Lesbian Prom Date Ban VIOLATED Constance McMillen's Rights, Judge Says

JACKSON, Miss. — The prom's still off at a Mississippi high school that canceled it instead of letting a lesbian student bring her girlfriend, but a federal judge ruled Tuesday that the district's actions did violate the teen's constitutional rights.

U.S. District Judge Glen H. Davidson refused the American Civil Liberties Union's demand to force the Itawamba County school district to put on the April 2 prom. However, he said canceling it did violate 18-year-old Constance McMillen's rights and that he would hold a trial on the issue.

That would come too late for the prom to be salvaged at Itawamba Agricultural High School. Still, Kristy Bennett, ACLU Mississippi legal director, called the decision a victory.

The American Civil Liberties Union sued the district to force it to put on the prom and allow McMillen to bring her girlfriend and wear a tuxedo. School officials said in U.S. District Court this week that they decided to cancel it because McMillen's challenge to the rules had caused disruptions.

The judge noted that McMillen has been openly gay since she was in the eighth grade and that she intended to communicate a message by wearing a tuxedo and escorting a same-sex date.

"The court finds this expression and communication falls squarely within the purview of the First Amendment," Davidson said.

As for McMillen, she said she was happy about the ruling but doesn't know what to expect when she returns to school. She attended classes a day after the March 10 decision to cancel the prom. But she said the hostility and comments from other students led her to miss school. She skipped class on Tuesday to go to the doctor and the fight is taking a toll, she said.

"My nerves are shot," she said.

District officials said in a statement that they were ready to get back to educating students.

Davidson said a private prom parents are planning will serve the same purpose as a school-sponsored one. He wrote that "requiring defendants to step back into a sponsorship role at this late date would only confuse and confound the community on the issue."

McMillen isn't sure if she'll go to the dance.

"I'm going to school tomorrow (Wednesday) and will get a feel of how everybody feels about me. That will help me make my decision about whether I'm going to the private prom," McMillen said. "I want to go because all my junior and senior class will be there, but I don't want to be somewhere I'm not welcomed."

Ben Griffith, the school district's attorney, said his clients were pleased with the ruling.

"What we're looking at now is the fact that the case is still on the docket for a trial on the merits," Griffith said.

McMillen first approached school officials about bringing her girlfriend in December, and again in February. Same-sex prom dates had been banned in the past, but she had hoped school officials would grant her request.

"I thought maybe the policy had been in place for a different reason," McMillen testified at a hearing on the ACLU lawsuit. "I wanted to let them know how it made me feel. I felt like I couldn't go to the prom."

She was told two girls couldn't attend together and she wouldn't be allowed to wear a tuxedo, court documents show. The ACLU issued a demand letter earlier this month and the district responded by canceling the event. McMillen, who lives with her grandmother and has a 3.8 grade point average, has kept her 16-year-old girlfriend out of the spotlight at the request of the girl's parents.

District officials said they felt not hosting the prom was the best decision "after taking into consideration the education, safety and well being of our students." Superintendent Teresa McNeece said it was "a no-win situation."

The 715-student high school is located in Fulton, a town of about 4,000 in rural, north Mississippi. The entire county school district has 3,588 students.

The case is typical of what's happening in schools across the country, said Charles Haynes, senior scholar for The Freedom Forum First Amendment Center.

"This case is different because this is not just dress, it is a higher claim of personal identity," Haynes said. "I think that if the student prevails in this case, it will send a message to school districts that they need to accommodate students now who are openly gay and lesbian and want to participate in student activities," Haynes said.

Her case has become a cause celebre.

She has appeared on the "The Early Show," "The Wanda Sykes Show" and "The Ellen DeGeneres Show" to talk about how she is fighting for tolerance. DeGeneres presented her with a $30,000 college scholarship from Tonic, a digital media company. A Facebook page set up by the ACLU for McMillen has over 400,000 fans.

Well I would like to add the following; it does not seem that anyone is looking at the age here. I am assuming that she is 18, however it is stated her girlfriend is 16. Now correct me if I am wrong, if she is admitting they have a lesbian relationship, I would assume they are having sex. Is she not committing statutory rape?

its mississippi. the south is notorious for having lower ages of consent to sex. also, some states say that when both participants are still in high school it isn't statutory rape, others have a 2 year age difference rule, it really all depends.

This is one of the results of taking prayer out of the schools. This child needs much prayer. I am the first to say that God is love. When he formed the world he said it was good. you can't pray away the gay. god made her that way. for god to make someone gay, and then say that they must be punished for it makes him very cruel. to say that because he made someone gay that they should never be able to make any kind of romantic commitment to someone else who they would be able to love in a romantic way (i.e. if straight-opposite sex, if gay-same sex) for as long as they live, but straight people can get married and divorced as many times as they would like is ridiculous.

No, gays and lesbians do NOT, as you say, want to impose their "lifestyle" on others. What they want is to be treated the same as any heterosexual America. Oh, and being a GLBT person is NOT a "lifestyle! It's who they are. Also, a GBLT orientation is NOT sinful--it is a normal, natural variation of human sexuality (and that of many other species).

Whether you like it or not, Constance was born a lesbian. This is who she is. A GLBT orientation is NOT a choice--it is part of them from birth, even if it doesn't manifest until later in life.

