DETROIT — Police who carried out a raid on a family home that left a 7-year-old girl dead over the weekend were accompanied by a camera crew for a reality television show, and an attorney says video of the siege contradicts the police account of what happened.

Geoffrey Fieger, an attorney for the family of young Aiyana Jones, said he has seen three or four minutes of video of the raid, although he declined to say whether it was shot by the crew for the A&E series "The First 48," which has been shadowing Detroit homicide detectives for months.

Police have said officers threw a flash grenade through the first-floor window of the two-family home, and that an officer's gun discharged, killing the girl, during a struggle or after colliding with the girl's grandmother inside the home.

But Fieger said the video shows an officer lobbing the grenade and then shooting into the home from the porch.

"There is no question about what happened because it's in the videotape," Fieger said. "It's not an accident. It's not a mistake. There was no altercation."

"Aiyana Jones was shot from outside on the porch. The videotape shows clearly the officer throwing through the window a stun grenade-type explosive and then within milliseconds of throwing that, firing a shot from outside the home," he said.

A&E spokesman Dan Silberman said neither he nor anyone else from the network would comment about the case, and he denied a request by The Associated Press for the footage.

Detroit police were trying to obtain the film crew's footage, Assistant Chief Ralph Godbee said Monday.

Fieger said the investigation into what happened during the raid "needed to go no further than the videotape."

"The videotape shows clearly that the assistant police chief and the officers on the scene are engaging in an intentional cover up of the events," Fieger said. He said more than one camera was recording at the scene, and that the footage includes sound.

Police arrested the target of the raid, a 34-year-old man suspected of killing a 17-year-old boy, in the upstairs unit in the two-family home. Police had warrants to search both properties, and family members of the slain girl were seen going in and out of both on Monday. The suspect has not been charged, and it was not immediately clear what relationship he had to the slain girl.

The case has been handed over to the Michigan State Police to avoid the appearance of a conflict of interest, Wayne County Prosecutor Kym Worthy said Monday.

Some, including the slain girl's family and others, have questioned what effect the cameras may have had on the tactics used during raid on the home, which had toys strewn about the front lawn on Monday.

The police department is understaffed, and officers have said they feel vulnerable – especially after one patrolman was killed and four others were wounded during a gunfight with a suspect in a vacant home earlier this month.

Two prominent criminal defense attorneys said they were unaware of past instances when Detroit police used flash grenades in raids when children were possibly present.

"That's a new one," said Detroit lawyer Corbett Edge O'Meara. "That does seem to be a pretty extreme measure. It doesn't surprise me that the police had no concern whether they were endangering the lives of children when they made this raid."

Attorney Marvin Barnett was more blunt: "I've never heard that before in my entire career, that you've thrown a flash bomb in a house unless you've got an armed suspect and you know there is nobody else in the house."

"I'd like to know who gave the order to do that," Barnett said.

Godbee said the department was confident the film crew's presence had no effect on how the raid was conducted. He said the police department's use of flash grenades is decided on a "case by case" basis.

"It primarily goes to the severity of the crime and the potential of violence from the offender we're trying to get in custody," Godbee said.

He declined to comment on whether the officers involved in the raid were aware children were in the home.

"Our tactics absolutely will be addressed and assessed at the appropriate time," Godbee said.

The family was left searching for answers. They retained Fieger, a high-powered attorney who also represented assisted suicide advocate Dr. Jack Kevorkian, but the girl's father said he wants to know what led to his daughter's death.

"They killed my baby, and I want someone to tell the truth," he said Sunday.

Police have not identified the officer whose gun fired the shot that killed Aiyana. Godbee said he is a 14-year veteran with six to seven years on the Special Response Team, and that he has been placed on paid administrative leave pending the outcome of the investigation.

The officer was cleared following a nonfatal shooting last summer. Police were fired upon by someone barricaded in a house and returned fire, Godbee said.

The Detroit police department has been under two court-ordered consent decrees since 2003 aimed at, among other things, correcting how and when its officers use force on suspects.

The department declined to say whether it was being paid by the television show.

