Obama Memo Gives More Benefits To Federal Workers' Same-Sex Partners

WASHINGTON — President Barack Obama ordered government agencies Wednesday to extend additional benefits to same-sex partners of federal employees, including child care services and expanded family leave.

The moves come a year after Obama signed a memorandum giving federal workers' same-sex partners a first round of benefits including visitation and dependent-care rights. At the same time he asked federal agencies to determine what other benefits could be given to domestic partners without Congress acting, and those he announced Wednesday were the results of that review.

They include child-care services and subsidies; more flexibility to use family leave to attend to the needs of domestic partners and their children; relocation benefits; giving domestic partners the same status as "family members" when federal appointments are made; and access to credit union and other memberships when those are provided to federal workers.

As with Obama's memo a year ago, this one covers only benefits that can be extended under existing law, without congressional action. Legislative action would be required for a full range of health care and other benefits. Health care benefits are the ultimate goal for many activists, and Obama supports them as well. In a statement he called on Congress to act on legislation to extend health benefits to same-sex partners.

"While this memorandum is an important step on the path to equality, my administration continues to be prevented by existing Federal law from providing same-sex domestic partners with the full range of benefits enjoyed by heterosexual married couples," Obama said.

It's the president's latest step to further gay rights. The White House recently backed a compromise on the military's "don't ask don't tell" policy on gays in the military that would move ahead on repeal but still allow the Pentagon time to implement new policies. In April, he moved to grant same-sex partners full visitation rights in hospitals.

Obama's approach on gay rights has been criticized as too cautious by gay activists, particularly on "don't ask don't tell."

Dear fellow civil rights supporters, please join me in boycotting all expressions of patriotism (standing for the national anthem/pledge of allegiance, wearing/displaying US flags, etc.) until the United States lives up to the ideal of equal treatment under the law for all US citizens.

Nothing less than full repeal of DADT & DOMA is acceptable...until then the mindless parroting of empty phrases is reinforcing your own oppression.

What about the rest of us? I'd like some federally recognized rights and priveleges, too. As a woman married to another woman, that is. Woulda saved us tons on attorney's fees, drawing up all our protections...

Is it me or is the title of this article misleading? Dang pubs are gonna see "More" compared to what everyone else gets when it's actually "More" compared to what they had, still leaving them well short of equal.

I just don't understand why they think minorities want special, additional rights that nobody else has... they just want equality... Jesus...

I'm glad we are finally moving toward equal treatment for everyone, (let's get singles on an even plane too). But I have a question.

We know openly gay people are not allowed to serve in the military. Suppose the draft were re-instated. Would being gay exempt one from the draft? How would you "prove" you were gay? What if you were gay, but had taken a vow of celibacy? Would you still have to serve? Would only sexually active gay people have to serve?

If I was a young man and got a draft notice the first thing I would do is declare my “gayness.” The draft board would say, “Well, you’ve been married to a woman and fathered children by her.” My reply: “Yes, but as you fundies and repubs say, being gay is a life style choice, and I decided to become gay when I got my draft notice.”

See how ridiculous the ban on gays in the military is?

By the way, there was a gay guy in my barracks bay in Army basic training. “Skinny”, as he was nicknamed, was a good soldier, really stracked out. He was also a riot when we sat around the barracks and shot the breeze. I never felt like he was a threat to ravish me sexually and I don’t think he was bad for “unit cohesion.”

It does not exempt someone from the draft. Men who claimed o be homosexual were still drafted. And even with DADT, it has happened that people who admitted they were gay were still deployed. Their discharges were put off until after they were used. When the deployment ended, the paperwork magically got shoved through quickly.

You are exactly right. That's why the "ban" on gays serving in the military is ridiculous. There is no ban on serving, there is a lot of govt/military hypocrisy, though.

What a bunch of bulls***! This is a bloody memo. And oh, BTW, a federal judge ruled that health benefits can be given without violating DOMA. And the lawsuit that is now facing the Obama Administration from Lamda Legal regarding this issue is conveniently never mentioned. Nor is the fact that Obama's DOJ defended DOMA in the strongest language, comparing gays to incestous pedophiles in the brief.

This is, again, dry bones. Thanks for the pat on the head, Obama Administration. Now how about actually advocating like you promised?

Who’s compromising? Both the bigots and the misguided have a great deal of power and influence. Obama is president, not King. He has to move deliberately and a little slower than you like but there is movement. So if you would prefer the Christian fundamentalist Bush government back in power, you are welcome to it. You must also recall there was no wave of the hand that brought equality to African Americans in this country. It was a process that even today is ongoing, but a process.

In Pennsylvania state employees have benefits that straights do not. For example, there leave benefits such as sick family leave specifies an option for "same sex domestic partners," but there is no corresponding benefit specified for unmarried domestic partners of opposite sexes. At first glance this Federal change also favors gays the same way.

Until DOMA has been repealed, this seems the best the federal government can do. Please join us in working towards DOMA's repeal so that married partners are treated as married partners regardless of homophobic sentiment, and I will happily join you to work against benefits for unmarried domestic partners.

The best? No. If they're going to recognize unmarried domestic partners, there is no reason to single out homosexuals for this benefit package. Before I was married, I had a few live-in girlfriends with whom I shared expenses, etc. Such a relationship would not be recognized for these Federal or State benefits, but the same relationship if homosexual would get the benefits. Personally I have no problem with discrimination if it is based on intelligence, but this government move is nonsense. If homosexuals claim to be opposed to discrimination but support this, then it shows they're anti-descrimination position is merely self-serving, not ideological.

It's more progress than we've received from any other President. Yes it may seem slow at times, but it is far further than we have come via any other President.

Five years from now, we'll be able to look back at this time in history and everyone can say "what was all the fuss about"....

Agreed on all counts.

I understand the impatience, but how much exactly is one person supposed to cover in 16 months time? How much did his predecessor accomplish in the same time frame? I would love to see that one juggle 2 wars, massive unemployment, the Great Mexican Threat of 2010, Isreal, teabagboys, possibly Korea, and now, on top of everything else, gay panic.

Pardon Barack for not moving fast enough for you. We've definitely evolved (sorry, it's the best word) into an instant gratification, instant information culture here and you'd better be quick and you'd better be right the first time. I'm dying to see one other person do better for an impossible job. Go ahead. Tell me how much better off we'd be right now with The Old Man and the Stewardess.

Considering where we were just 40 years ago, a lots been accomplished in the recent past. In spite of hysterics who have yet to follow instructions and make their way to the tar pits. :)

His actions speak volumes to everyone except to the very people he is trying to help. I really think the gay community is being overly cynical here, he's trying, he's moving the issue forward in the right direction and they have the nerve to complain?

I guess they forgot that just 500 days ago they did'nt have a chance in hell of seeing any of the things they are seeing now.

McCain never promised to repeal DOMA, repeal DADT, and enact ENDA. Obama promised all that and none has been done. That compromise repeal of DADT is crap, this is a pander considering his DOJ is fighting for DOMA, and ENDA, well, sure hasn't done squat on that. Health care reform--even that cobbled slop that was passed discriminates against GLBT people. You do realize that even if health care benefits are given to domestic partners, the federal government taxes said benefits? Not for "married" people but married gays and lesbians? You bet!

Crumbs from the master's tables. And people wonder why GLBT people are PO at the Obama Administration. Lots of pretty words, a couple of memos, and not one real law among them and Obama certainly isn't pushing for any laws.
