Arizona Immigration Law: Sections BLOCKED By Federal Judge

PHOENIX — A federal judge stepped into the fight over Arizona's immigration law at the last minute Wednesday, blocking the heart of the measure and defusing a confrontation between police and thousands of activists that had been building for months.

Coming just hours before the law was to take effect, the ruling isn't the end.

It sets up a lengthy legal battle that could end up before the Supreme Court – ensuring that a law that reignited the immigration debate, inspired similar measures nationwide, created fodder for political campaigns and raised tensions with Mexico will stay in the spotlight.

Protesters who gathered at the state Capitol and outside the U.S. Embassy in Mexico City cheered when they heard the news. The governor, the law's authors and anti-illegal immigration groups vowed to fight on.

"It's a temporary bump in the road," Gov. Jan Brewer said.

The key issue before U.S. District Judge Susan Bolton in the case is as old as the nation itself: Does federal law trump state law? She indicated in her ruling that the federal government's case has a good chance at succeeding.

The Clinton appointee said the controversial sections should be put on hold until the courts resolve the issues, including parts that required officers to check a person's immigration status while enforcing other laws.

In her preliminary injunction, Bolton delayed provisions that required immigrants to carry their papers and banned illegal immigrants from soliciting employment in public places – a move aimed at day laborers.

The judge also blocked officers from making warrantless arrests of suspected illegal immigrants for crimes that can lead to deportation.

"Requiring Arizona law enforcement officials and agencies to determine the immigration status of every person who is arrested burdens lawfully present aliens because their liberty will be restricted while their status is checked," Bolton wrote.

The ruling came just as police were making last-minute preparations to begin enforcement of the law and protesters, many of whom said they would not bring identification, were planning large demonstrations against the measure.

At least one group had planned to block access to federal offices, daring officers to ask them about their immigration status.

"I knew the judge would say that part of the law was just not right," said Gisela Diaz, 50, from Mexico City, who came to Arizona on a since-expired tourist visa in 1989 and who waited with her family early Wednesday at the Mexican Consulate to get advice about the law.

"It's the part we were worried about. This is a big relief for us," she said.

At a Home Depot in west Phoenix, where day-laborers gather to look for work, Carlos Gutierrez said he was elated when a stranger drove by and yelled the news: "They threw out the law! You guys can work!"

"I felt good inside" said the 32-year-old illegal immigrant, who came here six years ago from Sonora, Mexico, and supports his wife and three children. "Now there's a way to stay here with less problems."

Opponents argued the law will lead to racial profiling, conflict with federal immigration law and distract local police from fighting more serious crimes. The U.S. Justice Department, civil rights groups and a Phoenix police officer asked for Wednesday's injunction.

Lawyers for the state contend the law was a constitutionally sound attempt by Arizona to assist federal immigration agents and lessen border woes, such as the heavy costs for educating, jailing and providing health care for illegal immigrants.

They said Arizona shouldn't have to suffer from a broken immigration system when it has 15,000 officers who can arrest illegal immigrants.

In her ruling, Bolton said the interests of Arizona, the busiest U.S. gateway for illegal immigrants, match those of the federal government. But, she wrote, that the federal government must take the lead on deciding how to enforce immigration laws.

The core of the government's case is that federal immigration law trumps state law – an issue known as "pre-emption" in legal circles. In her ruling, Bolton pointed out five portions of the law where she believed the federal government would likely succeed on its claims.

Justice Department spokeswoman Hannah August said the agency understands the frustration of Arizona residents with the immigration system, but added that a patchwork of state and local policies would seriously disrupt federal immigration enforcement.

Federal authorities have argued that letting the Arizona law stand would create a patchwork of immigration laws nationwide that would needlessly complicate foreign relations. They said the law is disrupting U.S. relations with Mexico and other countries.

About 100 protesters in Mexico City who had gathered in front of the U.S. Embassy broke into cheers when they learned of Bolton's ruling. They had been monitoring the news on a laptop computer.

"Migrants, hang on, the people are rising up!" they chanted.

Mexico's Foreign Secretary Patricia Espinoza called the ruling "a first step in the right direction" and said staff at the five Mexican consulates in Arizona will work extra hours in coming weeks to educate migrants about the law.

"None of this is very surprising," said Kevin R. Johnson, an immigration expert and the law school dean at University of California at Davis. "This is all very much within the constitutional mainstream."

The federal government has exclusive powers over immigration to ensure a uniform national policy that aids in commerce and relations with other countries, Johnson said.

A century ago, differing policies among states led to problems that prompted the federal government to adopt a comprehensive immigration policy for the country, Johnson said.

