Elena Kagan Tapped For Supreme Court (VIDEO)

WASHINGTON -- President Barack Obama on Monday nominated Solicitor General Elena Kagan to the Supreme Court, declaring she would demonstrate the same independence, integrity and passion for the law exhibited by retiring Justice John Paul Stevens.

If confirmed by the Senate, Kagan would become the third woman on the high court. At 50, she is relatively young for the lifetime post and could help shape the high court's decisions for decades.

The former Harvard Law School dean "is widely regarded as one of the nation's foremost legal minds," Obama said. He introduced her in the White House East Room as "my friend."

Kagan said she was "honored and humbled by this nomination." She called it "the honor of a lifetime."

"I look forward to working with the Senate and thank you, Mr. President, for this honor of a lifetime."

Obama cited what he called Kagan's "openness to a broad array of viewpoints" and her "fair mindedness."


In a statement issued before Kagan had completed her remarks, the lawmaker who will preside over her confirmation hearing, Democratic Sen. Patrick Leahy of Vermont, said, "The Senate should confirm Ms. Kagan before" Labor Day.

"Our constituents deserve a civil and thoughtful debate on this nomination, followed by an up-or-down vote," he said.

The Republican leader, Sen. Mitch McConnell of Kentucky, said his party would make sure there was a "thorough process, not a rush to judgment" on the nomination.

"Judges must not be a rubber-stamp for any administration. Judges must not walk into court with a preconceived idea of who should win," he said, adding that Republicans would have a vigorous debate on that principle.

Obama began with high praise for the retiring Stevens, a leader of the court's liberals, calling him "a giant in the law," impartial and having respect for legal precedent.

Kagan "embodies the same excellence, independence and passion for the law," Obama said.

"She's an acclaimed legal scholar with a rich understanding of constitutional law. She is a former White House aide, with a lifelong commitment to public service and a firm grasp of the nexus and boundaries between our three branches of government," Obama said. Kagan served in the Clinton White House.

Obama noted that neither Kagan's mother nor father "lived to see this day, but I think her mother would relish this moment. I think she would relish, as I do, the prospect of three women taking their seat on the nation's highest court for the first time in history ... a court that would be more inclusive, more representative, more reflective of us as a people than ever before."

I have reserved my opinion for now, but I want to see more attention given to the recent rating released of all the SCOTUS justices over the 70 years showing that 4 of the 5 most conservative judges are currently sitting on the SC and Roberts is the 10th most conservative judge. None of the current progressive liberal leaning ones even rate in the top 10 most liberal.

I like her. I think he made a wise choice. She's sharp as a tack and very eloquent. Not the most picture-friendly candidate, but she's not auditioning to be a super-model. She clearly has a great background in arguing cases before the SCOTUS, and as Dean of Harvard Law I'm sure she'd built up a lot of understanding about the law and the constitution.

African Americans Should Oppose Supreme Court Nominee Kagan!
African-Americans should not have BLIND FAITH that a nominee without a record of her position on issues of race and Affirmative Action will serve our needs.
I supported President Obama’s quest to become president. I also actively supported United State Supreme Court Associate Justice Sotomayor’s confirmation to the Court. http://www.ireport.com/docs/DOC-297128
I don’t support his nomination of Elena Kagan to the Supreme Court. Judge Kagan has never served as a judge in any court. My hope was that President Obama would take advantage of this opportunity and appoint an African American who is highly qualified, has experience as a judge, and has empathy to the plight of the poor and disadvantaged. I believe that a qualified progressive African-American should be appointed to the vacancy on the United State Supreme Court. So to be an effective jurist you have to be a judge? Hm....I'd actually prefer fewer SCOTUS candidates to be judges myself, they get caught up in pedantics with a lifetime on the court.

Instead of calling this a "nomination", it should have been called a "Gnomination". However maybe it would be good to have a SC justice who looks like a lawn ornament - sort of a grass roots touch.

This woman is NO Harriet Miers, so stop with that fickle analogy now. If anyone says she is, I suggest they read up on Harriet Miers and see exactly how unqualified she was for the appointment she received. Even Harriet Miers felt she was unqualified. This woman has spades of legal experience, and loads of other Supreme Court justices have never sat as judges before. I actually think that Obama is trying to remove the political posturing of this Court. After all, the law is supposed to be impartial and not reside in the realms of politics.

Ok, the GOP has been incredibly inept politically but historic trends are overwhelming and very clear in that the GOP should take back seats in the House and Senate in 2010. Who thinks the Dems will retain or increase their Congressional seats?

Given this, what makes you think a Diane Woods has a better chance later? This was the time to go for the liberal (especially to counteract what Bush done) before it's too late.

What a lot of progressives fail to see, I think, is that the Democrats are equally politically inept, and if this appointment choice doesn't make that crystal clear, I don't know what will. She's never been a judge. She's Wall Street to the bone. She's an insult to the American people, just like Harriet Miers.

Overwhelming is right, regarding the coming GOP tsunami. Only a blind person could fail to see it at this point. Hopefully, their majority won't plunge us into a new war with Iran.

The Dems only lost one seat in the off year of Clinton's second term. With these "Larry Craig" type republicans running around, anything is possible.

Also, the DNC has an excellent ad ready making perfectly clear who is responsible for the economic mess: GWB and the republicans. I expect very minimal losses.
