Disturbing Job Ads: 'The Unemployed Will Not Be Considered'

Still waiting for a response to the 300 resumés you sent out last month? Bad news: Some companies are ignoring all unemployed applicants.

In a current job posting on The People Place, a job recruiting website for the telecommunications, aerospace/defense and engineering industries, an anonymous electronics company in Angleton, Texas, advertises for a "Quality Engineer." Qualifications for the job are the usual: computer skills, oral and written communication skills, light to moderate lifting. But red print at the bottom of the ad says, "Client will not consider/review anyone NOT currently employed regardless of the reason."

In a nearly identical job posting for the same position on the Benchmark Electronics website, the red print is missing. But a human resources representative for the company confirmed to HuffPost that the The People Place ad accurately reflects the company's recruitment policies.

"It's our preference that they currently be employed," he said. "We typically go after people that are happy where they are and then tell them about the opportunities here. We do get a lot of applications blindly from people who are currently unemployed -- with the economy being what it is, we've had a lot of people contact us that don't have the skill sets we want, so we try to minimize the amount of time we spent on that and try to rifle-shoot the folks we're interested in."

There are about 5.5 people looking for work for every job available, according to the latest data from the Labor Department.

Sony Ericsson, a global phone manufacturer that recently announced that it would be bringing 180 new jobs to the Buckhead, Ga. area, also recently posted an ad for a marketing position on The People Place. The add specified: "NO UNEMPLOYED CANDIDATES WILL BE CONSIDERED AT ALL." When asked about the ad, a spokeswoman said, "This was a mistake, and once it was noticed it was removed."

Ads asking the unemployed not to apply are easy to find. A Craigslist ad for assistant restaurant managers in Edgewater, N.J. specifies, "Must be currently employed." Another job posting for a tax manager at an unnamed "top 25 CPA firm" in New York City contains the same line in all caps.

A company's choice to ignore unemployed applicants and recycle the current workforce ignores the effect of the recession on millions of highly-qualified workers and could prolong the unemployment crisis, said Judy Conti, federal advocacy coordinator for the National Employment Law Project.

"In the current economy, where millions of people have lost their jobs through absolutely no fault of their own, I find it beyond unconscionable that any employer would not consider unemployed workers for current job openings," she said. "Not only are these employers short-sighted in their search for the best qualified workers, but they are clearly not good corporate citizens of the communities in which they work. Increasingly, politicians and policy makers are trying to blame the unemployed for their condition, and to see this shameful propaganda trickle down to hiring decisions is truly sad and despicable."

There is no law prohibiting discrimination against the unemployed, though advocates said the practice could be illegal if it had a "disparate impact" on minority groups.

Congressman John Dingell (D-Mich.), whose home state of Michigan has a 14 percent unemployment rate, was particularly disappointed to hear about the ads.

"While I appreciate that many employers are facing unprecedented competition for job openings, to close the door on such a large population of potential employees is shortsighted," he said. "Being unemployed is not a choice many workers choose to make. I would hope that companies that are discriminating against the unemployed will take into consideration that this choice is only further contributing to long-term unemployment in our country."

Also, I know it wouldn't SOLVE the current job crisis, but it would sure help out! And we must start somewhere! So CHANGE the fact of denying unemployed persons employment! Stop with your power trips! Stop with your political games! If you truly care about this country & your fellow Americans, help put people back to work ANY WAY YOU CAN.

This is just horrible, unbelievable, & should be unacceptable!!! But no, it's perfectly legal! There's no law that prohibits employers from denying unemployed persons employment. Talk about CHANGE??? Change that Mr. Obama!!! In your financial reform address towards the end you spoke of "EVADING ACCOUNTABILITY." Are these employers not doing just so??? How about Congress change THE FACT that denying unemployed persons employment is unconstitutional? Make a law that protects unemployed persons from these cold-hearted tyrants! Especially right now!!! Short-sighted, unsympathetic employers? My, what a surprise. After all, it was the well-laid plans and the amazing empathy of our corporations that got us into this recession in the first place...

Another thing companies are doing is asking for "recent" experience for a job, which is a way around saying the long-term unemployed need not apply.

I am shocked, I would not want t work at a company like that. Seriously I can understand that you set limits on education and grades, but seriously length of unemployment. This makes people unemployable as their skills fall away.