Supporters took solace that the judge kept portions of the law intact, including a section that bars local governments from limiting enforcement of federal immigration laws. Those jurisdictions are commonly known as "sanctuary cities."

"Striking down these sanctuary city policies has always been the No. 1 priority," said Republican Sen. Russell Pearce, the law's chief author.

The remaining provisions, many of them revisions to an Arizona immigration statute, will take effect at 12:01 a.m. Thursday.

Brewer spokesman Paul Senseman said the state will appeal Bolton's ruling to the 9th U.S. Circuit Court of Appeals in San Francisco on Thursday, asking the appellate court to lift the injunction and allow the blocked provisions to take effect. The appeal will ask the 9th Circuit to act quickly, Senseman said.

Whatever way that court rules, Bolton will eventually hold a trial and issue a final ruling.

Wednesday's decision was seen as a defeat for Brewer, who is running for another term in November and has seen her political fortunes rise because of the law's popularity among conservatives.

Her opponent, state Attorney General Terry Goddard, pounced.

"Jan Brewer played politics with immigration, and she lost," the Democrat said. "It is time to look beyond election-year grandstanding and begin to repair the damage to Arizona's image and economy."

Some residents in Phoenix agreed.

"A lot of people don't understand the connection between, 'Yes, we have a problem with illegal immigration' and 'We need immigration reform,' which is not just asking people for their papers," said Kimber Lanning, a 43-year-old Phoenix music store owner.

"It was never a solution to begin with."

Rep. Luis "The Hypocrite" Gutierrez stated in an interview that we should follow immigration law. The fact is that, because staying in the United States is a privilege and not a right for non-citizens, the United States government can force an individual to return to his or her home country. If you have not been deported before, but have at least one year presence in the U.S., you must wait 10-years to return. If you have not been deported before, but have less than one year presence in the U.S., you must wait 3-years to return.

Because Gutierrez is Latino, he thinks we should ignore the law and give amnesty to everyone that has broken the law by illegally entering the US. Ronald Reagan gave nearly 3 million illegals amnesty and 24 years later, there are 4 x's that number here. What that told these people is, come on over! If you can manage to hide long enough, we will give you a slap on the wrist and allow you to stay - forever. Its a scam!

Gutierrez said, of the Federal judge that she "used the constitution," that she "didn't make stuff up and extrapolate from the constitution." Apparently, extrapolating from the constitution is bad as it pertains to illegal immigration, but fine when the Supreme Court of the United States extrapolated when it defined the ex post facto clause.

I have a question and no one has yet to answer it for me? Why is it racist for me not to want to speak Spanish? Why is it racist for me to want illegal Mexicans, Guatemalans and any other south American nationals to come here legally. I have been told twice now the only reason I am not being considered for the job I have applied for is I don't speak Spanish or they would hire me? I am as liberal as they come but I am a tired frustrated American, support our people first then give hand outs. immigration done legally is great. If your an illegal alien here go home and do it right

I have a question:

Why does Obama's federal government argue that Arizona's immigration law that is attempting to support federal law interferes with federal enforcement of immigration law, but Obama has not sued Sanctuary Cities who openly defy federal law?

Are Democrats that upside down on this issue? Is Obama that dense? Is this just sacrificing our own citizens for political gain by the liberals?

Despite a 1996 federal law [the Illegal Immigration Reform and Immigrant Responsibility Act ( IIRIRA )] that requires local governments to cooperate with Department of Homeland Security's Immigration and Customs Enforcement (ICE), many large urban cities (and some small) have adopted so-called "sanctuary policies." Generally, sanctuary policies instruct city employees not to notify the federal government of the presence of illegal aliens living in their communities. The policies also end the distinction between legal and illegal immigration--so illegal aliens often benefit from city services too.

Maybe what this ruling will do is to open the door for a law suit ain federal court against LA or San Francisco and the sanctuary citiy laws will be struck down and we will enforce immigration in Californis.

Thank you, but I really do wonder about this.

Why is an attempt to enforce the law seen as a threat to the power of the federal government, while cities that have openly defied federal law and publically said that they will actively oppose the federal law by welcoming citizens of other nations and give them services while taking from Americans to do it, left alone?

It is interesting that this article is directly below the Wyly Brothers fraud article. While the ultr-wealthy decision-making enclave is secretly moving money where it will influence the ignorant and keep the uninformed voters completely uninformed, Mr. Arpaio is grandstanding and drawing attention to illegal aliens...against whom we direct our frustration and anger with a system and its representatives (immigrants) which slowly but surely is stripping us of our ability to stay in the middle class. Melthing our middle class away, actually.

The irony was unintentional, I know. But I believe we are so close to the tipping point (where most of us fall into provery and very very few join the millionaire class) that it will become harder and harder to avoid these kinds of juxtapositions.

