WASHINGTON — One week before Supreme Court nominee Elena Kagan begins her Senate confirmation hearings, both liberal and conservative groups are criticizing her record on abortion rights.

The anti-abortion group Americans United for Life, which calls Kagan a pro-abortion activist, recruited failed conservative Supreme Court nominee Robert Bork for a news teleconference this week to denounce her. At the same time, the liberal Center for Reproductive Rights released a report Monday casting doubt on the depth of Kagan's support for abortion rights.

The seemingly conflicting developments highlight the degree to which key players – along with the public – can do little better than guess at many of her views on major constitutional issues.

The American Civil Liberties Union, which doesn't take positions on Supreme Court nominations, released a report Monday concluding that Kagan has demonstrated intellect and knowledge of the law but has not weighed in on most constitutional issues. Free speech and presidential powers, on which Kagan has written extensively, are exceptions, the ACLU said.

"The simple truth is that there is much that we do not know about Kagan's views on the Constitution and the court," the ACLU's report said. "The available record offers very few clues about her constitutional views on criminal justice, immigration, voting rights, prisoners' rights, due process, the Establishment Clause and a host of other recurring Supreme Court topics."

The Center for Reproductive Rights said it's clear from her record that Kagan believes the Constitution affords the right to an abortion. But the group said some of her writings raise questions about how significant Kagan believes those rights are to women's health, lives and equality.

The center says it's important that the Senate ask Kagan about her views on the matter during her confirmation process. It criticized as "troubling" Kagan's contention in a 1988 memo she wrote as a Supreme Court clerk that elective abortions are by definition not medically necessary.

Kagan was writing a memo to Justice Thurgood Marshall recommending that he vote to let stand a ruling requiring Monmouth County, N.J., to pay for inmates' elective abortions.

"Quite honestly, I think that although all of this decision is well-intentioned, parts of it are ludicrous," Kagan wrote. She said women generally have no right to have their abortions paid for, and "I do not see why prisoners should have such rights."

The center's report also criticized Kagan for supporting what it called a "too-narrow health exception" in legislation banning a procedure its opponents call partial-birth abortion. Her recommendations "would have had harsh consequences for women seeking abortions, and were unconstitutional under then-prevailing law," it said.

My instincts say that the confirmation testimony should be fun, but it's going to be another showboat of senators questioning her about abortion (or precedent, or respect for states' rights, or any of several other analogous ideas that are code for "Will you overturn Roe?") and that's disappointing, because she is going to take the same tack that almost every other nominee has: I can't answer that question because I do not want to commit myself on issues that may come before the Court.

She can't be "Borked" simply because her record is not as expansive or as ideologically "pure" as Bork's was. I still wish she would say substantive things in her confirmation hearings.

I'm skeptical of Kagan. She's good some good qualities and some that I see as a bad sign. The more I read though the more I'm drifting away from her.

You're correct. That's why I'm sure you're working hard for the repeal of all physician-assisted suicide laws. I mean, if you 18 year-old daughter had a tough school year and would simply prefer to no longer go on living, why should the law prevent her?

As a wise person once said, "Why can't people just mind their own business? It's not for anyone to tell someone else what to do."

Regardless of the Laws and Public Opinion. I take charge of my body. I don't need, require and desire Elena OR the SCOTUS OR BigGov't in my Uterus.

Since When have conservatives parsed out their "morals/beliefs" re: BigGov't interference in Private matters of Private citizens?

If a woman becomes pregnant as a result of unwanted, undesired sperm emissions, then the contributing male must undergo a Mandated Vasectomy to ensure he will no longer be capable of inflicting any other unwanted pregnancies. It's ONLY Fair. If the gov't Wants to control My Reproductive rights, then "Gov't Reproductive Rights Control Commission" Must Include Male Reproductive Rights as Well!

Let's get rid of child support laws so that the man also has a choice in the matter. Currently, the law says that (unless the mother opts out), he is legally obligated to help support a child for 216 months, even if it was an unwanted pregnancy.

Elena has the charm of being entirely for executive power. Obama knows he can count on her vote when it comes to the status of the president. Whether this pleases liberals is irrelevant. Most will not care or, if they think about it, will agree. It's not as if Bush were president or Cheney. Of course, we don't know the future.

all i know is that if Kagan goes down becuase of the abortion litmis test then the D's will have lost just about eveything to the R's and will feel completly apathatic during voting season. Just another way for the R's to use the Con D's to dimantle the D party.

Kagan will be easily confirmed, after the Senators try to beat her up, I'm guessing over 75 aye votes. She is too smart to give away any positions she holds, she knows the confirmation song and dance by heart. Republicans know Obama could have selected a much more verifiable liberal Justice, so Kagan is better than what they fear might be a second choice.

Why would anyone think Obama would select a verifiable liberal? He's not, and he will select a right-leaning conservative like himself.