Kathy Handyside, I agree with you. The other day I was watching the news & I saw the most disturbing thing. An employer posted a job ad specifically stating the unemployed need not apply. What made it even more disturbing is when the spokeswoman from the Human Resources Dept was questioned by the news interviewer, her answer was: "If you're unemployed we feel that you were let go because the company kept the best. So we want the best." Now quiet naturally WE KNOW these things go on off record & behind closed doors. But to go on public television with this is quiet alarming to me! To know that you've been discriminated against, spit in your face, is sooooo wrong! I myself had a work related neck injury in Jan of 2007. Was retaliated on by my employer & wrongfully terminated. So there's various reasons why we are unemployed. But to know that we live in a country who claims to be the greatest & to see how persons in power allow employers to get away with this is murder! Yes, they're murdering the unemployed & the economy. Now I noticed you said you're in your 50's. But if you could bear "a minute" of clean rap lyrics, I'd like for you & those interested to visit my video on unemployment posted on You Tube. (Search: Unemployment extension-THE SAGA CONTINUES.) Sorry but if I have a job I dont need to apply for your sorry ass company's position. Wake up. There are lots of laid off professionals and skilled labor out there in need of work. These companies deserve to go under with that type of mentality.

Something else that really gets me are job postings with a l-o-o-o-n-g list of job duties and then you get to the bottom and the salary is $8-$9 an hour; you know, from that long list of job duties that it was work formerly done by two or three people and now the company is pushing it all on one person and offering them pennies in return! I'm also tired of the "must have 5-7 years experience" thing, the age discrimination, and postings that don't list the salary. If the salary isn't listed, you can bet that they expect you to work for next to nothing. And what voice do we have in Congress? No voice at all. We do not count in the general scheme of things. Only the rich count in this country now.

I actually had a recruiter send me a job posting in Arizona, this had been a few months back. I live in the northeast, as you pointed out and some thing I've seen too many times, a monumental list of job duties or qualifications with pay I couldn't afford to live on. The position in Arizona paid $8 an hour, so this guy wanted me to up and leave to head across the country for an $8 an hour job?
I asked if the company would be paying for my move, no response from that point.
Granted, I never had a six figure job, haven't had a loan in 20 years or credit card and I'm a 99er. With this mentality of what's discussed in this article, sadly I'll never find a job.
Almost 2 years of sending resumes out daily with such limited responses it's absolutely mind boggling.

I think it's time for a BIG march on Washington, and on the homes of these stingy greedy Congress members who are blocking extension of unemployment benefits. I lost my job in 2007 because Bush had so ruined the economy that my company ran out of work contracts and there was no work left for me to do. I went back to school to get training in medical transcription, but now those jobs are being offshored to India. Not only that, but I'm in my 50s and employers DEFINITELY hate people in their 50s! I say, either create jobs and extend the unemployment benefits, or lower the retirement age to 55 and let us start collecting our Social Security benefits (before the Republicans take them away).

The decision to not hire the unemployed is the underground GOP strategy to undermine the Obama administration at every turn. It is a silent conspiracy of like-minded groups and businesses -- from the smallest mom and pop store to the largest mega-corporation. Such a conspiracy threatens our national security, and yea, our very lives, verily. Sheesh, were'd that come from?

Any company that willfully ignores ALL unemployed applicants for a public job posting is shooting itself in the foot.

There are very few people out there who are willing to risk jumping from one job to another in this unstable economic climate... so companies looking for employed candidates will find next to nothing, or they'll get more applicants who deliberately lie on their resume in order to be considered for the job.

Most people who have stable jobs go back into the job market to get a pay increase, but wages in the private sector have taken such a beating that it's more likely that a new job will pay less than the current one. Under these conditions, companies who need fresh blood to meet their goals will have no choice but to consider qualified candidates who were laid off from their previous job.

So, if you're fed up with the discriminatory practices of some of these companies, just apply somewhere else. Your gain will be their loss.

Yes, as an employed person I wouldn't apply at company with this kind of open nastiness. That tells you what it would be like to work some place like that. I supsect that the companies this Sen. is talking about are really having trouble enticing the alreay employed for this reason. At any rate, I'm sure he's lying about unemployed people refusing work.

Yeah most of these lower wage jobs pay less than your unemployment check, so what's get point of working like a slave. ESPECIALLY WHEN YOU HAVE A COLLEGE EDUCATION LIKE MYSELF!!!

Of course White People like yourself have a job so yeah its acceptable for a guy like me to work an Immigrant/High School Drop Out job, Right?

Do the decision makers deciding to avoid the unemployed realize just how easy it is to become unemployed? One person decides to cut your job off of a line item list and your gone. If you work for a large corporation, that person may not have any idea who you are and may see that you are making the highest wage at your current level and about to be promoted to the next at an even higher wage. They can cut you and hire someone in at the lowest $ level. They figure that will be quick and that person will eventually be forced to work at your level anyway, the company will save some money, and all will be corrected. Nothing about a scenario like this suggests that the person who was cut lost her job because of her skills. This happened to me and I have held down several professional positions, only leaving when I wanted to. I am also highly educated (doctorate), go above and beyond the requirements in any position, and get along well with almost anyone. These are qualities employers should be looking for. Fortunately I found a new position a couple of months after I lost my job, but if I hadn't I'd still be out there and I'd be just as qualified for positions as I am now. This is depressing news because I have a number of friends who are still looking, some more qualified than I. Stop blaming the victim!