Another deeply troubling aspect of this pro-amnesty business is how throughly it's grounded in ignorance. Amnesty advocates run from key data the way Dracula runs from the sun. The population of illegals is a good example of this.

Macro-economic indicators is a reliable way of estimating a discrete population. The premise is simple enough: since illegals don't do Census interviews, measure their remittances, hospital births, school enrollments, housing data, etc., to estimate their number.

Amnesty heads respond to this the way they respond to everything else they don't like: they call it racist.

Again, a recipe for disaster.

And there are so many other things amnesty-heads promote that's steeped in ignorance -- willful ignorance!

They call the topic of "chain-migration" racist too, but chain migration results in that amount of illegals made citizens tripling in 5 years.

Likewise, the impossibility of weeding out the thousands of felons from the 30 million illegals is considered blasphemy too. Chuck Schumer simply says all illegals will undergo "background checks" as if Mexico has an efficient mechanism in place to do this.

Mexico does not; moreover, Mexico has no incentive to report its felons to us. The fact is, Mexico sees the USA as their penal colony.

Amnesty takes every rule of sensible immigration and stands it on its head.

Amnesty is an irrational/emotional response to mass suffering. And, yes, the illegal is suffering, but amnesty is not the fix for this suffering.

I just watched CNN about this immigration issue and I was so disgusted when I heard about all the identity theft and fake documents that these immagrants are coming up with to get Welfare, Jobs, Cars, homes ect..... Seems like they R willing to continue to break laws even after they snuck into our country. Hearing alot of stories like that doesn't make me feel sympathetic but more angry knowing what lengths they will go to in order to be here. 360 with Anderson Cooper was very enlightning and I hope u will all watch it later tonight as they will re-play it again.

I think Arizona has been successful. They have shined a light on the Federal Government's, Democrat and Republican alike, unwillingness to address the issue of illegal immigration. I am a female, small business owner, in the midwest. 6 months ago many people had no idea how many illegal aliens were in the U.S.A. Thanks to Arizona, now we do and the issue raises many questions: If we are a nation of laws and rules, as our Republic was intended to be, why are we allowing millions of people to enter the U.S.A. illegally? Why are we allowing business owners to employ non-citizens illegally without consequence? If we are the "fair nation" we believe ourselves to be why are we allowing one countries citizens to trample the potential opportunities of all other world citizens? Why does the government allow sanctuary cities and states for that matter?

Why is it so difficult to enforce: Come legally, know how to read, write and speak fluent English, have a plan to support yourselves and your family, have enough respect for your "new nation" to have a plan for how you will contribute to the society which is opening their doors to you.

Why will the Federal Government not represent the legal citizens of the U.S.A by enforcing our laws?

Unfortunately, it is all about the votes. Each side has an agenda, and if either one gives ground, the other will take advantage. The big prize is the new potential Hispanic voting block. Thus we have a stalemate and nothing gets done. It shouldn't be this way, but both parties want more power, and Immigration Reform is a means to get it.

This limbo that you are describing, creates fertile ground for modern-day slavery.

People here that advocate path to legalization/amnesty and this fine, which is probably less than the fees they would have paid for visas/green card, does not address how the USA stops another 12 million + coming in the next wave and this wave going into the shadows like the last wave. Employers would hire legal workers if they wanted to obey the worker laws, ergo, they hire illegal aliens to break USA worker laws. This broken record I hear about path to legalization/amnesty never seems to address how THE NEXT WAVE is permanently stopped?

This is gonna get worse before it gets better. For those of a certain mindset this is a huge victory. Better hope it's not a Pyrhhic victory. If something isn't done a lot of other states will try the same thing with different prepositions or whatever it is that made this law so controversial. Then the Feds will either have to fish or cut bait - finally.

Will be interesting to see if just one state passes a simple law...a statute that makes it mandatory for all law enforcement agencies in the state to execute 287g. Any law enforcement officers in the state not executing 287g will be charged with a misdemeanor, a fine, suspended, and placed on supervision or transferred, etc.

"The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 added Section 287(g), performance of immigration officer functions by state officers and employees, to the Immigration and Nationality Act. This authorizes the secretary of DHS to enter into agreements with state and local law enforcement agencies, permitting designated officers to perform immigration law enforcement functions, provided that the local law enforcement officers receive appropriate training and function under the supervision of ICE officers."

"The cross-designation between ICE and state and local patrol officers, detectives, investigators and correctional officers allows these local and state officers necessary resources and latitude to pursue investigations relating to violent crimes, human smuggling, gang/organized crime activity, sexual-related offenses, narcotics smuggling and money laundering. In addition, participating entities are eligible for increased resources and support in more remote geographical locations."
