Senate Republicans Lose Bid To Block Suit Against Arizona Law

WASHINGTON — Senate Democrats on Wednesday turned back a move by Republicans to block the Justice Department from pursuing its lawsuit seeking to overturn Arizona's controversial immigration law.

The bid by South Carolina Republican Jim DeMint to nix the lawsuit came out on the losing end of a 55-43 vote. Five Democrats voted to block the lawsuit while two Republicans voted against the measure.

The law requires officers, while enforcing other laws, to check a person's immigration status if there's a reasonable suspicion the person is in this country illegally.

The administration argues that the law is unconstitutional because immigration is a federal responsibility. Some claim the law will result in racial profiling.

The law has whipped up election-year passions, but most vulnerable Democrats stayed behind the administration despite polling that shows voters generally support the controversial law. Hispanic voters are a valuable Democratic-leaning constituency.

The Justice Department lawsuit is one of seven that have been filed against the new law, which goes into effect July 29.

"There's nothing in there about racial profiling except that you can't do it, and you can't stop someone if you suspect them of being illegal," DeMint said. "You can only ask for documentation if you stop them or arrest them for some other crime."

DeMint sought to add the measure as an amendment to legislation to extend unemployment benefits for millions of people who have been out of work for six months or more.

Democrats voting to block the lawsuit were: Max Baucus and John Tester of Montana; Mark Pryor and Blanche Lincoln of Arkansas; and Ben Nelson of Nebraska. Republicans Mike Johann of Nebraska and George Voinovich of Ohio broke with their party in voting against the amendment.

For those of that persuasion, the right to discriminate is a state rights issue. That seems to be the basis of thinking of those who support this law and refuse to admit how it targets 40% of their neighbors. Its telling by their not supporting a genuine crackdown on the illegal employers who created this problem. But then, the Republicans need the political donations of the illegal employers to to fund their elections.

They need to pick what they want and stick with it. On some subjects it's less government, on others, they want the Gestapo.

I wouldn't come here illegally from another country (suggesting there are others besides Mexico) if no one was willing to hire me in the first place and that was well-known across the board.

It would have been a lot cheaper and far less divisive to stick businesses with massive fines followed by jail time for repeats. As if a physical wall is both the answer and the image we want to project to the rest of the world in the 21st century.

Obama, Schumer and Graham keep telling us the amount of illegals is only 12 million but consider this:

In other words, when we add in 5 million from places other than Latin America, the number is closer to 30 million.

Thank you for including "add in 5 million from places other than Latin America". Some seem to think the only illegals are Latin American/Mexican.

700,000 new illegals enter and stay in the US every year. How many are found and deported by the Federal Government?

How many Legal immigrants are allowed into the US and stay every year? They are the ones that pay the visa fees not some smuggler.

This string of minor successes Obama is getting is starting to remind of the string of minor successes Bush started getting leading up to the Iraq War.

Obamanesty is fundamentally wrong. One man standing our 100 year old immigration policy on its head can't come to any good in the long run.

Not sure where yo are getting your "facts" from since 100years ago the US immigration policy was strictly whites only admission and otherwise mainly concerned with deporting asian railroad workers. Perhaps your personalization of the issue with Obama is telling of a deeper set of issues...

He seems to complain about how many pges are in bills, makes me think he is just not legislator material. Then again the GOP idea of writing a bill is to have the lobbyist who stands to gain the most write the bill in exchange for a hefty campaign contribution...

I saw one GOPer in the FL Legislature who didn't even know what was in the bill he presented to the chamber for consideration. He could not even describe the bill beyond vague generalities...

Bury Arizona in lawsuits, nationally and internationally to the point that the state becomes bankrupt. That is the only way to stop this bigotry and small minded spirit. You don't want illegals then we will fight against these lawsuits but the roads will get more potholes, no social services and police and fireman take cuts. Bleed Arizona dry.

Just saw on T.V. that Mesa, Arizona is becoming the new ghost town of Arizona. Over 100,000 latino and Mexican residents have closed up shop and packed up and are leaving the state. they will soon see how they can get along with the cheap labor they had with these people. A shame, I lived in Arizona in the 60's I am sure it is very different now but I did like it there...They will soon learn what the South learned with the slaves,cheap labor is not all bad. The South collapsed soon after slaves were freed.

Please please don't let all of the illegals move to Texas. California, New York and Massachusetts are much nicer places to live. Check out Oregon too. Very friendly nonracists there. No bigoted nasty white men. Texas is full of mean people. Lots os rattlesnakes and rednecks. And it's real hot.

Fanned, I can picture those old farts being pissed there's no one to mow their lawn. I've been to Arizona many times and they like that cheap labor. One of the best parts of Arizona is the vibrant Latino community. The irony of this is if you want to be honest the Latinos were there first. The "crusty old white men still living in the 50's" are the interlopers.
