Financial Reform Conference: Auto Dealers Beat Obama, Win Exemption From Consumer Protection Agency

WASHINGTON (AP) -- In the end, the political clout of 18,000 auto dealers scattered nationwide was too much even for President Barack Obama.

House and Senate negotiators putting final shape to a sweeping overhaul of Wall Street regulations all but agreed Tuesday to exclude auto dealers from the oversight of a consumer financial protection bureau.

"The political reality is that those of us who have fought against an auto dealer carve-out can't prevail," Representative Luis Gutierrez, D-Ill.

The House bill approved last December contained an exemption for auto dealers, among others, from lending regulations issued by the proposed consumer agency. The Senate did not, but the sentiment was there. In a 60-30 nonbinding vote last month, senators called for the auto dealer loophole.

Under a compromise offered by Senate Democrats Tuesday, auto dealers would still be covered by federal truth-in-lending rules that would have to conform to regulations adopted by the consumer agency.

The Federal Reserve, which oversees truth-in-lending regulations, could adopt different rules but would have to explain its decision. At the same time, the Federal Trade Commission would be given authority to write new rules for auto dealers under accelerated procedures.

But the bottom line would be that auto dealers would be exempt from direct supervision by the consumer financial protection bureau. The exclusion would not apply to auto dealers that provide their own financing, such as Carmax, or to giant auto lender GMAC.

The Senate compromise, if accepted by House negotiators, would be one of President Barack Obama's most high profile losses in his efforts to overhaul Wall Street regulations. The main contours of the House and Senate bills generally match the administration's goals, but Obama has personally lobbied against efforts to carve auto dealers out of the consumer agency's jurisdiction.

The administration has even made a national security case, arguing that military personnel have been especially prone to predatory lending schemes by car dealers.

Auto dealers have used their high visibility in their local communities to fight inclusion in the bill. They say they only process the loans and then turn them over to other lending institutions to administer and service.

The National Auto Dealers Association continued to press for the House exclusion, objecting to the Senate proposal's requirement that the Fed's truth-in-lending rules hew to those issued by the consumer agency and that the FTC be given the authority to write auto dealer rules on a fast track.

The discussion on excluding auto dealers is one of many negotiations under way in a joint House-Senate panel that is working out differences between the House and Senate bills.

Panel members must still iron out some of the most difficult differences, including how to regulate the complex securities known as derivatives and how far to go in restricting the investment activities of banks.

On Tuesday, Rep. Barney Frank, the joint committee chairman, and Senate Banking Committee Chairman Christopher Dodd prodded the panel to conclude its work by Thursday in time for Obama's appearance before the Group of 20 nations in Toronto this weekend.

"It would be a grave error for the U.S. to do things where we could be gamed by other countries," Frank, D-Mass., said.

Treasury Secretary Timothy Geithner made a similar point while testifying before the Congressional Oversight Panel, an independent committee established to look over Treasury's financial rescue fund. Geithner stressed the need for the United States to shape a consensus on international financial regulations.

"The reforms Congress is about to enact will be a good model for the world and will give us enormous credibility in trying to, again, pull the world to those higher standards," he said.

Auto finance is sleazier than mortgage finance by a long shot. Dealers can hide from you how much the true principal amount of the loan is--the amount they immediately sell the loan to a finance company for. Thus the APR is never correctly calculated. How can this bill reform consumer lending without addressing the largest loan many consumers ever get? I hope the president vetoes the bill on this point alone. Say no to "carve-outs."

An enormous amount of consumer fraud occurs at auto dealerships. Fact: Dealer "Finance Managers" often quote an interest rate higher than the one at which the auto loan is placed, and the dealership pockets the difference every month. It's part of their cash-flow. The "Finance Manager" (aka Resident Scam Artist) usually tells the customer that that's the 'best rate' he/she could get, based on the customer's credit rating. Ninety-nine percent of customers don't know the difference. If the deal is financed through GMAC or FoMoCoCredit, or presumably any of the other manufacturers' credit arms, the 'spread' is built into the dealers' quotes, and is an expected practice among dealerships/finance arms. As they say down in Texas: "That's just good bidness!"

According to this article I don't see that they beat anything being that they still will be covered by federal truth-in-lending rules that would have to conform to regulations adopted by the consumer agency, obviously they must have not been before. When we consumers pay attention to these type things congress votes on that may seem small, then they won't be able to back door us all the time. This is just one of those things they vote on that the American public is not so familiar with up front being that there are so many other pressing issues. Something tells me this will come back around.

If our Secretary of the Treasury can say this about a policy which plays favorites at the consumers' expense, he is more out of touch with any sense of ethics and accountability than I previously thought!

The ultimate purpose of all consumer finance legislation is full disclosure, which is another way of saying that a consumer should be told the truth. The vast majority of automobile financing is handled by the auto dealers; consumers never speak with a banker. Thus the statement by auto dealers that they "only process the loans and then turn them over to other lending institutions to administer and service" is the consumer finance version of the recent argument by mortgage brokers that they only processed home loan applications and then turned them over to lenders to service. We all know how much honesty lay behind that proposition. The point is that almost all fraud and misrepresentation in automobile purchase transactions occurs at the dealership. So naturally Congress decides that this huge segment of the financing industry is not in need of any reform. Rack up another one for lobbyist money.

you must not have read the article. the part of the auto market talked about in the article is the subprime market. if the government would regulate the way used car dealers financed their customers there would be no way to make profit. with out profit auto dealers would not cater to this segment of the market. then lots of people could not get cars limiting their ability to seek liberty but at least you would feel better.

Not sure what is wrong with some of you people. The President's role in passing legislation is limited. He has two parties and lobbyists to contend with. Compromises have to be made in politics. How much cooperation do you think the Republicans offer during this process. They do not and will not ever cooperate with this President and it is plain to see. The irony here is that this President is very Centrist. Until the Republicans grow up and start behaving like they care about our Country and its people, I refuse to blame Obama for any substandard legislation.

You harbor this illusion that Obama is a progressive who is thwarted by all these regressive forces in Washington. But there is no evidence that Obama has ever pushed for any progressive measures.

The Obama you speak of--the embattled progressive thwarted by the corporate malefactors--is a figment of your imagination.

Auto dealer's are some of the biggest crooks in this country , so they will get a pass to continue their crochet consumer practices .