Too bad people dont get upset whenever ANYONE is killed, the only reason anyone cares so much more about this lil girl than the 17 yr old is, this lil girl was not only killed by a Police Officer but by a white one at that....................how upset were folks over the Officers shot there, the 15 yr old, the 16 yr old, 17 yr old jarean or the elderly woman? the difference between them and this lil girl? all the others were shot by another black person, nobody cared about this little girl BEFORE she was killed but now everyones rushing to the Funeral Home, standing at corners with candles burning, making her a shrine in front of their home.........next time, try caring before a child is killed and quit looking for color in every picture, she wasnt shot because shes black, she was killed because she was failed by EVERYBODY that she should have been able to count on to protect her, yes, her own family.

She was an innocent 7 year old, in which police raided the wrong home. Just because a police officer was unfortunately murdered does not negate the fact that she deserved not to die in such a fashion. Believe me, if this was a 7 year old white child murdered in her home by over zealot police officers, you would be singing another tune!

Shut up you sound so damn stupid, re-read your post youngin. Yes, a 7year old child who was murdered by the irresponsible Detriot police. That is why everyone is so upset, including me who has a 6 year old child. The police our out of control and they need to clean house and re-train these ANIMALS to deal with all people in society and handle situations appropriately, not by killing, hurting, stun gunning our youth, older citizens or average joe. THis is an epedemic folks check the internet re:police brutality and you will see another side of this scary horrible picture. You must protect your family!!

I think on this story, im inclined to believe the highly trained and experienced Police Officers.....that officer went in with his shield in one hand, gun in the other and shocked granny, not saying she fought with him, the two collided, the gun went off and shot the lil girl, nope I dont believe the attorney as he "cant produce" the video as he "wasnt given a copy" and he "has since lost contact" with the person who supposedly showed him the video, wont let his "clients" answer as to whether Jones was with Owens because he feels that their answer would cloud the investigation and 6 hrs later, after the family refused to cooperate with the MSP for their investigation (so much for them wanting an investigation), no bullet hole anywhere in the exterior walls of the home, nor the window where the flash bang (not a bomb) was thrown through. Daddy was at what mall Tuesday flashing a gun at 3 teens wearing t-shirts with the 17 yr olds pic?

The shot came from outside the home. Forensics can easily show the projection on the bullet. I say again, if this was a white 7 year old shot while sleeping on her sofa, you would not have such doubt.

So according to Detroit Fox news and click on detroit.....this family, including "daddy of the year" are'nt exactly the Cleavers. To address a few "points" from some folks on here:
not only did Daddy know that "Uncle" was wanted for murder and shacked up in the 2nd unit that the whole family, inc the lil girl, was in and out of all day (explains the need to raid BOTH units), Daddy was actually with him when he shot the 17 yr old boy. Daddy has a rap sheet for robberies, weapons, fleeing from police in a stolen car (surprise here right, given the two stolen vehicles in their backyard) and even Granny herself has been around the proverbial criminal block a time or two. Wonderful family...........one can ony hope that after, if not possible to do so during, the investigation, CPS comes in to do their own report on the other 4 kids residing, with 6 adults in a 2 bedroom filthy (seen the pics of inside the apt) apartment and save them from this train wreck of a family before another innocent child loses his/her life. Poster family for the need to "clean up Detroit". All this over a look given by a 17 yr old CHILD to a grown man.

The Cleavers were on this show called "Leave It To Beaver". They were portrayed as the cookie-cutter perfect family that never got in trouble (I have old parents! LOL!) hence the idiot saying they are not the Cleavers.

Yes you are right there is a double standard. What pisses me off is because this girl wasn't a JonBenet Ramsey, she's just swept under the rug by MSM. God knows we heard about that girl every other day. Not saying it's bad it's just the coverage scale is VERY unbalanced.
By the way, thought I let you know, you should have just stopped reading Gemini's post and saved your time when you read "according to Detroit FOX NEWS!"

To those asking why the family "harbored" the suspect. This house is a duplex with two seperate units. There is some question whether or not the suspect even lived in the same unit or was related in any way to Aiyana.

What is really at issue is not just the actions of individual police officers but the increasingly militaristic tactics that are used to fight crime. Militarized police do not belong in a country that purports to be a democracy.

