O'Connor, Scalia Say Kagan Doesn't Need Judicial Experience

WASHINGTON — Former Justice Sandra Day O'Connor says that lack of judicial experience should not derail Elena Kagan's nomination to the Supreme Court.

O'Connor tells ABC's "Good Morning America" that historically more than a third of the justices came to the court without first serving as judges, adding "I think it's fine. Just fine."

The first woman to serve on the Supreme Court says that Kagan seems "very well qualified academically." She says that going through the Senate Judiciary Committee's confirmation hearings, however, is a "difficult, unpleasant experience" for a nominee, no matter who that is.

Justice Antonin Scalia, the Supreme Court's most notorious conservative, likewise says he likes that Kagan hasn't served on the bench, ABC News reports.

"When I first came to the Supreme Court, three of my colleagues had never been a federal judge," said Scalia, who joined the Court in 1986 after being nominated by President Reagan. "William Rehnquist came to the Bench from the Office of Legal Counsel. Byron White was Deputy Attorney General. And Lewis Powell who was a private lawyer in Richmond and had been president of the American Bar Association."

"Currently, there is nobody on the Court who has not served as a judge --indeed, as a federal judge -- all nine of us," he continued. ". . . I am happy to see that this latest nominee is not a federal judge - and not a judge at all."

Scalia's remarks came during a lecture he gave at Catholic University's law school, held at the U.S. Courthouse in Washington, D.C.'s ceremonial courtroom.

Kagan returns to Capitol Hill Thursday to meet privately with a half dozen senators. Her nomination hearings could begin as early as late June.

I find nothing wrong with Kagan's lack of judicial experience, I do have a problem with the court being stacked with people from the same universities. Someone should let Obama know that there are law schools outside of New England that provide a much more diverse legal background.

I'm sure she has opponents that find this a detriment. I agree with O'Connor and Scalia. I do question here politics and whether or not having a 3rd liberal woman from the NY metro area is wise.I do think elections have consequences and the President has every right to pick the person he thinks will be best for the country. Barry's judgement has been very bad so far though, and this is is a momentous appointment that may haunt us for decades and no place for more on the job training.

Having a supreme court composed of nine justices with no judicial experience would be unwise, but having one such justice is a strength, not a weakness. Like all professions, the judicial mindset can result in a certain amount of tunnel-vision. Having one justice with outside eyes is a plus.

Stop the Kagan nomination. Americans must make the correlation of the exact state of the nation, the economy, the injustice and inequality in our society and Harvard graduates in the private sector, Goldman Sachs, and the Federal government. A person from Harvard should not be considered for government service anywhere especially the Supreme Court. A Harvard graduate who has ties to the Federalist Society and Goldman Sachs must not be considered for any judiciary position. The nation has suffered these people, the Obama government, quite enough. Obviously the fascist perspective of our political elite, that is okay with the overt coup de tat by G.S. of the U.S. government, its' implications and consequences, has not been fully assessed. A clear and present danger exists if we have fascists and GS agents in the U.S. government and the highest court. Stop the nomination of Ms. Kagan.

I am asking the citizenry to draw conclusions from the correlation of Harvard men and women in the Highest echelons of the Federal government, Goldman Sachs, the Federal Reserve and the national economic collapse.

Crisis economy formation measures must be implemented now or this great nation is doomed.

Scalia may not like her conclusions, but I suspect he respects her mind and reasoning. Despite his biting decisions, he has a reputation on the court for collegiality beyond even the norm with his peers and is quite close with Ginsburg, again, I suspect because he respects her.

As for Thomas, have you actually read their decisions. The idea that they are clones is a bit of a misnomer. Their decisions are quite different in legal reasoning. Thomas is much more a traditional conservative and maybe a bit of a Straussian.
