Fremont, Nebraska Suspends Tough Immigration Law, Forcing Trial

Fremont, Nebraska suspended its voter-approved ban on hiring or renting property to illegal immigrants Tuesday.

OMAHA, Neb. — A judge said Wednesday she's not sure whether lawsuits challenging a Nebraska city's ban on hiring and renting to illegal immigrants should be heard in federal or state court, delaying any ruling on blocking the voter-approved ordinance.

U.S. District Judge Laurie Smith Camp said during a hearing that she wasn't sure whether she had jurisdiction over the lawsuits filed by the American Civil Liberties Union of Nebraska and the Mexican American Legal Defense & Educational Fund, also known as MALDEF.

Both civil rights groups sued the city of Fremont, saying the ordinance is discriminatory, and sought preliminary injunctions to keep the ban from being enforced while the lawsuits proceed. Smith Camp consolidated the lawsuits, but said she did not want to rule on any motions until satisfied the challenge should be heard in federal court.

The ban still won't go into effect as planned this week because the Fremont City Council voted to temporarily suspended the ordinance until the lawsuits are resolved.

Smith Camp noted both lawsuits claim the ordinance violates Nebraska law because Fremont exceeded its municipal powers under state law by adopting the ordinance.

"At this time, it seems to me this case needs to be argued in state court, not federal court," Smith Camp said. "I don't have subject-matter jurisdiction if the claim can be resolved in state court."

Smith Camp gave attorneys until Aug. 16 to file briefs arguing why the case should be heard in federal court. She will decide whether the case will continue in federal court after reviewing the briefs.

Attorneys for the groups declined to comment following the Wednesday hearing.

The attorney Fremont council members voted to hire to defend the ordinance, Kansas-based law professor Kris Kobach, said via teleconference with the court Wednesday that the city would not take any action to reverse the suspension while the court decides whether it has jurisdiction.

Kobach drafted the Fremont ordinance and offered to represent the city for free to fight the lawsuits. He also helped write Arizona's new controversial immigration law.

Fremont, a city of 25,000 west of Omaha, is among a handful of Nebraska cities that have seen marked demographic changes primarily because of an influx of Hispanic workers at meatpacking plants. The ordinance has divided the community between those who say it makes up for what they call lax federal law enforcement and others who argue it could fuel discrimination.

Fremont's ordinance would require employers to use a federal online system that checks whether a person is permitted to work in the U.S.

It also would require people seeking to rent property to apply for a $5 permit at City Hall. Those who said they were citizens would receive a permit and would not have to provide documents proving legal status. Those who said they weren't citizens would receive permits, but their legal status would be checked. If they're found to be in the country illegally and are unable to resolve their status, they would be forced to leave the property.

Landlords who knowingly rent to illegal immigrants could be subject to $100 fines.

The ordinance has put Fremont on the list with Arizona and other places in the national debate over immigration regulations. Arizona's sweeping new law takes effect Thursday, but a federal judge blocked the most controversial sections Wednesday.

Arizona's overall law still will be enacted Thursday, but without certain provisions, including a requirement that officers check a person's immigration status while enforcing other laws.

I find this whole illegal immigrant(sp?) debate interresting. On the one hand people are against anyone not American being in the country w/o proper documentation. And on the other are people who don't mind if people are here illegally as long as they keep their mouths shut and do the cheap labor jobs available. My question is: what about the illegal immigrants(sp?) from Canada, Europe, and other countries who are fair skinned? I have met people whose Visa's have run out, but remain in the country regardless, w/o worry of being deported and a lot of them say they don't worry due to their fair skin color. Yes, if you go to a country where you don't have proper documentation, there should be laws in place. But instead of just rounding people up and sending them back, can we look at each person's case individually? I don't know the solution to solve this issue, but with tempers flaring and people starting to police their own communities, creating lists of who they suspect are here illegally, I'm becoming nervous as a Black American woman, when will people start asking me if I am from Africa and demand I prove my citizenship(sp?)? Scary stuff.

This is about hate. Fremont is 25,000 of which 93% are white - so exactly how many illegal immigrants do they have? This town has a lot better things to spend time and money on.

What are those numbers based on? Illegal immigrants tend to not participate in census polling so there is no accurate number of how many could be living there. Last I checked, some illegals are white too.

full amnesty is really the way to go for both parties on this issue, but republicans miss the big picture... make them legal and let them start paying taxes and pretty soon all the undesirables will mosey on back where they came from and only the hard-working immigrants will stay, especially if our green jobs plan includes a provision for picking up garbage on the road if an individual receives public assistance

I'm down for making them legal, if for no other reason than so we can give them social security numbers and drivers licenses... at least we'd be able to tell who is who and actually keep them from skipping court dates on their traffic tickets, misdemeanors, and fishing violations... for the violent and/or sneaky coyote types, I propose a 1 mile wide swath along the border to be used as a free-fire range for airborne vehicles of all branches of the military... they could use the practice to cut down on civilian casualties on A-stan

Read that statement again closely - there's an influx of Hispanics, but "illegal immigration" has stirred opinions. The subtext here is that the influx is not all illegal immigrants.

Of course it's an idea. That's what Republicans are trying to prevent by pitting the people against illegals. If they were made legal and paid taxes, then the corporate exploiters wouldn't be able to get their slaves. If they pretend it's about following the "law", then they can continue to exploit the rage, knowing full well that it is impossible to remove 15 million people. They know that, as citizens, they would demand actual rights. It's been a tool for many different things for years.

Yes the Huff Post has a lot of Progressives here, but as you know, Dems, Libs and Progressives actually listen and are not fearful of the actual voter and we enjoy debating them here with facts.

Because of that, is why I come on here. I am a Liberal, and proud of it. I have some conservative views as well...My main goal is trying to reach just one of the opposing ideology voters, to at least listen.
