNA from the virus. There is no indication that it ever had any effect on humans. However, since it is considered a contamination, use of the vaccine in question has been stopped for the US (other countries are apparently still considering it).

As a comparison, the food you eat is contaminated with far far worse.

Kind a disproves the whole conspiracy thing, doesn't it?

Anybody, anywhere can do tests on vaccines.

"The FDA learned about the contamination after an academic research team using a novel technique to look for viruses in a range of vaccines found the material in GlaxoSmithKline's product and told the company,"

Guess how the FDA learned of it?
Seems to me it was from the company.

Principaldad,
You missed the entire point of my post. HOW is it that vaccines
are becoming contaminated and why wasn't it discovered UNTIL 30 million
kids were already given the shot? And you echo the claim that "the virus
in question is not known to cause any disease in humans". Really?
Where are the LONG TERM studies that can back that claim?
Aren't we being told this by the same people who CAN NOT manage
to keep their own vaccines from getting contaminated?

"Hey kid...sorry about the contaminated vaccine. Tell ya what...
let me make it up to you. Stop by the front desk on the way out and

I am amazed---Plaintiff's experts at Thimerosal trial largely agreed with defendants on causes of Autism
-------------------
Some qualifications have been left out. I urge everyone to go read at least this part of the decision.

Quote: "Three basic points concerning the causation of autism, which are well-accepted AND NOT DISPUTED [emphasis added] by the petitioners in this case, are relevant here."

..."The first basic point is that there is a very strong genetic component to the causation of autism...[long snip]...The second basic point is that some specific non-genetic factors have been identified and accepted as factors in causing autism, but those consist of exposures during the early prenatal period....[long snip] ...The third basic point is that autopsy studies, comparing brains of autistic children to those of non-autistic children, indicate that the autistic brains show a number of different abnormal features that of necessity would have occurred during specific parts of the prenatal period, as the unborn child developed...
http://www.uscfc.uscourts.gov/sites/default/files/Hastings.King%20Decision.pdf starting at page 38.

Here is the first sentence again, "Three basic points concerning the causation of autism, which are well-accepted AND NOT DISPUTED by the petitioners in this case, are relevant here."

I was surprised, to say the least. I haven't been following the causes of autism carefully. I knew it was strongly genetic but this surprised me.

"Autopsy studies of Autistic children compared to non-autistic children".

Where is the study? What are the numbers? How can they claim that
the "abnormality's " all occurred during prenatal gestation? What about the
cases of children who were developing normally and did not show any
signs of "Autism" until they were two or three years of age? Just because
the petitioners DID NOT DISPUTE the "basic points concerning the causation
of Autism" DOES NOT mean that they actually KNOW what the causes are.
If there is a "very strong genetic component to the causation of Autism"
then why hasn't it been identified? Where is the evidence for this "component"?
I would put more stock into a Genetic cause for Autism if the rate were one in
ten-thousand. But one in ninety? I don't buy it...

I thought that 'regressive autism' was medically/scientifically different from other types of autism. You certainly would think so. There seems to be a fairly recent consensus that it isn't. The condition is set before birth. How and when it appears varies.

As for the rest, go read the decisions. Go read recent review articles. That way you can get a sense of where the current thinking is.

Conclusion
I am amazed---Plaintiff's experts at Thimerosal trial largely agreed with defendants on causes of Autism
-------------------
And on page 40.
"In their post-hearing briefs, the petitioners have pointed to a few items of medical literature suggesting that postnatal factors, in general, can contribute to the causation of autism I note also that two of petitioners’ experts, Drs. Kinsbourne and Aposhian, briefly discussed the fact that the condition known as “herpes encephalitis” has been proposed as a possible postnatal cause of autism. A brief analysis of this area of possible causation by postnatal factors, therefore, is appropriate here...[snip].... Rather, respondent’s experts opine only that there is currently no persuasive evidence that ANY (emphasis added) postnatal factors play a role , and that the above-described autopsy studies, showing brain anomalies in autistics that would necessarily have arisen prenatally, makes it seem unlikely that postnatal factors play any significant causal role in autism."

Please note that this is the judge's interpretation of what the witnesses said and wrote

Transcripts and many of the reports can be found using this index. Sorry, I can not find a transcript and exhibit index on the official court website for the Thimerosal cases.

Breaking News Many Suspected/New Warning About Everyday Poison Linked to Alzheimer's, ADHD, and Autism

http://articles.mercola.com/sites/articles/archive/2010/03/20/david-ayoub-interview-february-2010.aspx

Thank goodness doctors are coming forwad speaking out as Dr. Mercola does.

They don't like you receive his free news letters & become educated in matters of importance that could save the lives of your children, family memmbers & friends you love.

Vaccination began as something good & went bad along the way due to greed & too many looking the other way.

Errors must be admitted & corrected. Time to clean house & get back to the original purpose that actually had the well being of our people at heart.

Keep this interview in mind & facts like vaccinations contain traces of mercury & aluminum as you watch this eye opening experiment that gives one the idea of the "point" being made.

Brains, especially babies, are fragile & sensitive matter.

Who's to say how little wouldn't do the same harm in synergy to different degrees, in different children, similar to the extreme reaction in this clip?

In promising a new friend to send information on the dangers of mercury in fillings, not even attempting yet, to tell her of the dangers of too many vaccinations, I was overwhelmed by all the information to choose from.

I couldn't concentrate enough to decide what to send & began crying, instead, due to the helpless feeling of knowing many children remain in harms way.

Too many oppose truth with lies of deception, like they do in these blogs but there's a lot we can do to help our people.

Look up media email addresses. Hold them accountable in giving us all facts, on this & every other matter of importance that comes up. Use your voice to cover all the dishonest ones out there & demand fair reporting.