The school board did NOT do the right thing. Instead of inclusion and acceptance, they chose the path of exclusion and rejection. What is the message that they have given to the other students? That it's just fine and dandy to discriminate against GLBT people.

Her family should not hide in shame--they are doing the right thing in supporting their daughter. No, Ellen is not a dispicable lesbian. She is a fine person and has 100 times more class than many of the posters here.

As for you who signed themself "A Normal Human being", if you are a normal human being, I would take my chances with abnormal people any day.

Meh. Don't concern yourself with those so insecure in their sexuality--those self dubbed "Normal Human Beings"--that they have to hate on people who are different, to legitimize *their* orientation.

What a shame!!!Those who practice a "sodome and gomorah" style of abomination want to impose on others their sinful style of living. What a disgrace for the fate of humanity. She was not born as a lesbian. She made herself. All that stuff of being born homosexual or lesbian is just an irational excuse for this abnormal human beings. This is why our society and our country is almost destroyed-what is sinful and morally wrong is defined as good and what is good and morally wright is labeled as "old fashioned" and out of line.
The administration of the school did the right thing. What is the message the school gives to the graduants. I would barred all homosexual and lesbians from the military.

Her family should hide in shame and not sueing the school. Another despicable lesbian as Ellen rushed to assist this immature student.

I do believe that everything has its place and time. I am getting a bit tired though to read and hear the plight of same gender people. I have some rights and I really, don't want to read or hear about it every single day. Proms are and have been for boy-girl dates. I think this young ladies want to make the statement that it is ok to take her girl-friend to the prom. What about the other people in the prom that may feel disgusted at seeing holding tight, kissing, etc. etc. in the dance floor? We all have rights but gee whizz the girl-girl or boy-boy prom is not such a good idea.

When this story first surfaced on HP, my comment was that while I generally hate people making money purely off of media exposure, (think Balloon Boy here) I really hope that this girl ends up getting enough money out of this to send both her and her girlfriend to college.

Now how about another wish:

Any young celebrities who support LGBT rights should get together to host a private prom. Hire Vampire Weekend (or whatever other band-of-the-moment might wish to play) and some elite caterers. Tell Constance that she may invite any of her friends, and fly them all to the event. While she and her friends who have the loyalty and courage to support her are partying with the stars, those who discriminate against her can sit at home an watch the videos on YouTube and hope that Carrie Prejean will host a party for them someday.

It was said earlier that proms are not paid for with school money so if it was never funded by the school it seems to me that the only issue is one of location or is there some issue with whom ever holds those purse strings? What is really going on in this town?

It's b/c it was being held on school property since it is a very, very small town. I'm from Mississippi and not every town can afford to have their proms off campus. We do in Vicksburg, but we have more places(and larger town) to hold a prom than they do so.

But we are starting an era of majority rule in this country...when you cant get what you want the right way, all you gotta do is change the rules to expedite what you want.

If the students want her at the prom, they will vote for her...if they dont want their prom to be a joke because a girl want to show up in a Tuxedo they wont vote for her to come.

It seems simple enough...either we are going to have things done the right way, or we are going to use majority rule...you cant keep changing it to suit the fight you have in front of you.

but everyone is a minority....who is the majority in this country...whites, blacks, the old, the young, mean people, nice people, gay people, straight people...

There is always going to be somebody that feels that they are being put out by someone in this country...in this case is was an 18 year old girl, who already knew that there were rules against going to the prom with her same sex 16 year old girlfriend...so she got the ACLU get the prom cancelled for everybody.

Ellen got involved becuase it is good PR for her and may help the American Idol ratings, not to mention her own stock goes up big time...

The girl got paid, and i forsee she is going to get paid some more...

The other kids in the town all get to look like homophobic neanderthals...because that is exactly how all 14, 15, and 16 year olds should be looked at, i guess.

The school board, while following the rules and regulations in place are now all homophobes...but hey, it goes without saying, it is Mississippi right?

At this point I'd just be glad to get a 30k schlarship and let those hicks stew in their 19th century ghetto in the backwaters of Mississippi. She has a great future ahead of her and a college education nearly paid for none of which she would have if it wasn't for these slack-jaws. It is ironic how their hate has actually empowered her.

Guys, this is Mississippi, a state that in 2001 voted to keep the confederate flag on their state flag. This is a state famous for the murder of 3 civil rights workers in 1964. The poorerst state with the lowest per capita income and the most people living below poverty line in the US. They suffer the same "brain drain" as a third world country, their most successful citizens often leave and move to other states. Elvis was born in Mississippi, but Graceland is in Tennessee. William Faulkner and Tennessee Williams moved to New orleans. Muddy Waters, BB King, Bo Diddly, and later Oprah Winfrey, all born in Miss, all moved away for a better future. Constance will leave and go to a modern state where she will be accepted. If anyone thinks I am being unfair to the "worst state in the union", you may be right, so take your state back from the backwards neaderthals. The rest of us are getting sick of subsidizing your poor state with our tax dollars, i don't want any more of my money supporting institutionalized racism and intolerance.

I feel for you brother, how many times can a state be on the wrong side. First the Confederacy, then the civil rights movement, now this. My mother left the south as soon as she could (she went to college in the 50's, a rare feat where she's from at the time) She's one of the most tolerant elderly persons you'll ever meet. And thats the problem, people who may be different or tolerant leave the place. Maybe I'm making a broad generalization here and I apologize. You are obviously not what I rant about here.