Watch the report on DemocracyNow. That was the first time I heard that this grandmother was actually arrested and then let go, during the time that the police were trying to cover their actions.

For those unfamiliar with flash-bang grenades (as attorney Fieger is) let me explain something; the "bang" of the flash-bang grenade sounds exactly like a gunshot from a close distance. Unless the 48 hours crew was right next to the officer that fired the weapon, it would be almost impossible to distinguish the grenade bang from the gunshot.

The only way to tell would be when the autopsy report comes out, a medical examiner could easily tell if the shot was fired from a distance or near the sofa where the girl was sleeping.

I wish I could get more news on this story as I have several unanswered questions. Who was the subject that the police were going after and what was his relationship to the family? If there was a fight over the gun in the house who was doing the fighting? When will the department's video from the incident be release (all SWAT team incidents are filmed)?

Regardless, the cop never should have had his finger near the trigger. It's called indexing. This Weekley ashle should have known how to handle a firearm. Plus they got the wrong apartment. Plus they did a home invasion in the middle of the night.

They were not being threatened by anyone. Even if he did enter and granny approached him (right!) why would he struggle with her with his finger on the trigger? You don't put your finger on the trigger until you are ready to shoot.

You're correct that the officer never should put his finger near the trigger in normal circumstances. However, if the grandmother was fighting with the officer and attempting to grab the gun, it could have easily gone off while the officer was trying to protect the trigger.

Incidents like this could easily be prevented by utilizing more advanced holsters than only allow the gun to be removed from certain angels.

One thing for sure, everyone here is outraged. This incident just shows how vulnerable we all are to police actions. If the suspect was a relative (or boyfriend) of a resident of the house it just shows his callous disregard for the lives of everyone living there. They were nothing but human shields for his bad behavior. The police had only one thing on their minds when they went in, and it sure was not about innocents that may have been there. The callous disregard that the police showed for the lives of other human beings that were not suspects shows the true nature of 'getting the job done'.

What really gets under my skin is that all of us are potential victims in a scenario like this.

the police are also not judge, jury and executioner . . . even if the police were raiding a residence inhabited only by someone accused of a terrible crime, they must not start throwing incendiary devices and shooting into the dark until they have identified themselves and met violent resistance . . . just because someone is accused, it does not make them guilty and a fair target for police brutality

I live in Seattle and recently a lunatic shot 4 cops in broad daylight in a coffee shop in Tacoma and then ran to his auntie's house in my "upscale white' neighborhood the police surrounded and blocked off the neighborhood.. (one of the streets was my street so I watched this first hand) they sat for hours before they determined it was 'safe' to enter the house.. and they were after a cop killer so what is Detroits excuse...

Even the military surrounds houses in Iraq and they nearly always get their man. Here they commit violent home invasions throwing bombs through the windows, kicking in doors in middle of the night with black ski masks and assault weapons screaming at people as they are jerked out of their sleep. We are treated far worse than our own military treats ter.rorists in other countries.

I don't see how the TV show is to blame. You would think that cops on camera would behave more carefully considering that their actions were being recorded.

Most likely, this is an incident of Detroit police behaving better than usual. At least this time they searched a home somewhat nearby the correct address, and they only killed one person...

Truth be known, this poor child didn't have it so good. Why would those people who love her so much surround her in any type of conditions that would lead to the possibility of a police raid? Bless her heart.

why would the police department, charged to serve and protect her, take such risks with her safety, any citizen's safety? even if she was the alleged murder, the state did not have the right to execute her in her sleep without benefit of due process

You have no idea what the family did or did not do. If you've been keeping up with the story, you've see the inside of that apartment where that poor little girl lived. Why would a loving family let her live in squalor. It doesn't take money to keep a home clean. As far as what the police did or didn't do, you have no idea about that either. Why not reserve your judgement until the video is released. And, why would the grandmother try to grab the gun from the officer? When an officer comes to the door with a warrant, most innocent people would comply. Shame on the adults in that family for putting that innocent child in danger. Our police officers need to be treated with respect until it's proven that an individual officer doesn't deserve that respect. My brother is a police officer. I sometimes wish that he and his fellow officers would just take a couple of weeks off and then let the public see how much good they do in the communities.