Sign up for newsletters like Dr. Mercola's, in the above link, to keep informed.

Above all, do your own research. They're counting on your not doing so & hope enough stay duped in order to continue the scam, just to keep that almighty dollar.

Do a search on "truth about vaccinations" & "truth about amalgam fillings"

It's all there in many pages of articles to study.

Watch for sites of the deception like "Quackwatch" who have been exposed & discredited. Look them up & see for yourself, too.

I read it. What got left out is the subject of this article, the thimerosal decisions in the 3 test cases.

The plaintiffs found an excellent, well-respected epidemiologist. He didn't find major faults with the studies. All he could say was that the studies could have missed the real rooting-tooting regressive autism. He had to make that up. He didn't think the studies missed regressive autism or plain autism, just his invented subset of regressive autism. Somehow or another , the other experts for the plaintiffs did not support his argument.

And that leaves out the whole theory of how thimerosal was supposed to cause autism, which was a disaster. Go read at least one of the court decisions. I recommend http://www.uscfc.uscourts.gov/sites/default/files/Hastings.King%20Decision.pdf

Herd Immunity - Vaccinating the Kids helps Others
----------------
One of the more ridiculous claims made by anti-vaxers is that there is no such things as herd immunity. Herd immunity is the concept that a higher rate of vaccination protects those who are unvaccinated or those in whom the vaccine did not result in a strong enough response.

A new study shows that a higher rate of flu vaccination in children can lower the rate of infection in a community. The result is similar to what happened in Japan when flu vaccination for children was required.

Herd immunity? Anti-vaxers? You're just full of media talking points. Lets just put to rest the anti-vax label since that is not what most of us stand for. We are for children's health. Anyway the theory of herd immunity in inarguably great, no doubt. But, in order for it to work everybody must be vaccinated and boostered since these vaccines only last for a few months to 12 years.

It is also interesting if you follow disease, the MRSA came to be due to the overprescription of antibiotics. There isn't any telling what we are creating in our children since there is any studies on the long term affects of vaccines and their toxins.

"But, in order for it to work everybody must be vaccinated and boostered since these vaccines only last for a few months to 12 years. "

That statement shows that you do not understand the concept of herd immunity. Not everyone needs to be vaccinated, just a high enough amount so as to prevent those who are unvaccinated from coming in contact with the actual disease pathogen. Herd immunity will work well as long as unvaccinated individuals stay away from other unvaccinated individuals.

Furthermore, herd immunity also protects those with weaker levels of immunity as those individuals with not be exposed to the same amount of pathogen as they would be if there are higher numbers of unvaccinated individuals.

That is why not vaccinating without any compelling, rational medical reason can cause outbreaks of disease as it makes it more likely that you will have a concentration of unvaccinated individuals. And if you have an unvaccinated individual at the center of an outbreak, dependent of the severity of disease, they can provide sufficient exposure to those who had weaker responses to the vaccine, who would not have developed disease if not for the contact with the unvaccinated diseased individual.

The black helicopters are circling......

The "doctors" who do research of this nature (epidemiological studies) have little if nothing to do with the pharmaceutical studies. Anyway if a link were to be demonstrated, then the current no-fault compensation schemes means that vaccine manufacturers would not be held directly liable.
All the current (and quite adequate) scientific evidence indicates that there is no appreciable vaccine-autism link. There is provision made for individual adverse reactions which might result in neurological damage (this can happen, rarely) with compensation available. The chance of a major connection between vaccines and autism is infinitessmal. If there were even a tiny fraction of autism cases that were caused by vaccines, the studies done so far would have been revealed this via the statistical methods employed for these studies.

Those epidemiologists thank members of and the pharmaceutical industry in there studies for their support and help in research and editing.

Soon the Supreme Court will decide whether drug makers can be sued by parents who claim their children suffered serious health problems from vaccines. Hopefully the National Childhood Vaccine Injury Act will be overturned.

The quite adequate scientific evidence you speak of only tests the MMR and one ingredient thimerosal. There is 11 vaccines in the current CDC recommended schedule and 40+ ingredients. If you read this adequate evidence you will discover that they are rife with conflicts of interest, error in data collection and inadequate co-corts, or completely made up.

The CDC's and pharma's top scientist clearly state in the Simpsonwood transcripts that there is an undeniable link between vaccines and neurological disease and how to cover it up.

There are 300+ peer-reviewed studies that show a link between autism and vaccines and if you doubt they exist then you are keeping your eyes closed.

The autism community took a big hit this week with the Vaccine Courts ruling FOR SURE. The inconsistencies of this court are evident and it is the wish of many to move the appeal to a civil court and publicly televised. TRANSPARENCY

They're not in it together?.

Just do an internet search using, "faked studies and paid doctors to put their names on them" to see pages of massive proof. They didn't count on people doing the research & being smart enough to sort out disinfo & deception.

Fraud due to greed has been exposed & faking studies "IS" common practice to keep that almighty dollar.

There's many doctors coming forward in truth on this charade & cover up so the gig is up.

Part of the massive proof is the way they fight new studies we insist are done, this time, with over site by those we know have no vested interests.

If they have nothing to hide why don't they want new studies & fair debate?

That says it all!

It's time big pHARMa & their partners in crime are made to clean house, revamp & get back to the original purpose that actually has our well being at heart.

We're done being cash cows & guinea pigs & that's that.

The "herd" mentality has done more harm than good because too many sheeple do the research.

The trade off of childhood disease most recover easily from to other disease & all the harm, injury & death "was not worth it"

"They can have people take vaccination against serious disease seriously.

Or, they can sell people dangerous and unnecessary vaccines against less dangerous illnesses and have people lose all faith in vaccination.

They can't have both."

There's always bad with
